At bottom, that is what this dispute is about: can the Executive displace clear congressional command in the name of resource allocation and enforcement goals? Here, the answer is no,\u201d Newman added.<\/p>\n<p>Newman denied the Department of Homeland Security\u2019s (DHS) motion to dismiss and granted a preliminary injunction, preventing the enforcement and implementation of the civil immigration policies put forth by the administration. <strong><a href=\"https:\/\/dailycaller.com\/2022\/03\/11\/ice-deportations-joe-biden-immigration\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018Sanctuary Country\u2019: ICE Deportations, Arrests See Dramatic Drop Under Biden)<\/a><\/strong><\/p>\n<p>Brnovich called the decision a \u201ctremendous victory\u201d in a statement first released to the Daily Caller News Foundation.<\/p>\n<p>\u201cSince assuming office, the Biden administration has undermined our immigration laws and our law enforcement agencies, while empowering dangerous cartels and criminals on both sides of the border,\u201d he said. \u201cI\u2019m grateful for this ruling and for the partnership of Ohio and Montana as we work to reverse this catastrophic lawlessness.\u201d<\/p>\n<p>Knudsen echoed Brnovich\u2019s sentiments in a statement to the DCNF, saying that he hopes the administration \u201cwill follow the court order and start following the law when it comes to deportations, particularly for those illegal aliens who have prior criminal convictions.\u201d<\/p>\n<p><a title=\"View Preliminary Injunction AGs V. Biden<\/a> by <a title=\"View Daily Caller News Foundation&#039;s profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/292804634\/Daily-Caller-News-Foundation#from_embed\">Daily Caller News Foundation<\/a> on Scribd<\/p>\n<p>DHS changed its civil immigration enforcement through a series of memos over the course of 2021, the <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/publications\/21_0120_enforcement-memo_signed.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">first<\/a> of which from DHS Acting Secretary David Pekoske in January 2021 instructed the department to review its immigration enforcement \u201cpolicies and practices.\u201d The agency also instructed officials to prioritize civil immigration enforcement measures on those posing risks to national security, border security and public safety and implemented a 100-day pause on removals of noncitizens.<\/p>\n<p>DHS Secretary Alejandro <a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/republican-texas-lance-gooden-letter-joe-biden-title-42\/\" target=\"_blank\" rel=\"noopener noreferrer\">Mayorkas<\/a> issued a <a href=\"https:\/\/www.ice.gov\/doclib\/news\/guidelines-civilimmigrationlaw.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">memo<\/a> in September 2021 echoing the priorities and encouraging \u201cdiscretion\u201d when it comes to immigration enforcement.<\/p>\n<p>\u201cIt is estimated that there are more than 11 million undocumented or otherwise removable noncitizens in the United States,\u201d Mayorkas wrote. \u201cWe do not have the resources to apprehend and seek the removal of every one of these noncitizens. Therefore, we need to exercise our discretion and determine whom to prioritize for immigration enforcement action.\u201d<\/p>\n<p>\u201cThe fact an individual is a removable noncitizen therefore should not alone be the basis of an enforcement action against them,\u201d he added. \u201cWe will use our discretion and focus our enforcement resources in a more targeted way.
