Jackson evaded answering the question, replying, \u201cI don\u2019t know,\u201d then laughed.<\/p>\n<p>Kennedy asked, \u201cWhen does life begin, in your opinion?\u201d<\/p>\n<p>\u201cSenator, I don\u2019t know,\u201d Jackson answered as she laughed uncomfortably.<\/p>\n<p>\u201cMa\u2019am?\u201d Kennedy queried.<\/p>\n<p>\u201cI don\u2019t know,\u201d Jackson repeated.<\/p>\n<p>\u201cYou have a belief?\u201d Kennedy persisted.<\/p>\n<p>\u201cI have personal, religious and otherwise beliefs that have nothing to do with the law in terms of when life begins, \u201c Jackson responded.<\/p>\n<p>\u201cDo you have a personal belief, though, about when life begins?\u201d Kennedy prodded.<\/p>\n<p>\u201cI have a religious view \u2014\u201d Jackson started.<\/p>\n<p>\u201cA religious belief?\u201d Kennedy interjected.<\/p>\n<p>\u201c \u2014 that I set aside when I am ruling on cases,\u201d Jackson finished.<\/p>\n<p>\u201cOkay. When does equal protection of the laws attach to a human being?\u201d Kennedy shifted.<\/p>\n<p>\u201cWell, Senator, I believe the Supreme Court \u2014 actually \u2014 actually I don\u2019t know the answer to that question. I\u2019m sorry. I don\u2019t,\u201d Jackson dodged.<\/p>\n[embedded content]\n<p><a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/19\/legal-stances-ketanji-jackson\/\">The Washington Post<\/a>, writing of Jackson\u2019s position on abortion, noted:<\/p>\n<blockquote>\n<p><em>\u2026 she ruled against the Trump administration\u2019s decision to cut grant funding under the federal Teen Pregnancy Prevention Program. In\u00a0<a href=\"https:\/\/cases.justia.com\/federal\/district-courts\/district-of-columbia\/dcdce\/1:2018cv00346\/193532\/22\/0.pdf?ts=1526127333\">Policy and Research v. HHS,<\/a>\u00a0she found that the administration had not properly grounded its action in the mandates of the Administrative Procedure Act. As a lawyer in private practice, Jackson wrote an\u00a0<a href=\"https:\/\/cdn.cnsnews.com\/attachment\/1-AMICUS%20BRIEF-MCGUIRE%20V%20REILLY-KETANJI%20BROWN%20JACKSON.pdf\">amicus brief<\/a>\u00a0on behalf of women\u2019s groups defending a Massachusetts law that kept abortion protesters away from the entrances of facilities.<\/em><\/p>\n<\/blockquote>\n<p>The amicus brief <a href=\"https:\/\/cdn.cnsnews.com\/attachment\/1-AMICUS%20BRIEF-MCGUIRE%20V%20REILLY-KETANJI%20BROWN%20JACKSON.pdf\">states<\/a>:<\/p>\n<blockquote>\n<p><em>Few American citizens who seek to exercise constitutionally protected rights must run a gauntlet through a hostile, noisy crowd of \u201cin-your-face\u201d protesters. Still fewer citizens, when seeking medical or surgical care \u2014 particularly care involving deeply private matters \u2014 must confront a crowd swarming around them, shouting in their faces, blocking their way, and thrusting disturbing photographs and objects at them. Yet on any given day, patients of reproductive health clinics may face all of these. \u2026<\/em><\/p>\n<p><em>Both patients and reproductive health care workers have been waylaid by screams shouted inches from their ears and gruesome placards shoved under their noses. The chaotic scenes, in which protest may go far beyond mere \u201cspeech,\u201d are well-documented. They also are extremely frightening. \u2026\u00a0<\/em><\/p>\n<p><em>The purpose of the statute at issue here is to regulate conduct, not pure speech. Demonstrators who wish to express their support for or opposition to abortion may still do so in almost any manner they choose, including by yelling or displaying disturbing visual images. What is regulated, however, is a form of conduct that has proven over time to be threatening and dangerous to women attempting to enter a clinic: \u201cin-your-face\u201d confrontations.
