Chuck Grassley (R-IA) about a D.C. District Court ruling in which she <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/25\/bidens-scotus-nominee-helped-strike-down-trumps-border-controls\/\">bypassed<\/a> federal statute to declare that former President Donald Trump\u2019s administration could not expand expedited deportation.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cExpedited removal \u2026 a way in which Congress had given the authority to the Department of Homeland Security to make a decision about how to deport people, who are noncitizens,\u201d Jackson stated, opting for President Joe Biden\u2019s <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/12\/15\/report-biden-agencies-purge-term-alien-favor-noncitizen\/\">preferred<\/a> characterization\u00a0of illegal aliens.<\/p>\n<p>In the 2019 case, the pro-mass immigration group Make the Road New York sued the Trump administration for its expanded expedited deportation of illegal aliens.<\/p>\n<p>Whereas expedited removal had long only applied to illegal aliens who crossed by land, were encountered near the border, and had been in the U.S. for no longer than 14 days, Trump sought to expand the process to include illegal aliens encountered across the U.S. for up to two years after they arrived.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Jackson\u00a0<a class=\"x5l\" href=\"https:\/\/cases.justia.com\/federal\/district-courts\/district-of-columbia\/dcdce\/1:2019cv02369\/209974\/40\/0.pdf?ts=1569662340\" target=\"_blank\" rel=\"noopener external\">issued<\/a>\u00a0a preliminary injunction to halt the policy on the grounds that the administration violated the Administrative Procedure Act (APA) and did not sufficiently weigh the impact that the policy would have on illegal aliens.<\/p>\n<div id=\"attachment_20118202\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/media.breitbart.com\/media\/2022\/03\/GettyImages-1372827340.png\"><\/a><\/p>\n<p class=\"wp-caption-text\">Judge Ketanji Brown Jackson makes brief remarks after U.S. President Joe Biden introduced her as his nominee to the U.S. Supreme Court during an event in the Cross Hall of the White House February 25, 2022, in Washington, DC. (Drew Angerer\/Getty Images)<\/p>\n<\/div>\n<p>The\u00a0U.S. Court of Appeals for the District of Columbia Circuit reversed, telling Jackson that she exceeded her legal authority because the statute left this matter to the discretion of the Department of Homeland Security (DHS) and did not empower a federal judge to override that judgment.<\/p>\n<p>Grassley noted that Congress gave DHS \u201csole and unreviewable discretion whether expedited removal would apply to an alien who has not been paroled or admitted to the United States.\u201d<\/p>\n<p>\u201cThe law specifically says that Homeland Security, not the courts, was responsible for making that decision. Could you please explain why you believe a federal court could review something congress called \u2018unreviewable?&#8217;\u201d Grassley asked.<\/p>\n<p>Jackson defended her ruling, stating:<\/p>\n<blockquote>\n<p>The challenge was not about the actual determination. The challenge was about the procedures that the agency undertook to make that determination. And so that statute said \u2026 that the agency had \u2018sole and unreviewable discretion to decide and in interpreting that, <strong>I took into account the language of that statute and the language of another statute that Congress has enacted to direct agencies with respect to the manner in which they exercise their discretion<\/strong>. [Emphasis added]\n<\/blockquote>\n<p>Later, though, the D.C. Circuit appeals court\u00a0<a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/F398C868A41E007D85258590004E10B3\/$file\/19-5298-1848499.pdf\">reversed<\/a> Jackson\u2019s decision.<\/p>\n<p>\u201cWe hold that the district court properly exercised jurisdiction under 8 U.S.C. \u00a7 1252(e) over the Associations\u2019 claims, but that there is no cause of action under the Administrative Procedure Act to scrutinize the Secretary\u2019s designation decision so long as it falls within statutory and constitutional bounds,\u201d the court stated.<\/p>\n<p>As Breitbart News previously reported, Jackson has <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/28\/joe-biden-scotus-nominee-refuses-illegal-alien-noncitizen\/\">used <\/a>the terms \u201cnoncitizen\u201d and \u201cundocumented non-citizens\u201d in prior rulings rather than using the terms \u201calien\u201d and \u201cillegal alien,\u201d which are regularly used in court and federal statutes.<\/p>\n<p><strong><em>John Binder is a reporter for Breitbart News.
