Ted Cruz (R-TX) on Tuesday told President Joe Biden\u2019s Supreme Court nominee Kentanji Brown Jackson that if her views from law school were applied broadly, \u201ccivil commitment laws across the country would be struck down, releasing sexual predators.\u201d<\/p>\n<p>Cruz brought up her 1996 Harvard Law Review note during the second day of Jackson\u2019s confirmation hearing, reading aloud excerpts from her major academic worked entitled \u201cPrevention vs. Punishment: Toward a Principled Distinction in the Restraint of Released Sex Offenders.\u201d Cruz argued that Jackson was advocating for the idea that the regulated release of sex offenders \u2014 which can require them to register with local law enforcement officials, notify community members of their presence, undergo DNA testing, and submit to civil commitment for an indefinite term \u2014 could be seen as unconstitutional if the regulations are viewed as punitive rather than preventative.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cIf the views you advocated for in law school prevailed, civil commitment laws across the country would be struck down, releasing sexual predators. And under the argument, community notification and DNA bank laws could well be struck down as well. Is that an outcome that should concern people?\u201d Cruz asked Jackson.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Jackson said she \u201cwas not advocating for the striking down of those laws.\u201d<\/p>\n<p>\u201cMy note was trying to identify criteria that I thought could be applied consistently to determine whether the laws were punitive or preventative,\u201d she said, later stating that she was looking at four different kinds of laws and did not label them all \u201cpunitive.\u201d<\/p>\n<p>In response, Cruz narrowed his critique down to Jackson\u2019s law school take on Civil Commitment laws.<\/p>\n<p>If you look at Civil Commitment laws, the UCLA School of Law Williams Institute estimates more than 6,300 sex offenders are currently detained by civil commitment programs,\u201d the senator said. \u201cIf the view you advocated prevailed, presumably, those 6,300 sex offenders would be released to the public. Is that an outcome that should be concerning?\u201d Jackson replied:<\/p>\n<blockquote>\n<p>Senator, in law school when I was writing a note, I was looking at a brand new set of laws that had not previously been enacted in any jurisdiction \u2014 they were new. I was assessing at the time, as law school students do, what criteria I thought might be used by courts to make a determination in the future as to whether or not they should be treated as punitive and therefore \u2014 not unconstitutional \u2014 but therefore, ones that carry with them certain rights versus preventative\u2014<\/p>\n<\/blockquote>\n<p>Cruz interrupted Jackson to explain that while he understands that the views she may have held as a student could have changed, he believes her view is \u201cone that has continued.\u201d<\/p>\n<p>The GOP senator\u2019s line of questioning was part of a larger line of questioning throughout the hearing: whether Jackson has a sentencing record of being soft on child porn offenders. Jackson\u2019s potential \u201cleniency\u201d in child porn offender cases was first brought to public attention by Sen. Josh Hawley (R-MO) who published a\u00a0<a href=\"https:\/\/twitter.com\/HawleyMO\/status\/1504221933046534146\">Twitter thread<\/a>\u00a0of Jackson\u2019s rulings, interviews, articles, and speeches and <a href=\"https:\/\/www.breitbart.com\/crime\/2022\/03\/17\/hawley-bidens-scotus-pick-pattern-letting-child-porn-offenders-off-hook\/\">accused<\/a> her of having \u201ca pattern of letting child porn offenders off the hook for their appalling crimes.\u201d<\/p>\n<div class=\"entry-content\">\n<p><em>Katherine Hamilton is a political reporter for Breitbart News.
