\/><\/div>\n<p class=\"p1\">Abortion advocates are taking cases to court and suing several pro-life organizations in challenges to Texas\u2019s pro-life law.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">The law in question is S.B. 8, which prohibits abortions after fetal cardiac activity can be detected, which typically occurs around six weeks of pregnancy.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Several efforts have been made by pro-abortion groups to sue in order to block the law, but the challenges have met hurdles due to the structuring of the legislation.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">As The Daily Wire previously\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rejects-abortion-providers-request-to-stay-texas-heartbeat-law\"><span class=\"s1\">reported<\/span><\/a>, \u201cThe Texas law allows citizens to sue abortion providers and those who \u2018aid and abet\u2019 illegal procedures for a financial reward if the lawsuit is successful.\u201d <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">The specific language of the law has presented complications for pro-abortion groups who have struggled to find the correct people to sue, as was evident in a recent decision from Texas\u2019s Supreme Court.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Earlier this month, as The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/texas-supreme-court-deals-devastating-blow-to-pro-abortion-supporters\"><span class=\"s1\">reported<\/span><\/a>, \u201cTexas\u2019s Supreme Court unanimously ruled against abortion supporters on Friday, dealing a final blow to a challenge to the state\u2019s abortion ban.\u201d<\/p>\n<p class=\"p1\">\u201cTexas law does not grant the state-agency executives named as defendants in this case any authority to enforce the Act\u2019s requirements, either directly or indirectly,\u201d the\u00a0<a href=\"https:\/\/www.txcourts.gov\/media\/1453763\/220033.pdf\"><span class=\"s1\">court ruling said<\/span><\/a>. \u201cSenate Bill 8 provides that its requirements may be enforced by a private civil action, that no state official may bring or participate as a party in any such action, that such an action is the exclusive means to enforce the requirements, and that these restrictions apply notwithstanding any other law.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">\u201cBased on these provisions,\u201d the court continued, \u201cwe conclude that Texas law does not grant the state-agency executives named as defendants in this case any authority to enforce the Act\u2019s requirements, either directly or indirectly.\u201d<\/p>\n<p class=\"p1\">The U.S. Supreme Court <a href=\"https:\/\/www.dailywire.com\/news\/scotus-rules-in-texas-pro-life-cases-abortion-providers-can-sue-state-doj-challenge-dismissed-law-can-remain-in-effect\"><span class=\"s1\">previously ruled<\/span><\/a> that a lawsuit could continue in the state of Texas in an effort to block the law, but it was allowed to continue to stand.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">New lawsuits, however, might prove to be more successful for those who wish to block the law and allow abortions to take place after a fetal heartbeat can be detected.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">As The Washington Post <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/21\/texas-abortion-sb8\/\"><span class=\"s1\">reported<\/span><\/a>, the Lilith Fund and the North Texas Equal Access Fund are suing the\u00a0<span class=\"s2\">America First Legal Foundation<\/span>\u00a0and the\u00a0<span class=\"s2\">Thomas More Society<\/span> in federal court, and two private citizens in Texas state court.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">The funds \u201cprovide financial, emotional, and logistical support for abortion patients all over Texas,\u201d per <a href=\"https:\/\/www.lilithfund.org\/wp-content\/uploads\/2022\/03\/Chicago-Complaint.pdf\"><span class=\"s1\">one<\/span><\/a> of the lawsuits.<\/p>\n<p class=\"p1\">The lawsuit noted that the fund groups \u201cbring this lawsuit to protect themselves, their staff, their volunteers, and their donors from [Thomas More Society\u2019s] unlawful attempts to intimidate Plaintiffs and prevent them from exercising their rights under the U.S. Constitution.\u201d<\/p>\n<p class=\"p1\">Among other requests, in both of the <a href=\"https:\/\/www.lilithfund.org\/wp-content\/uploads\/2022\/03\/3.16.2022-TEA-Lilith-v.-AFLF-Complaint-with-Exhibits-small.pdf\"><span class=\"s1\">challenges<\/span><\/a>, the groups want the courts to declare that \u201cthe private civil enforcement procedures of SB8 are unconstitutional, void, of no effect, and therefore not usable \u2026\u201d<\/p>\n<p class=\"p1\">The lawsuits were filed in Washington, D.C., and Chicago, which means they will not go through the U.S. Court of Appeals for the Fifth Circuit, which is known for being more conservative and has decided to keep the pro-life law in the past. \u201cIf the lawsuits are appealed, they would instead be heard by the U.S. Court of Appeals for the 7th Circuit Court and U.S. Court of Appeals for the District of Columbia Circuit,\u201d the Post noted.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Two days after the fund groups filed their challenges, state Representative Briscoe Cain (R) put forward cease and desist letters to all Texas abortion funds, saying they are \u201ccriminal organizations.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">\u201cIt is a crime to pay for another person\u2019s abortion in Texas, and anyone who gives money to these abortion funds will be prosecuted,\u201d Cain wrote. He also said he was planning to introduce a measure next session that would \u201censure that abortion providers and funds are prosecuted for their crimes even when they reside in counties where the local district attorney refuses to enforce the state\u2019s abortion laws.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Today, I sent cease-and-desist letters to abortion funds and Citigroup informing them of current abortion laws in Texas.
