So once the internet came in and people got access to hundreds and then thousands of photos, they would, the sentencing guidelines would reflect hundreds and then thousands of photos.\u201d<\/p>\n<p>Toobin went on to suggest that the increased availability naturally led to much greater numbers of photos that people possessed \u2014 and that the sentencing recommendations did not reflect that change.<\/p>\n<p>\u201cWhat I thought Chairman Durbin pointed out is that judges across the country, including Republican appointed judges, have been saying, look, we can\u2019t apply the rules that were designed pre-internet for an internet society and many judges have been giving somewhat less sentences as a result and I thought that was a very clear explanation of why Judge Jackson imposed sentences that were all prison sentences. It wasn\u2019t like she was letting these people go, but they were somewhat less than the guidelines because the guidelines had not been adapted for the internet era,\u201d Toobin concluded.<\/p>\n<p>Jackson\u2019s own defense of her recommendations was almost identical to Toobin\u2019s: \u201cCourts are adjusting their sentences in order to account for the changed circumstances.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Judge Jackson: Sentencing guidelines for child pornography offenders are &#8220;leading to extreme disparities in the system.&#8221;<\/p>\n<p>&#8220;Courts are adjusting their sentences in order to account for the changed circumstances\u2026&#8221; <a href=\"https:\/\/t.co\/H0ZeyRAGm6\">pic.twitter.com\/H0ZeyRAGm6<\/a><\/p>\n<p>\u2014 Townhall.com (@townhallcom) <a href=\"https:\/\/twitter.com\/townhallcom\/status\/1506265786528243717?ref_src=twsrc%5Etfw\">March 22, 2022<\/a><\/p>\n<\/blockquote>\n<p>Senator Josh Hawley (R-MO) <a href=\"https:\/\/dailywire.com\/news\/hawley-biden-scotus-nominee-has-a-pattern-of-letting-child-porn-offenders-off-the-hook\/\">brought the topic to the forefront<\/a> ahead of the hearings that started Monday, saying that he was concerned to see her discretionary sentences for those convicted of child pornography possession were often much lighter than either the law or the prosecution recommended.<\/p>\n<p>As The Daily Wire reported:<\/p>\n<blockquote>\n<p><em>I\u2019ve been researching the record of Judge Ketanji Brown Jackson, reading her opinions, articles, interviews &#038; speeches,\u201d the senator said. \u201cI\u2019ve noticed an alarming pattern when it comes to Judge Jackson\u2019s treatment of sex offenders, especially those preying on children.<\/em><\/p>\n<p><em>Hawley claimed that as far back as during Jackson\u2019s time in law school, the judge has questioned whether convicts should be made to register as sex offenders and said that it leads to \u201cstigmatization and ostracism.\u201d<\/em><\/p>\n<p><em>\u201cShe\u2019s suggested public policy is driven by a \u2018climate of fear, hatred &#038; revenge\u2019 against sex offenders,\u201d Hawley tweeted.<\/em><\/p>\n<p><em>\u201cIt gets worse,\u201d he warned. \u201cAs a member of the U.S. Sentencing Commission, Judge Jackson advocated for drastic change in how the law treats sex offenders by eliminating the existing mandatory minimum sentences for child porn.\u201d<\/em><\/p>\n<\/blockquote>\n<p>The White House <a href=\"https:\/\/dailywire.com\/news\/white-house-slams-hawley-allegations-about-biden-scotus-nominees-lax-record-on-child-pornographers-as-toxic-and-weakly-presented-misinformation\/\">responded<\/a> to Hawley\u2019s accusations, as spokesman Andrew Bates declared his words \u201ctoxic and weakly-presented misinformation that relies on taking cherry-picked elements of her record\u00a0out of context.\u201d<\/p>\n<p><i>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
