She also helped draft and file several amicus briefs on behalf of clients speaking in favor of the arguments made by Guantanamo Bay detainees. Although Jackson and Democrats have noted the constitutional protections provided to accused terrorists, Republicans argue that her defense of the detainees went beyond merely doing her job as a defense attorney.<\/p>\n<p>Sens. Lindsey Graham of South Carolina and John Cornyn of Texas both asked Jackson about briefs while she filed while representing both captured alleged terrorists and parties interested in their cases. Jackson drafted amicus briefs in the cases <a href=\"https:\/\/ccrjustice.org\/sites\/default\/files\/assets\/Brief%20on%20Behalf%20of%20Former%20Federal%20Judges%20as%20Amici%20Curiae%20in%20Support%20of%20Petitioners.pdf\"><em>Boumediene v. Bush<\/em><\/a> and <a href=\"https:\/\/web.archive.org\/web\/20151002113651\/http:\/www.americanbar.org\/content\/dam\/aba\/publishing\/preview\/publiced_preview_briefs_pdfs_07_08_08_368_ReversalAmCuCATOInstConstProjandRutherfordInst.authcheckdam.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Al-Marri v. Spagone<\/em><\/a> while working as an attorney at the law firm Morrison &#038; Foerster. In the <em>Boumediene <\/em>brief, Jackson and her clients, a group of former federal judges, argued that the federal government could not use information obtained from alleged terrorists through torture in legal proceedings.<\/p>\n<p>Graham and Cornyn suggested that Jackson\u2019s briefs signaled that she would be overly sympathetic to terrorism suspects. <a href=\"https:\/\/dailycaller.com\/2022\/03\/21\/senators-signal-three-issues-define-ketanji-brown-jackson-hearing-supreme-court\/\"><strong>(RELATED: Senators Signal Three Issues That Will Define The Ketanji Brown Jackson Hearings)<\/strong><\/a><\/p>\n<p>\u201cThe American people deserve a system where everybody is represented, whether you like them or not, and anybody who takes up that cause, no problem with me, you\u2019re just doing your job and I think you\u2019re making our country stronger,\u201d Graham said.<\/p>\n<p>However, he added, \u201cthe American people deserve a system that can keep terrorists off the battlefield. McCoy\/U.S. Navy via Getty Images)<\/p>\n<\/div>\n<p>Graham noted Jackson\u2019s argument in the <em>Al-Marri <\/em>brief, made on behalf of three non-profit organizations. In that brief, Jackson argued on behalf of her clients that the Executive Branch may not \u201c<span id=\"page38R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">use the military to <\/span><span dir=\"ltr\" role=\"presentation\">detain,<\/span> <span dir=\"ltr\" role=\"presentation\">without<\/span> <span dir=\"ltr\" role=\"presentation\">charge<\/span> <span dir=\"ltr\" role=\"presentation\">or<\/span> <span dir=\"ltr\" role=\"presentation\">trial,<\/span> <span dir=\"ltr\" role=\"presentation\">persons who are <\/span><span dir=\"ltr\" role=\"presentation\">lawfully in the United States and who have allegedly <\/span><span dir=\"ltr\" role=\"presentation\">engaged in terrorism-related conduct.\u201d<\/span><\/span><\/p>\n<p>When asked whether or not she personally agreed with the arguments in the brief, Jackson declined to say.<\/p>\n<p>\u201cMy responsibility was to make my clients\u2019 arguments,\u201d she responded to Graham. \u201cThe Supreme Court did not address that issue. The case became moot.\u201d<\/p>\n<p>Both Graham and Cornyn called attention to a passage in a habeas corpus petition filed on behalf of Khiali-Gul, an Afghan <a href=\"https:\/\/www.nytimes.com\/interactive\/2021\/us\/guantanamo-bay-detainees.html#detainee-928\">detainee<\/a> captured in 2002 and released in 2014. Jackson was a member of Gul\u2019s defense team and helped draft the 2005 <a href=\"https:\/\/www.scribd.com\/document\/556639705\/Gul-v-Bush-amended-habeas-petition\">brief<\/a>, which claimed that government officials committed war crimes and crimes against humanity against him. The brief lists \u201cc<span class=\"a\">onditions of isolation; constant vulnerability to repeated interrogation <\/span><span class=\"a\">and severe beatings; [and] the threat or reality of being kept in cages with no privacy,\u201d among other treatment, and names President George W. Bush and Secretary of Defense Donald Rumsfeld as chief defendants.<\/span><\/p>\n<p>\u201cWhy in the world would you call Secretary of Defense Rumsfeld and George W. Bush war criminals in a legal filing?\u201d Cornyn asked. \u201cIt seems so out of character for you.\u201d<\/p>\n<p>Denying that she remembered the brief in question, Jackson claimed that she did not \u201cintend to disparage the President or the Secretary of Defense.\u201d<\/p>\n<p>\u201cWell being a war criminal has serious ramifications,\u201d Cornyn shot back. \u201cYou could be subject to the International Criminal Court and hauled before the international tribunal and tried for war crimes. It\u2019s not a casual comment I would suggest.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2017\/11\/04\/international-criminal-court-wants-war-crimes-probe-into-us-soldiers-in-afghanistan\/\">(RELATED: International Criminal Court Wants War Crimes Probe Into US Soldiers In Afghanistan)<\/a><\/strong><\/p>\n<p>Senate Judiciary Committee chairman Dick Durbin revisited the exchange following the committee\u2019s lunch recess. Durbin claimed that Jackson \u201cat no time\u201d referred to either Bush or Rumsfeld as war criminals.<\/p>\n<p>Republicans have repeatedly sought to portray Jackson as soft on crime, owing to her work as a public defender, her time as vice chair of the U.S. Sentencing Commission, and her sentencing decisions during her time as a District Court judge. Missouri Sen. Josh <a href=\"https:\/\/dailycaller.com\/2022\/03\/17\/alarming-pattern-josh-hawley-supreme-court-nominee-ketanji-brown-jackson-record-child-porn\/\">Hawley<\/a> and Tennessee Sen.
