The editors gnashed their teeth that banks are being pressured by politicians on both sides of the aisle to pick winners and losers in the American economy.<\/p>\n<p>They are right about the need for lending institutions to stay above the fray. They are also wrong to think that anyone dragged banks into the public policy arena. They marched into the fray to the drumbeat of the \u201cwoke\u201d band cheering them on.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Ending the blatant discrimination against a Constitutionally-protected industry, such as the firearm industry, is a matter of ensuring that ivory-tower, unaccountable corporate boardroom executives do not dictate which rights Americans choose to exercise. Discrimination against the firearm industry is a conscious decision by these corporate entities to slowly choke off American firearm manufacturing, and with it the Second Amendment.<\/p>\n<p>This is how they plan to exact gun control through corporate fiat. Eliminating the industry that produces firearms for law-abiding Americans means Americans can\u2019t exercise their Second Amendment rights.<\/p>\n<p><strong>Banks Discriminate<\/strong><\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Banks, and news editors, must be honest. This is a fight the banks started, and they can choose to end it immediately. They only need to drop business demands for gun control that exceeds federal and state law. It is not for banks to dictate public policy, especially when it comes to Constitutional rights.<\/p>\n<p>Bank of America <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/bank-america-stops-financing-makers-military-style-rifles-n865106\">announced<\/a> in 2018 that they would no longer conduct business with firearm manufacturers producing Modern Sporting Rifles (MSRs), or AR-15-style rifles, vilifying the most-popular selling rifle in America as \u201cmilitary-style\u201d firearms for civilians. Bank of America\u2019s then-vice chairman Anne Finucane <a href=\"https:\/\/www.bloomberg.com\/news\/videos\/2018-04-10\/bofa-s-finucane-on-coal-lending-to-gun-companies-green-bonds-video\">made<\/a> the announcement on Bloomberg TV. That is something that Bloomberg editors failed to note. They missed it again when their own reporters <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2021-04-28\/bofa-citi-risk-hit-to-business-in-texas-over-gun-policies#:~:text=Citigroup%20said%20it%20would%20prohibit,style%20rifles%20for%20civilian%20use.\">reported<\/a> it less than a year ago.<\/p>\n<p>Citigroup, too, <a href=\"https:\/\/www.nssf.org\/articles\/citibank-continues-to-deny-credit-to-firearms-industry\/\">enacted<\/a> discriminatory firearm policies more than a decade ago. The banking giant <a href=\"https:\/\/blog.citigroup.com\/2018\/03\/announcing-our-us-commercial-firearms-policy\/\">stepped up<\/a> their discrimination in 2018, refusing to do business with anyone who did not agree to <a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2021\/03\/NSSF-factsheet-Age-Discrimination-Laws.pdf\">age-based gun bans<\/a> that would deny Second Amendment rights to adults under 21, or those who sell standard-capacity magazines. Federal law allows adults at 18 to purchase rifles and shotguns.<\/p>\n<p>Bloomberg news <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2018-03-22\/citigroup-restricts-some-gun-sales-by-its-business-customers\">reported<\/a> on this in 2018. They also <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2021-11-04\/citi-said-to-take-key-step-to-restart-texas-muni-business\">reported<\/a> that Citigroup attested to the Texas Attorney General that they do not hold discriminatory policies against the firearm industry, despite the fact that their discriminatory policies are still <a href=\"https:\/\/blog.citigroup.com\/2018\/03\/announcing-our-us-commercial-firearms-policy\/\">posted<\/a> on their website. Another miss by Bloomberg\u2019s editors.<\/p>\n<p>JPMorgan Chase\u2019s CEO Jamie Dimon testified before Congress that the banking giant does not work with any business manufacturing AR-15-style rifles, maligning them as \u201cmilitary-style weapons for civilian use.\u201d That was enough for Louisiana\u2019s Republican Attorney General Jeff Landry and Republican state Treasurer John Schroeder to <a href=\"https:\/\/www.theadvocate.com\/baton_rouge\/news\/politics\/legislature\/article_39097b88-48c9-11ec-b115-1f65a34e1211.html\">bar<\/a> JPMorgan Chase from competing for state bonds. \u201cI\u2019m not selling our 2nd Amendment rights to corporate America,\u201d said Treasurer Schroder. And Attorney General Landry recently told his fellow Republican attorneys general at their January meeting, \u201cThe Second Amendment is not for sale.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Wells Fargo once stayed out of the \u201cwoke\u201d banking cabal. However, just two months after Wells Fargo and other banks got \u201c<a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-04-04\/bb-t-wells-fargo-get-failing-grades-from-gun-control-advocates\">failing grades<\/a>\u201d from gun control radicals Guns Down America, CEO Charles Scharf <a href=\"https:\/\/www.reuters.com\/article\/us-wells-fargo-guns\/wells-fargos-relationship-with-nra-is-declining-ceo-idUSKCN22A2ZU\">reported<\/a> the bank\u2019s relationship with the NRA was \u201cdeclining,\u201d adding the bank would no longer participate in line of credit or mortgage commitments. Wells Fargo has terminated banking relationships with several major firearm manufacturers because they refused the bank\u2019s demand that they stop manufacturing Modern Sporting Rifles.<\/p>\n<p>Bloomberg news <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-04-04\/bb-t-wells-fargo-get-failing-grades-from-gun-control-advocates\">reported<\/a> on the \u201cfailing grades\u201d at the time. That, too, was skipped by the editors.<\/p>\n<p><strong>Battling Back<\/strong><\/p>\n<p>The firearm industry is not fighting alone. Political leaders witnessed corporate banks\u2019 demands. Texas <a href=\"https:\/\/www.nssf.org\/articles\/nssf-praises-texas-gov-abbott-for-signing-find-act\/\">enacted<\/a> the Firearm Industry Nondiscrimination (FIND) Act, which tells these corporate banks that they cannot profit from Texas tax dollars and use those profits to fund efforts to deny those Texans their Second Amendment rights.<\/p>\n<p>Similar legislation is pending in eight states. It has also been <a href=\"https:\/\/www.nssf.org\/articles\/nssf-welcomes-rep-bergmans-find-act-introduction-in-congress\/\">introduced<\/a> in Congress by Rep. Jack Bergman (R-MI) as <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/6970?q=%7B%22search%22%3A%5B%22hr+6970%22%2C%22hr%22%2C%226970%22%5D%7D&#038;s=3&#038;r=1\">H.R. 6970<\/a>. That is in addition to the Fair Access to Banking Act (<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/563?q=%7B%22search%22%3A%5B%22s+563%22%2C%22s%22%2C%22563%22%5D%7D&#038;s=1&#038;r=2\">S. 563<\/a>\/<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1729?q=%7B%22search%22%3A%5B%22hr+1729%22%2C%22hr%22%2C%221729%22%5D%7D&#038;s=2&#038;r=1\">H.R. 1729),<\/a> introduced by Sen. Kevin Cramer (R-ND) and Rep. Andy Barr (R-KY) respectively. These bills would ensure that banking and credit decisions are based on objective, individualized credit worthiness and impartial risk-based standards. It would also prevent multinational financial institutions with over $10 billion in assets from accessing taxpayer-subsidized government programs, including access to the Federal Reserve Discount Window Lending Programs, Federal Deposit Insurance Company, and Automated Clearing House Network, if they are at the same time denying banking services to legal businesses under federal law.<\/p>\n<p>None of these bills, nor Texas\u2019s law, tells the banks they must do business with the firearm industry. Corporate banks are free to hold discriminatory policies should they choose. However, the FIND Acts would give states, and the Federal government, the same freedom to choose with whom they conduct business, especially when it means funding banks bent on destroying Second Amendment rights. The Fair Access to Banking Act only tells these corporate banks they cannot access taxpayer-funded insurances while at the same time destroying the taxpayers\u2019 Constitutional rights.<\/p>\n<p>Banks should assess their business decisions based on credit worthiness, not \u201cwoke\u201d political agendas. This is not a fight the firearm industry chose, but one thrust upon the industry when banks decided to choose winners and losers based on activist political agendas.<\/p>\n<p><em>Lawrence G.
