class=\"p3\">When it comes to the Second Amendment, many people simply think about guns, and for good reason. Firearms are typically what face the tightest controls and are what most people want to trust for self-defense.<\/p>\n<p class=\"p3\">However, the Second Amendment protects the right to keep and bear <i>arms<\/i>. That includes all kinds of weapons, including less-lethal weapons like stun guns and tasers.<\/p>\n<p class=\"p3\">Unfortunately, a number of states banned them.<\/p>\n<p class=\"p3\">One by one, such statewide bans fell before the courts, but few besides Rhode Island\u2019s remained. Now, <a href=\"https:\/\/www.bostonglobe.com\/2022\/03\/15\/metro\/federal-judge-strikes-down-ris-stun-gun-ban\/\" target=\"_blank\" rel=\"noopener\" class=\"stylish-link\">even that one has fallen<\/a>.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Just now in a lawsuit we&#8217;re watching, a federal judge struck down Rhode Island&#8217;s ban on stun guns and Tasers. This was the last statewide stun gun ban in the country. <a href=\"https:\/\/t.co\/arlZ7DRCOC\" class=\"stylish-link\">https:\/\/t.co\/arlZ7DRCOC<\/a> <a href=\"https:\/\/t.co\/X7ky5hh7tg\" class=\"stylish-link\">pic.twitter.com\/X7ky5hh7tg<\/a><\/p>\n<p>\u2014 Firearms Policy Coalition (@gunpolicy) <a href=\"https:\/\/twitter.com\/gunpolicy\/status\/1503846867561496592?ref_src=twsrc%5Etfw\" class=\"stylish-link\">March 15, 2022<\/a><\/p>\n<\/blockquote>\n<p class=\"p3\">This is fantastic news for the people of Rhode Island. Especially since the state also heavily restricts the private ownership of firearms.<\/p>\n<p class=\"p3\">It\u2019s an odd quirk that many gun control-favoring states, like Rhode Island, also like to restrict less-lethal self-defense options. You can\u2019t defend yourself with lethal force, but you can\u2019t defend yourself with less-lethal force, either.<\/p>\n<p class=\"p3\">Further, while proponents may argue that such tools in the hands of criminals will lead to assaults, particularly against women, the truth is that many women prefer to use something like a stun gun to a firearm anyway. That means these bans actually prevented women from choosing to do something <i>other<\/i> than seeking out a firearm for self-defense.<\/p>\n<p class=\"p3\">A bit of an oxymoron, if you ask me.<\/p>\n<p class=\"p3\">Attorney Eugene Volokh wrote over at The Volokh Conspiracy that now <a href=\"https:\/\/reason.com\/volokh\/2022\/03\/15\/r-i-stun-gun-ban-struck-down\/\" class=\"stylish-link\"><span class=\"s1\">only a couple of bans remain<\/span><\/a>.<\/p>\n<p class=\"p3\"><i>\u201cStun gun bans remain in effect, to my knowledge, in<\/i><\/p>\n<p>\u25cf <i>New York, where a <\/i><span class=\"s1\"><i>federal district court<\/i><\/span><i> held that the state stun gun ban was unconstitutional, but a <\/i><span class=\"s1\"><i>state trial court<\/i><\/span><i> in a different case disagreed (yes, state courts can do that),<\/i><\/p>\n<p>\u25cf <i>Wilmington (Delaware) and the county in which it is located (New Castle County),<\/i><\/p>\n<p>\u25cf <i>plus some smaller towns.<\/i><\/p>\n<p class=\"p3\"><i>Stun guns are also heavily regulated (e.g., with total bans on carrying in most places outside the home) in Connecticut and in some cities. New Jersey lawyer Dan Schmutter tells me that New Jersey likely also essentially bans carrying stun guns outside the home. For more, see <\/i><a href=\"http:\/\/www.law.ucla.edu\/volokh\/stungun.pdf\" class=\"stylish-link\"><span class=\"s1\">this article<\/span><\/a><i>, though the listing of restrictions in Appendix II is now out-of-date.\u201d<\/i><\/p>\n<p class=\"p3\">It\u2019s good to see the courts recognize that the Second Amendment doesn\u2019t just apply to firearms but rightfully should include less-lethal weapons. If only these few other places can be shown the error of their ways.<\/p>\n<p class=\"p3\">Doing so might allow a lot of people, particularly those who may not be permitted to own firearms due to various reasons, to have a way to protect themselves. Again, it\u2019ll also benefit people who want to protect themselves but don\u2019t feel they can pull the trigger on a gun pointing at another human being.<\/p>\n<p class=\"p3\">As it stands, though, folks in Rhode Island are a bit freer now than they were when they woke up Tuesday morning.<\/p>\n<p><strong>Like this article?
