Brad Little\u2019s (R) desk, CNN <a href=\"https:\/\/www.cnn.com\/2022\/03\/14\/politics\/idaho-abortion-bill-six-weeks\/index.html\">reported<\/a>. The law would allow the father, sibling, grandparent, aunt, or uncle of the unborn baby to sue the medical professional who performed the abortion.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cThe life of each human being begins at fertilization, and unborn preborn children have interests in life, health, and well-being that should be protected,\u201d the bill reads:<\/p>\n<blockquote>\n<p>Therefore, the state of Idaho has a compelling interest in protecting the life of a preborn child at all stages of its development, including after the preborn child has a detectable heartbeat, which signals rhythmically and without pause the presence of a precious and unique life, one that is independent and distinct from the mother\u2019s and one that is also worthy of our utmost protection.<\/p>\n<\/blockquote>\n<div id=\"attachment_20227892\" class=\"wp-caption alignnone\"><a href=\"https:\/\/media.breitbart.com\/media\/2022\/03\/Idaho-Gov-Brad-Little-Jan10-22-ap.jpg\"><\/a><\/p>\n<p class=\"wp-caption-text\">Idaho Gov. (AP Photo\/Otto Kitsinger)<\/p>\n<\/div>\n<p>The law\u2019s private enforcement mechanism is similar to Texas\u2019s pro-life law, which went into effect last fall. Under the Texas law, anyone in the United States may sue anyone who helped a pregnant woman obtain an abortion after six weeks or when a heartbeat has been detected. Both laws forbid state officials, government employees, politicians, etc. from enforcing the law themselves.<\/p>\n<p>However, Idaho\u2019s law differs from the Texas law in that women who are victims of rape or incest are able to obtain abortions if they are able to provide a copy of a police report to the physician who would perform the abortion. The law also departs from Texas\u2019s law in that only the doctor can be sued and only close family can sue.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Notably, the man accused of rape or incest is not allowed to sue an abortion provider under the law. The law would allow an exception for medical emergencies in which an abortion would be necessary \u201cto avert [a woman\u2019s] death\u201d or to fight against a \u201cserious risk of substantial and irreversible impairment of a major bodily function,\u201d according to the bill.<\/p>\n<p>According to the legislation, any licensed healthcare professional who \u201cintentionally, knowingly, or recklessly performs or induces an abortion\u201d violates the law and \u201ccommits the crime of criminal abortion.\u201d<\/p>\n<p>\u201cCriminal abortion shall be a felony punishable by a sentence of imprisonment of no less than two years and no more than five years in prison,\u201d the bill text reads. \u201cThe professional license of any health care professional who performs or induces an abortion or who assists in performing or inducing an abortion in violation of this chapter shall be suspended by the appropriate licensing board for a minimum of six months upon a first offense and shall be permanently revoked upon a subsequent offense.\u201d<\/p>\n<p>Planned Parenthood issued a statement, expressing dismay at the possibility that fewer unborn children will be terminated in the state.<\/p>\n<p><span>\u201cIdaho\u2019s anti-abortion lawmakers ignored public opinion and rushed through this legislation, looking to capitalize on the U.S. Supreme Court\u2019s failure to block Texas\u2019s ban,\u201d Planned Parenthood <\/span><a href=\"https:\/\/www.plannedparenthoodaction.org\/pressroom\/idaho-becomes-first-state-to-pass-copycat-texas-style-abortion-ban\"><span>claimed<\/span><\/a><span> in a statement<\/span><span>.\u00a0<\/span><span>\u201cThe bill\u2019s sponsors and supporters have even explicitly stated their desire for Idaho to be the next Texas.\u201d<\/span><\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p><span>The CEO of Planned Parenthood Jennifer Allen <a href=\"https:\/\/www.plannedparenthoodaction.org\/pressroom\/idaho-becomes-first-state-to-pass-copycat-texas-style-abortion-ban\">asked<\/a> Gov. Little to veto the legislation in a separate statement.\u00a0<\/span><\/p>\n<p>\u201cSB 1309 is a travesty grounded in bad motives, questionable legality, and no science at all. Governor Little must do the right thing, listen to the medical community, and veto this legislation before it forces Idaho patients to leave the state for critical, time-sensitive care or remain pregnant against their will,\u201d Allen said.<\/p>\n<p><span>GOP Rep. Steven Harris, the bill\u2019s sponsor <a href=\"https:\/\/idahocapitalsun.com\/2022\/03\/14\/texas-style-abortion-bill-heads-to-idaho-gov-brad-littles-desk\/\">said<\/a>\u00a0the law will \u201cend many abortions\u201d in the state.\u00a0<\/span><\/p>\n<p><span>\u201cWe heard in testimony in the committee; we heard in testimony here today that this will end many abortions in Idaho,\u201d Harris said.<\/span><span>\u00a0\u201cLet\u2019s save some babies.\u201d<\/span><\/p>\n<p><span>One of the bill\u2019s co-sponsors, state Rep. Barbara Ehardt (R), slammed the Supreme Court for ruling in favor of \u201cabortion rights\u201d in the 1973 case <em>Roe. v Wade<\/em>.\u00a0<\/span><\/p>\n<p><span>\u201cAbortion is not a constitutional right,\u201d Ehardt <\/span><a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/14\/abortion-ban-idaho-texas\/\"><span>said<\/span><\/a><span>. \u201cThe Supreme Court in 1973 did something that was never allowed in the first place.\u201d<\/span><\/p>\n<p><span><em>Katherine Hamilton is a political reporter for Breitbart News.
