W. Bush nominee, ruled on Feb. 2 to bar Secretary of Defense <a href=\"https:\/\/www.theepochtimes.com\/t-lloyd-austin\">Lloyd Austin<\/a> and all other military officials from taking punitive action against the unnamed Navy officer, who sought religious exemptions to the military\u2019s COVID-19 vaccine mandate.<\/p>\n<p>Merryday wrote that the Navy\u2019s rejection failed to note that the branch has separately granted hundreds of medical exemptions to the COVID-19 vaccine mandate<\/p>\n<p>The Navy officer was told he would be removed from command of his ship on Feb. 3 if he didn\u2019t start a COVID-19 vaccination series.<\/p>\n<p>Top military officials determined that the commander\u2019s religious beliefs were sincere and that they would be \u201csubstantially burdened\u201d by being forced to get vaccinated, but also claimed that granting the exemption request \u201cwould have a predictable and detrimental effect on the readiness of you and the Sailors who serve alongside you.\u201d<\/p>\n<p>On Feb. 28, the Navy asked Merryday for an emergency stay on the preliminary injunction, arguing that the judge\u2019s ruling prevents it \u201cfrom removing an officer from \u2026 commanding officer billets who the military has deemed unfit for command.\u201d<\/p>\n<p>\u201cThe order is an extraordinary intrusion upon the inner workings of the military that presents a direct and imminent threat to national security during a global military crisis, and it indefinitely sidelines a Navy warship,\u201d the Navy said, according to court papers, <a href=\"https:\/\/www.stripes.com\/branches\/navy\/2022-03-08\/navy-commander-coronavirus-vaccine-mandate-lawsuit-destroyer-5273860.html\">Stripes and Stars<\/a> reported.<\/p>\n<p>\u201cWith respect to Navy Commander, the Navy has lost confidence in his ability to lead and will not deploy the warship with him in command,\u201d the filing states.<\/p>\n<p>Admiral Daryl Caudle filed a statement on Feb. 28 saying that the Navy \u201ccannot have a Sailor who disobeys a lawful order to receive a vaccine because they harbor a personal objection any more than we can have a Sailor who disobeys the technical manual for operating a nuclear reactor because he or she believes they know better.\u201d<\/p>\n<p>Merryday on Thursday denied the U.S. Department of Defense\u2019s request to halt the injunction, and accused the defense of attempting \u201cto evoke the frightening prospect of a dire national emergency resulting from allegedly reckless and unlawful overreaching by the district judge.\u201d<\/p>\n<p>The Epoch Times has reached out to the Navy for comment.<\/p>\n<p><i>Zachary Stieber contributed to this report.<\/i><\/p>\n<div class=\"author_wrapper\">\n<div class=\"one_author_block round\">\n<div class=\"top_row\">\n\t\t\t\t\t<a href=\"https:\/\/www.theepochtimes.com\/author-isabel-van-brugen\"><\/a><\/p>\n<p>Follow<\/p>\n<\/div>\n<p>Isabel van Brugen is an award-winning journalist and currently a news reporter at The Epoch Times.
