Under DACA, officials give no-deportation passes and work permits to people who say they are illegal aliens.<\/p>\n<p>\u201cThey\u2019re creating the next DACA-like population,\u201d said Rob Law, who worked at the Department of Homeland Security for President Donald Trump. \u201cThis is about giving work permits to the illegal-alien population \u2026 it\u2019s about establishing the class of next non-U.S. citizen workers in the country.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>The numbers are potentially huge. In 2009, just 3,533 young people from Honduras, Guatemala, and El Salvador <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/southwest-border-unaccompanied-children\/fy-2014\">claimed<\/a> UAC status as they crossed the border. The number jumped to 21,000 in 2013, and then <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/southwest-border-unaccompanied-children\/fy-2014\" target=\"_blank\" rel=\"noopener\">52,000<\/a> in 2o14.\u00a0 The UACs numbers <a href=\"https:\/\/immigrationforum.org\/article\/fact-sheet-unaccompanied-migrant-children-uacs\/\" target=\"_blank\" rel=\"noopener\">dropped<\/a> to 15,687 in 2020 under President Donald Trump\u2019s cautious policies but spiked to <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/southwest-land-border-encounters\" target=\"_blank\" rel=\"noopener\">114,0211<\/a> under Mayorkas\u2019s easy-migration rules.<\/p>\n<div id=\"attachment_20162994\" class=\"wp-caption alignnone\"><a href=\"https:\/\/media.breitbart.com\/media\/2022\/03\/img-0.png\"><\/a><\/p>\n<p class=\"wp-caption-text\">U.S. Department of Homeland Security<\/p>\n<\/div>\n<p>Overall, almost 600,000 UAC migrants had entered the country by January 2022, just 14 years after Congress unanimously passed the UAC law in 2008.<\/p>\n<p>Biden\u2019s border chief is Alejandro Mayorkas at the Department of Homeland Security (DHS). Mayorkas is portraying the giveaway as a benevolent gift to abandoned young migrants, dubbed \u201cSpecial Immigrant Juveniles,\u201d or SIJs.<\/p>\n<p>\u201cToday, we are taking action to help immigrant children in the U.S. who have been abused, neglected, or abandoned and offer them protection to help rebuild their lives,\u201d\u00a0said a statement from Ur Jaddou, at Mayorkas\u2019s U.S. Citizenship and Immigration Services (USCIS) agency. \u201cThese policies will provide humanitarian protection to vulnerable young people for whom a juvenile court has determined that it is in their best interest to remain in the United States,\u201d\u00a0said Jaddou.<\/p>\n<p>Mayorkas is a wealthy and clever lawyer. His memo <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/policy-manual-updates\/20220307-SIJAndDeferredAction.pdf\" target=\"_blank\" rel=\"noopener\">dismisses<\/a> the impact of job competition on Americans\u2019 wages: \u201cExercising our discretion to grant deferred action and possibly authorizing employment provides significant benefits to the U.S. labor pool and the economy in general compared to delaying such status.\u201d\u00a0For decades, that labor market has been tilted in favor of CEOs and investors by the federal government\u2019s policy of extracting migrants from many poor countries to work, rent, and consume in the United States.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Under the 2008 UAC law, young migrants can ask border officials to treat them as unaccompanied alien children \u2014 even when coyotes and cartels publicly deliver them to the border in chartered buses that are funded by the migrants\u2019 parents or by labor traffickers. Border officers then relay the blocs of supposedly unaccompanied migrants to the Department of Health and Human Services. The agency then relays the migrants to unverified sponsors after a security check, which is kept cursory because officials know the sponsors are usually labor traffickers or the youths\u2019 illegal-immigrant parents.<\/p>\n<p>\u201cHonestly, I think almost everyone in the system knows that most of the [migrant] teens are coming to work and send money back home,\u201d Maria Woltjen, executive director and founder of the Young Center for Immigrant Children\u2019s Rights,\u00a0<a href=\"https:\/\/www.breitbart.com\/economy\/2021\/01\/10\/critics-joe-biden-is-restarting-hunger-games-migration-policy\/\">told<\/a>\u00a0a ProPublica reporter. \u201cThey want to help their parents,\u201d she\u00a0said\u00a0in a November 2020 article which\u00a0<a href=\"https:\/\/www.breitbart.com\/immigration\/2021\/03\/13\/bidens-deputies-allow-illegals-import-more-young-uac-migrants\/\" target=\"_blank\" rel=\"noopener\">cited<\/a> the case of Garcia, a Guatemalan youth who used the UAC loophole in 2018:<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote>\n<p>He was 15 and he had debts to pay, starting with the roughly $3,000 he owed for the \u201ccoyote\u201d who guided him across Mexico from Guatemala. To finance the trip, his parents had taken out a bank loan, using their house as collateral. If he didn\u2019t repay it, the family could lose its home.<\/p>\n<\/blockquote>\n<p>The \u201ceveryone in the system knows\u201d category <a href=\"https:\/\/www.breitbart.com\/immigration\/2021\/03\/26\/lindsey-graham-joe-biden-is-complicit-with-child-traffickers\/\" target=\"_blank\" rel=\"noopener\">includes<\/a> many federal legislators and Mayorkas. He told Univision anchor Jorge Ramos in a March 2021\u00a0<a class=\"x5l\" href=\"https:\/\/mailchi.mp\/d2f6d9011a3a\/transcript-univision-news-interview-with-department-of-homeland-security-secretary-alejandro-mayorkas?e=de2b6a98e3\" target=\"_blank\" rel=\"noopener external\">interview<\/a>\u00a0that \u201cwe need to invest and address the root causes so that parents do not need to send their children \u2026 to be placed in the hands of traffickers.\u201d<\/p>\n<p>At least <a href=\"https:\/\/www.breitbart.com\/immigration\/2021\/03\/13\/bidens-deputies-allow-illegals-import-more-young-uac-migrants\/\" target=\"_blank\" rel=\"noopener\">60 percent<\/a>\u00a0of the UACs are work-ready male <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/03\/05\/data-shows-most-migrant-children-teenagers-seeking-jobs\/\" target=\"_blank\" rel=\"noopener\">youths<\/a>, aged 16 or older the year they arrive. Many <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/03\/04\/biden-resettles-over-146000-border-crossers-across-u-s-in-first-year\/\" target=\"_blank\" rel=\"noopener\">walk<\/a> away from federal supervision to illegally take jobs that would otherwise go to diverse Americans at higher wages.<\/p>\n<div id=\"attachment_18293234\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/03\/UACs-in-Tucson-Sector.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-18293234\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/03\/UACs-in-Tucson-Sector.jpg\" alt=\"Of 125 migrants apprehended near San Miguel, Arizona, on October 10, 3\/4ths were unaccompanied children. (Photo: U.S. Border Patrol\/Tucson Sector)<\/p>\n<\/div>\n<p>The younger UACs are the left-behind <a href=\"https:\/\/www.breitbart.com\/economy\/2022\/03\/04\/joe-biden-delivers-flood-of-cheap-migrant-labor-to-new-york\/\" target=\"_blank\" rel=\"noopener\">children<\/a> of\u00a0<a href=\"https:\/\/www.breitbart.com\/immigration\/2021\/03\/13\/bidens-deputies-allow-illegals-import-more-young-uac-migrants\/\" target=\"_blank\" rel=\"noopener\">illegal migrants<\/a> in the United States. The joint DHS-coyote smuggling route encourages migrants to separate themselves from their families by first going alone to the United States. The Mayorkas\/coyote network also minimizes pressure on illegal migrants to go home, boosting New York City and other cities that <a href=\"https:\/\/www.breitbart.com\/economy\/2022\/03\/04\/joe-biden-delivers-flood-of-cheap-migrant-labor-to-new-york\/\" target=\"_blank\" rel=\"noopener\">prefer<\/a> to build an economy on cheap labor.<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p>The SIJ program was created in 1990 \u201cto give [legal] status to kids who are on their own, truly left on their own, with no one else to turn to here in the United States \u2014 [such as] victims of trafficking or abandoned kids or orphans,\u201d Vaughan said. \u201cBut the [implementing] rules were written with loopholes that you can drive a truck through,\u201d she added.<\/p>\n<p>The SIJ program is now being used by Mayorkas to help legalize the migrants who got into the country via the UAC program.<\/p>\n<p>The UAC program was passed unanimously by Congress in 2008. It was also portrayed as a small-scale, short-term rescue program for the children who were victims of sex trafficking, for example.<\/p>\n<p>Progressives are eager to ignore their support for the trafficking of child labor via the UAC pipeline.\u00a0In February, Reuters\u00a0<a class=\"x5l\" href=\"https:\/\/www.reuters.com\/investigates\/special-report\/usa-immigration-alabama\/\" target=\"_blank\" rel=\"noopener external\">reported<\/a>\u00a0on a teenager who was delivered by federal officials to an Alabama home close to a chicken processing company:<\/p>\n<blockquote>\n<p>At age 16, when most kids in the United States are halfway through high school, Amelia Domingo found herself working on chicken processing machines in this farm town [Enterprise, Ala.] and deep in debt to loan sharks in her native Guatemala.<\/p>\n<p>After borrowing $10,000 for smugglers to get her through Mexico, Amelia crossed into Arizona last February and turned herself over to [Customs and Border Protection] immigration officials. They led her, she said, from a crowded border facility to a shelter for unaccompanied minors. After about a month, officials from the U.S. Department of Health and Human Services, which oversees shelters for migrant children,\u00a0released her to a sister here in Alabama.<\/p>\n<p>\u2026<\/p>\n<p>One day, she said, she hopes to return to Guatemala. First, though, she must continue wiring most of her wages home, where her parents pay off the loan sharks and what she said is a dizzying interest rate of 10% per month. She\u2019ll return, she said, \u201cif I ever have the means.\u201d<\/p>\n<\/blockquote>\n<p>But the UAC law cuts off when DHS officials can no longer pretend that the young men and women are children. Three years after a young man tells border officials that is really aged 15, he is recorded as being an 18-year-old adult in the federal documents.<\/p>\n<p>That is where Mayorkas\u2019s new SIJ rule is intended to take over from the UAC law.<\/p>\n<p>The SIJ law allows young migrant adults to ask judges for SIJ status \u2014 and green cards and citizenship \u2014 on the grounds that they were abandoned by the parents who funded their trip to the United States, and who usually stay in close contact via cellphones. They can ask for green cards even if one of their illegal-migrant parents is standing in the courtroom, said Vaughan.<\/p>\n<p>The parents accused of abuse cannot defend themselves in court. But they do not want to defend themselves because they prefer the state judges \u2014 not federal judges \u2014 to award green cards to their children, she added.<\/p>\n<p>But the SIJ pathway to green cards is already clogged.<\/p>\n<p>Tens of thousands of former UACs are getting new SIJ status so they can apply for green cards. Yet the number of green cards awarded each year to the SIJs is limited because they come from the roughly 10,000 green cards allocated for various competing categories of \u201c<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/legal\/visa-law0\/visa-bulletin\/2020\/visa-bulletin-for-september-2020.html\" target=\"_blank\" rel=\"noopener\">EB-4<\/a>\u201d migrants.<\/p>\n<p>The number of claimed SIJs who were approved to get green cards <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/data\/I360_sij_performancedata_fy2017_qtr4.pdf\" target=\"_blank\" rel=\"noopener\">spiked<\/a> from 1,590 in 2012 up to 15,101 in 2016.<\/p>\n<p>Mayorkas\u2019s support for migrants includes two measures.<\/p>\n<p>First, Mayorkas\u2019s plan would reward the young migrants by giving them work permits before they eventually get their green cards.<\/p>\n<p>A \u201cPolicy Alert\u201d on March 7 <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/policy-manual-updates\/20220307-SIJAndDeferredAction.pdf\">says<\/a> the agency will offer \u201cdeferred action (and related employment authorization) for noncitizens [aliens] classified as Special Immigrant Juveniles (SIJs) who are ineligible to apply for adjustment of status to lawful permanent resident (LPR) status solely due to visa unavailability.\u201d<\/p>\n<div id=\"attachment_16480280\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/GettyImages-1230936527.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-16480280\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/GettyImages-1230936527.jpg\" alt=\"US President Joe Biden stands alongside Secretary of Homeland Security Alejandro Mayorkas (L) after signing executive orders related to immigration in the Oval Office of the White House in Washington, DC, February 2, 2021. (Photo by SAUL LOEB\/AFP via Getty Images)<\/p>\n<\/div>\n<p>This decision to award workers deferred action and permits to tens of thousands of migrants is a mere memo, not a congressional law or agency regulation:<\/p>\n<blockquote>\n<p>This update, contained in Volume 6 of the Policy Manual, is effective May 6, 2022 and applies to eligible noncitizens classified as SIJs before, on, or after that date based on an approved Petition for Amerasian, Widow(er), or Special Immigrant (Form I-360). This guidance is controlling and supersedes any prior guidance on the topic.<\/p>\n<p>\u2026<\/p>\n<p>USCIS will not publish Federal Register notices requesting public comment because public notice is not required for internal policy clarifications.<\/p>\n<\/blockquote>\n<p>The second measure is a draft <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/03\/08\/2022-04698\/special-immigrant-juvenile-petitions\" target=\"_blank\" rel=\"noopener\">regulation<\/a> that streamlines the process of getting SIJ status for the migrants. For example, it says that the migrants can apply up to age 21, it allows judges in juvenile courts to grant the SIJ status, and that DHS will not \u201crevoke\u201d the SIJ status when the young migrant reconciles with a parent.<\/p>\n<p>It says the SIJ request must be approved in 180 days, and also removes legal barriers, such as convictions for drug possession:<\/p>\n<blockquote>\n<p><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">In the final rule, DHS has expanded application of the simple possession exception to the grounds of inadmissibility under INA section 212(a)(2)(A),\u00a0<a class=\"usc external\" href=\"https:\/\/www.govinfo.gov\/link\/uscode\/8\/1182?type=usc&#038;year=mostrecent&#038;link-type=html\" target=\"_blank\" rel=\"noopener\">8 U.S.C. 1182<\/a>(a)(2)(A) (conviction of certain crimes), INA section 212(a)(2)(B),\u00a0<a class=\"usc external\" href=\"https:\/\/www.govinfo.gov\/link\/uscode\/8\/1182?type=usc&#038;year=mostrecent&#038;link-type=html\" target=\"_blank\" rel=\"noopener\">8 U.S.C. 1182<\/a>(a)(2)(B) (multiple criminal convictions), and INA section 212(a)(2)(C),\u00a0<a class=\"usc external\" href=\"https:\/\/www.govinfo.gov\/link\/uscode\/8\/1182?type=usc&#038;year=mostrecent&#038;link-type=html\" target=\"_blank\" rel=\"noopener\">8 U.S.C. 1182<\/a>(a)(2)(C) (controlled substance traffickers).\u00a0<em>See<\/em>\u00a0new\u00a0<a class=\"cfr external\" href=\"https:\/\/www.federalregister.gov\/select-citation\/2022\/03\/08\/8-CFR-245.1\">8 CFR 245.1<\/a>(e)(3)(v)(A).\u00a0<\/span><\/p>\n<\/blockquote>\n<p>The combination of the \u201cPolicy Alert\u201d and the draft regulation is \u201chuge,\u201d\u00a0<a href=\"https:\/\/twitter.com\/abogada_laura\/status\/1500842257234030595\" target=\"_blank\" rel=\"noopener\">tweeted<\/a> Yliana Johansen-M\u00e9ndez, an immigration lawyer at ImmDef, an L.A.-based advocacy group. \u201cAlthough they don\u2019t address the backlog itself, they provide stability &#038;
