Ron DeSantis and his team have repeatedly pushed back on this framing. As recently as Monday, the governor tore into a reporter for misrepresenting the bill during a press briefing.<\/p>\n<p>\u201cCritics call it the Don\u2019t Say Gay bill,\u201d <a href=\"https:\/\/twitter.com\/greg_price11\/status\/1500971287010852868\">said the reporter<\/a>, to which DeSantis replied, \u201cDoes it say that in the bill? I\u2019m asking you to tell me what is in the bill because you are pushing false narratives. It doesn\u2019t matter what critics say.\u201d<\/p>\n<p>\u201cIt bans classroom instruction on sexual identity and gender orientation,\u201d said the reporter.<\/p>\n<p>\u201cFor who?\u201d pressed the governor. \u201cFor grades Pre-K through 3. So 5-year-olds, 6-year-olds, 7-year-olds, and the idea that you wouldn\u2019t be honest about that and tell people what it actually says, it\u2019s why people don\u2019t trust people like you, because you peddle false narratives.\u201d<\/p>\n<h3>What\u2019s In The Bill?<\/h3>\n<p>The bill is a response to <a href=\"https:\/\/thefederalist.com\/2020\/07\/28\/speaker-most-parents-have-no-idea-their-kids-schools-are-pushing-insane-transgender-ideology\/\">an influx<\/a> of gender ideology and sexual orientation content in classrooms across the nation exposed by <a href=\"https:\/\/dailycaller.com\/2021\/05\/05\/two-genders-louisiana-teacher-sounds-off-on-woke-education-school-board-meeting\/\">conservative news outlets<\/a> and grassroots organizations like <a href=\"https:\/\/dailycaller.com\/2022\/01\/18\/parents-group-claims-saint-paul-public-schools-indoctrinating-preschoolers-on-transgender-issues\/\">Parents Defending Education<\/a>.<\/p>\n<p>Critics have most notably taken issue with the bill\u2019s statement that\u00a0\u201cclassroom instruction by school personnel or third parties on sexual orientation or gender identity may not occur in kindergarten through grade 3 or in a manner that is not age appropriate or developmentally appropriate for students in accordance with state standards.\u201d<\/p>\n<p>Students in kindergarten are typically five-years-old, while third graders generally are eight or nine years old.<\/p>\n<p>According<a href=\"https:\/\/www.cdc.gov\/ncbddd\/actearly\/milestones\/milestones-5yr.html\">\u00a0to the Centers for Disease Control and Prevention<\/a> (CDC), a child usually can follow rules or take turns playing games with other children by five years old. That five-year-old may sing, dance, do simple chores like matching socks or clearing the table.<\/p>\n<p>The child may tell a story that he or she heard, answer simple questions, maintain a simple conversation, count to 10, use words like\u00a0\u201cyesterday,\u201d \u201ctomorrow,\u201d \u201cmorning,\u201d or \u201cnight,\u201d and hop on one foot.<\/p>\n<p>Nowhere in the legislation is the word \u201cgay\u201d mentioned, though the word \u201cparent\u201d is mentioned 32 times and the word \u201cparental\u201d is mentioned seven times. The legislation heavily focuses on parental notification and parental awareness of what children are being taught or exposed to in school.<\/p>\n<h3>Heavy Emphasis On Parental Notification<\/h3>\n<p>HB 1557 requires that district school boards adopt procedures that \u201ccomport with certain provisions of law for notifying a students parent of specified information.\u201d<\/p>\n<p>The bill requires that these procedures \u201creinforce the fundamental right of parents to make decisions regarding the upbringing and control of their children.\u201d<\/p>\n<p>It prohibits any school procedures from impeding \u201ca parent from accessing certain records,\u201d encouraging a student to withhold such information from a parent, or discouraging parental notification in critical decisions involving a student\u2019s \u201cmental, emotional, or physical well-being.\u201d<\/p>\n<p>\u201cAdopt procedures for notifying a student\u2019s parent if there is a change in the student\u2019s services or monitoring related to the student\u2019s mental, emotional, or physical health or well-being and the school\u2019s ability to provide a safe and supportive learning environment for the student,\u201d orders the bill.<\/p>\n<p>\u201cThe procedures must reinforce the fundamental right of parents to make decisions regarding the upbringing and control of their children by requiring school district personnel to\u00a0encourage a student to discuss issues relating to his or her well-being with his or her parent or to facilitate discussion of the issue with the parent,\u201d the legislation continues.<\/p>\n<p>Such procedures may not impede parents from \u201caccessing any of their student\u2019s education and health records created, maintained, or used by the school district,\u201d the bill text reads.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Reporter: \u201cCritics call it the Don\u2019t Say Gay bill\u201d<\/p>\n<p>DeSantis: \u201cDoes it say that in the bill?\u201d<\/p>\n<p>Reporter: \u201cIt bans classroom instruction on sexual identity and gender orientation.\u201d<\/p>\n<p>DeSantis: \u201cFor who?\u2026 Grades Pre-K through 3.\u201d <br \/><a href=\"https:\/\/t.co\/gqMiYKyVzg\">pic.twitter.com\/gqMiYKyVzg<\/a><\/p>\n<p>\u2014 Greg Price (@greg_price11) <a href=\"https:\/\/twitter.com\/greg_price11\/status\/1500971287010852868?ref_src=twsrc%5Etfw\">March 7, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u201cA school district may not adopt procedures or student support forms that prohibit school district personnel from notifying a parent about his or her student\u2019s mental, emotional, or physical health or well-being, or a change in related services or monitoring, or that encourage or have the effect of encouraging a student to withhold from a parent such information,\u201d the legislation says.<\/p>\n<p>It continues: \u201cSchool district personnel may not discourage or prohibit parental notification of and involvement in critical decisions affecting a student\u2019s mental, emotional, or physical health or well-being,\u201d though it notes that the school may adopt procedures that permit the school to withhold information if \u201ca reasonably\u00a0prudent person would believe that disclosure would result in abuse, abandonment, or neglect.\u201d<\/p>\n<p>At the beginning of the school year, school districts must notify parents of all healthcare services offered at their child\u2019s school and give parents the ability to withhold their consent or decline any specific service.<\/p>\n<p>\u201cParental consent to a health care service does not waive the parent\u2019s right to access his or her student\u2019s educational or health records or to be notified about a change in his or her student\u2019s services or monitoring as provided by this paragraph,\u201d the legislation continues.<\/p>\n<p>The school district must also provide health screening forms or questionnaires to parents before administering them to students.
