Title 42 is an immigration policy implemented by former President Donald Trump that allows U.S. immigration officials to expel immediately\u00a0migrants who come to the southern border. Title 42 was implemented in the wake of the coronavirus pandemic.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Since the policy\u2019s start in March 2020, the federal government has\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.cbsnews.com\/news\/immigration-border-deportation-policy-migrant-children-texas-judge\/\" target=\"_blank\" rel=\"noopener\">expelled<\/a>\u00a0more than 1.6 million migrants.<\/p>\n<p>Biden previously declined to expel unaccompanied minor children under Title 42. Instead, he allowed the young migrants to enter the country, where they would be placed under the U.S. Department of Health and Human Services\u2019 supervision. From there, they would be placed with sponsors in the United States, who are typically family members.<\/p>\n<p>Pittman\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/wordpress.aflegal.org\/wp-content\/uploads\/2022\/03\/Order.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a>:<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote>\n<p>Here, the President has (arbitrarily) excepted COVID-19 positive unaccompanied alien children from Title 42 procedures\u2014which were purposed with preventing the spread of COVID-19. As a result, border states such as Texas now uniquely bear the brunt of the ramifications. Yet, while policy decisions are beyond judicial review, those agency actions that are \u201carbitrary, capricious, . . . or otherwise not in accordance with law\u201d will be set aside.<\/p>\n<\/blockquote>\n<p>Pittman explained that the \u201cramifications\u201d Texas deals with include strains on the state\u2019s public school system and medical resources, and increased incarceration.<\/p>\n<p>A\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.cbsnews.com\/news\/immigration-122000-unaccompanied-migrant-children-us-shelters-2021\/\" target=\"_blank\" rel=\"noopener\">record<\/a>\u00a0number of more than 122,000 unaccompanied minors arrived at the southern border during the fiscal year 2021.<\/p>\n<p>Texas Attorney General Ken Paxton\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/twitter.com\/KenPaxtonTX\/status\/1499908969153933313\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0the decision is a \u201cwin for Texas &#038; children\u2014loss for Biden &#038; cartels!\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Huge win against Biden! Win for Texas &#038; children\u2014loss for Biden &#038; cartels!<\/p>\n<p>\u2014 Attorney General Ken Paxton (@KenPaxtonTX) <a href=\"https:\/\/twitter.com\/KenPaxtonTX\/status\/1499908969153933313?ref_src=twsrc%5Etfw\">March 5, 2022<\/a><\/p>\n<\/blockquote>\n<p>America First Legal, led by former Trump adviser Stephen Miller, served as outside counsel for Texas as part of the lawsuit. Miller called the decision \u201ca truly historic victory.\u201d<\/p>\n<p>In a statement, Miller\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.aflegal.org\/news\/big-victory-on-title-42-america-first-legal-ag-paxton-win-preliminary-injunction-against-bidens-mass-release-of-illegal-alien-minors-at-the-border\" target=\"_blank\" rel=\"noopener\">said<\/a>:<\/p>\n<blockquote>\n<p>We are honored beyond words to have partnered with Attorney General Ken Paxton and the State of Texas in our landmark lawsuit against the Biden Administration\u2019s egregious decision to except ALL illegal alien minors traveling without adults (UAC) from Title 42\u2014and to have just obtained a preliminary injunction. Biden\u2019s decision to except UAC from Title 42, and instead mass resettle them in the United States, has led to the largest wave of criminal child smuggling in human history\u2013and the flood of illegal alien teens and minors has drained the resources of our schools, hospitals, and communities while creating a new unimpeded recruiting pipeline for MS-13. This preliminary injunction orders the Biden Administration to halt their order categorically excepting unaccompanied alien minors from Title 42 repatriation. This is a truly historic victory, but we have a long, long, long way to go to end the Administration\u2019s crusade to eradicate our sovereignty.<\/p>\n<\/blockquote>\n<p>Friday\u2019s decision is Texas\u2019s latest successful effort to prevent Biden from implementing his radical immigration agenda. Texas previously\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.npr.org\/2021\/02\/24\/970914755\/judge-bans-enforcement-of-bidens-100-day-deportation-pause\" target=\"_blank\" rel=\"noopener\">stopped<\/a>\u00a0a 100-day deportation moratorium from being enforced last February. Additionally, the state got a federal judge to order Biden to continue Trump\u2019s \u201cRemain in Mexico\u201d policy, where asylum seekers are returned to Mexico to wait for their hearings.<\/p>\n<p>The case is <em>Texas v.
