Netflix argues that the case violates the First Amendment.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cA hearing was initially set on that motion for Thursday,\u201d reported <a href=\"https:\/\/variety.com\/2022\/film\/news\/netflix-cuties-lucas-babin-lewd-acts-1235195818\/\"><em>Variety<\/em><\/a>. \u201cBut in a procedural move on the eve of the hearing, Babin dropped the original indictment and brought four new indictments under a different statute, alleging that the film violates the Texas state law against child pornography.\u201d<\/p>\n<p>\u201cIn response, Netflix filed a request for an injunction in federal court, arguing that Babin has abused his office in order to deprive Netflix of its First Amendment rights,\u201d it added.<\/p>\n<p><strong><em>Watch below:<\/em><\/strong><\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n[embedded content]\n<p>Netflix argued that it would suffer \u201cirreparable harm by being forced to continue playing Babin\u2019s game in state court and defending itself against even more baseless charges.\u201d<\/p>\n<p>A hearing will be held on Friday in Beaumont, Texas.<\/p>\n<p>Netflix found itself at the center of controversy in 2020 when it released a poster for the movie Cuties that featured pre-teen girls in sexually suggestive poses. The company apologized after severe online backlash. \u201cWe\u2019re deeply sorry for the inappropriate artwork that we used for \u2018Cuties.\u2019 It was not OK, nor was it representative of this French film which premiered at Sundance. We\u2019ve now updated the pictures and description,\u201d\u00a0<a href=\"https:\/\/deadline.com\/2020\/08\/netflix-apologizes-inappropriate-cuties-poster-criticized-sexualizing-children-1203018498\/\">Netflix said<\/a>\u00a0in a statement.<\/p>\n<p><em>Cuties<\/em> tells the story of 11-year-old Amy who joins a dance group called \u201cThe Cuties\u201d at school with her friends. Defenders of the film argued that Netflix dramatically misrepresented the story\u2019s content with its poster, noting that the original French advertisements were tame by comparison. However, upon the movie\u2019s release, the hashtag #CancelNetflix quickly began trending when clips of the movie revealed that the poster indeed reflected the movie\u2019s content: pre-teen girls dancing sexually.<\/p>\n<p>In response to the backlash, Netflix defended the film as \u201ca social commentary against the sexualization of young children.
