Offender who are attacking people on the street are just being dismissed, instead of convicted. Look at the second chart below and you\u2019ll see a pretty good explanation of why these types of crime are on the rise. What the charts above don\u2019t show is that Boudin\u2019s office has also \u201ccharged down\u201d more felony assault crimes than his predecessor (fellow progressive DA George Gascon who is now the DA in Los Angeles). The <em>Chronicle<\/em> compared two datasets it received from the DA\u2019s office, one showing the crimes for which individuals were arrested and booked and another showing how cases were actually charged by the DA. Here\u2019s what <a href=\"https:\/\/www.sfchronicle.com\/crime\/article\/Chesa-Boudin-s-office-just-released-new-data-on-16973247.php#:~:text=The%20data%20shows%20that%20Boudin&#039;s,smaller%20share%20of%20these%20cases.\" target=\"_blank\" rel=\"noopener\">the comparison revealed<\/a>:<\/p>\n<blockquote>\n<p>We found that under Boudin in 2020 and 2021, nearly 40% of charged cases originally booked as felony assaults were prosecuted under a different charge \u2014 compared with roughly 33% under Gasc\u00f3n in 2018 and 2019. The difference in these rates in robbery prosecutions was smaller but still present.<\/p>\n<p>It is likely most of the differently charged cases are getting prosecuted as lesser crimes, not more serious ones, though this precise information is missing from the data. Boudin confirmed that many defendants booked by police will get charged with other, often lesser offenses as investigations progress\u2026<\/p>\n<p>In his interview with The Chronicle, Boudin said there are many reasons his office might file charges in a case different from the most serious category booked by the police. Prosecutors may conclude they cannot prove a booked offense beyond a reasonable doubt, or new information about a case may come to light after it is booked and police have investigated further \u2014 DNA test results, say, or a statement by a key witness.<\/p>\n<\/blockquote>\n<p>I don\u2019t think anyone would dispute that there could be additional information and evidence that comes in after an arrest. In some cases that is going to result in lesser charges. But that doesn\u2019t explain why more felony assaults are suddenly being charged down than they were under the previous progressive DA. Boudin doesn\u2019t try to explain that he just talks around it.<\/p>\n<p>Brooke Jenkins, a former prosecutor who now supports the Boudin recall effort tweeted out her thoughts on the story.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Chesa Boudin does not hold criminal offenders accountable and now the data proves that. Conviction rates have plummeted.
