Justice Clarence Thomas wrote the majority opinion, and Justice Stephen Breyer, who was joined by Justices Elena Kagan and Sonia Sotomayor, penned the dissent.\u00a0<\/span><\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The Supreme Court <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/10\/14\/supreme-court-considers-reinstating-death-penalty-in-boston-marathon-bomber-case\/\">heard arguments<\/a> in the case in October of 2021, in which the U.S. government \u2014 despite President Joe Biden\u2019s <a href=\"https:\/\/www.reuters.com\/legal\/government\/biden-said-no-death-penalty-now-what-2021-06-21\/\">purported stance<\/a> on the death penalty \u2014 asked the justices to uphold the \u201csound judgment of 12 of respondent\u2019s peers that he warrants capital punishment.\u201d Tsarnaev\u2019s attorney\u00a0Ginger Anders contended that the First Circuit was correct in reversing the district court\u2019s decision because the district judge excluded a question about pre-trial media consumption from the juror questionnaire and excluded evidence from the unsolved Waltham murders.<\/p>\n<p>The conservative-leaning majority ultimately disagreed with Anders\u2019 argument, Thomas writing that Tsarnaev received a fair trial before an impartial jury.<\/p>\n<p>\u201cDzhokhar Tsarnaev committed heinous crimes. The Sixth Amendment nonetheless guaranteed him a fair trial before an impartial jury. He received one. The judgment of the United States Court of Appeals for the First Circuit is reversed,\u201d Thomas explained.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>For <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/10\/12\/capital-punishment-supreme-court-decide-fate-boston-marathon-bomber\/\">background<\/a>, a heavily redacted federal affidavit was\u00a0<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"https:\/\/www.bostonherald.com\/2019\/11\/15\/affidavit-pins-grisly-2011-triple-murder-on-tamerlan-tsarnaev\/\" target=\"_blank\" rel=\"noopener external\">unsealed<\/a>\u00a0in 2019 during\u00a0Tsarnaev\u2019s appeal of his death sentence, revealing details of 2011 murders allegedly involving his brother Tamerlan and his friend\u00a0Ibragim Todashev.<\/p>\n<p>Todashev, who was reportedly shot multiple times by the FBI during a 2013 interview, confessed that he and Tamerlan participated in the 2011 \u201cWaltham murders,\u201d and both men \u201ctook several thousand dollars from the residence and split the money,\u201d\u00a0<a class=\"x5l\" href=\"https:\/\/www.bostonherald.com\/2019\/11\/15\/affidavit-pins-grisly-2011-triple-murder-on-tamerlan-tsarnaev\/\" target=\"_blank\" rel=\"noopener external\">according<\/a>\u00a0to the\u00a0<em>Boston Herald<\/em>.<\/p>\n<p>On September 11, 2011, the 10-year anniversary of the 9\/11 Terror Attacks, the men allegedly\u00a0bound, beat, and slit the throats of\u00a0Raphael Teken, 37, Erik Weissman, 31, and Brendan Mess, 25. They also reportedly left the men covered in marijuana and attempted to scrub the crime scene of fingerprints.<\/p>\n<p>Tsarnaev\u2019s attorney argued that the district court violated the\u00a0U.S. Constitution\u2019s\u00a0Eighth Amendment and the Federal Death Penalty Act (FDPA) by excluding \u201creliable evidence\u201d that \u201cwent to the heart of Dzhokhar\u2019s mitigation case.\u201d Anders alleged that\u00a0the Waltham murders show how Tsarnaev\u2019s older brother Tamerlan, who died shortly after the bombing, had a propensity for violence and ultimately ended up playing a role in radicalizing Tsarnaev and manipulating him into participating in the Boston bombings. They also alleged Tamerlan was the main planner of the attack.<\/p>\n<p>In contrast, the\u00a0U.S. solicitor general\u00a0argued that the court of appeals improperly vacated the capital\u00a0sentence\u00a0recommended by the jury in \u201cone of the most important terrorism prosecutions in our Nation\u2019s history.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>The United States argued that pretrial publicity does not, as a rule, hinder a jury from being impartial and that the court engaged in a jury selection process that the Supreme Court has upheld in other notable cases. As for the exclusion of evidence pertaining to the unsolved Waltham murders, the U.S. waged the murders were an entirely different crime with seemingly different motives, and both parties reportedly involved are dead. To have battled over the details of the separate crimes in court \u201cwas exceedingly unlikely to be productive\u201d when discussing Tsarnaev\u2019s role in the Boston bombings, the briefing argues.<\/p>\n<p>\u201cIn sum, the court\u2019s jury selection process was both eminently reasonable and wholly consistent with this Court\u2019s precedents. The Court of Appeals erred in holding otherwise,\u201d Thomas wrote in his opinion.\u00a0\u201c\u2026The Court of Appeals\u2019 second reason for vacating Dzhokhar\u2019s capital sentences\u2014that the District Court erred in excluding from the sentencing proceedings evidence of the Waltham murders\u2014fares no better.\u201d<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<p>He continued:<\/p>\n<blockquote>\n<p>FDPA proceedings are not evidentiary free-for-alls. The district court may exclude information under the FDPA \u201cif its probative value is outweighed by the danger of creating unfair prejudice, confusing the issues, or misleading the jury.<\/p>\n<p>\u2026That conclusion was reasonable and not an abuse of the District Court\u2019s discretion. Dzhokhar sought to divert the sentencing jury\u2019s attention to a triple homicide that Tamerlan allegedly committed years prior, though there was no allegation that Dzhokhar had any role in that crime. Nor was there any way to confirm or verify the relevant facts, since all of the parties involved were dead.<\/p>\n<\/blockquote>\n<p>\u201cDzhokhar and the dissent offer several counterarguments, none of which is convincing,\u201d Thomas further noted.<\/p>\n<p>Justice Breyer, in his dissent, said he thinks the district court \u201cshould have allowed Dzhokhar to introduce the [Waltham murders] evidence.\u201d<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p>\u201cThree courts including this Court have now examined this record with care. Why? Why are appellate courts so deeply involved in what is, after all, a trial-based evidentiary matter?\u201d Breyer queried. \u201cThe reason, in my view, lies in part in the nature of the underlying proceeding. It is a death penalty proceeding. And where death is at stake, the courts (and Congress) believe that particular judicial care is required. \u201d<\/p>\n<p>Two people injured in the bombing took to Twitter on Friday to praise the outcome of the case.<\/p>\n<div class=\"caas-content-wrapper\">\n<div class=\"caas-body\">\n<p>\u201cCongratulations to all who worked tirelessly for justice,\u201d Adrianne Haslet wrote.
