The case was transferred to another part of the court under Justice Michael Yavinski for unknown reasons, and Yavinski presided over a hearing.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The alleged hate crime\u00a0<a href=\"https:\/\/queensda.org\/bronx-man-indicted-by-grand-jury-on-hate-crime-charges-for-slashing-man-after-hurling-homophobic-and-racial-slurs\/\">occurred<\/a> on July 6 at approximately 3:00 a.m. near the intersection of 77th Street and Roosevelt Avenue in Queens, according to Queens County District Attorney Melinda Katz\u2019s office. Castro allegedly yelled, \u201cI hate Latinos and f\u2014-t people\u201d at the victim before approaching and slashing his left cheek with a sharp object. Castro allegedly fled the scene.<\/p>\n[embedded content]\n<p>The victim, <a href=\"https:\/\/www.nydailynews.com\/new-york\/nyc-crime\/ny-hate-crime-arrest-queens-nypd-20210715-xc7nhwlozvd7poxvysmmzemuve-story.html\">identified<\/a> by the <em>New York Daily News<\/em> as\u00a0Milton Lobos Salguero, 34, told the outlet he was standing in line at a taco truck when Castro allegedly attacked. He was transported to Elmhurst Hospital and received 16 stitches.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Prosecutors said that Castro <a href=\"https:\/\/nypost.com\/2021\/07\/16\/homeless-man-with-90-prior-arrests-busted-for-anti-gay-assault-in-queens\/\">used<\/a> a wooden stake to slice the victim, according to the <em>New York Post.<\/em>\u00a0Less than a month before the attack, Castro was released from custody following two burglaries due to the city\u2019s bail reform laws, the outlet reported.<\/p>\n<p>In late June, he allegedly stole an ATM while conducting a nightclub burglary and allegedly burglarized a bar in another incident, according to criminal complaints obtained by the <em>Post<\/em>. He was charged with third-degree burglary in both instances and was released without bail on both charges, a representative with Katz\u2019s office said. Police told the outlet he had over 90 prior arrests.<\/p>\n<p>He was <a href=\"https:\/\/a073-ils-web.nyc.gov\/inmatelookup\/pages\/detail\/body.jsf\">apprehended<\/a> July 15 for his alleged attack on Salguero, according to online New York City Department of Correction (DOC) records. His bail has was set at\u00a0$250,002.00.<\/p>\n<p>Katz\u2019s office said Castro was indicted on August 24 and was charged with \u201cassault in the first and second degree as a hate crime, assault in the first and second degree, criminal possession of a weapon in the third degree, aggravated harassment in the second degree and criminal possession of a controlled substance in the seventh degree.\u201d<\/p>\n<p>Katz\u2019s office stated Castro faces up to 15 years in prison if convicted. His next court date is set for March 7, online inmate records show.<\/p>\n<p>\u201cIn Queens, we value our diversity. Attacking others because of their ethnicity or who they love is never acceptable. It will not be tolerated here.
