John Kennedy pressed three judicial nominees nominated by President Joe Biden to answer one question at a Wednesday Senate judiciary hearing.<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2021\/12\/17\/john-kennedy-grills-anne-traum-judicial-court-nomination\/\" target=\"_blank\" rel=\"noopener noreferrer\">Kennedy<\/a> first questioned <a href=\"https:\/\/www.sandiegouniontribune.com\/news\/courts\/story\/2022-01-19\/huie-judicial-nominee\" target=\"_blank\" rel=\"noopener noreferrer\">Robert Huie<\/a>, a nominee to the United States District Court for the Southern District of California, on whether he agrees with <a href=\"https:\/\/dailycaller.com\/2022\/01\/04\/manhattan-district-attorney-crime-memo-alvin-bragg\/\" target=\"_blank\" rel=\"noopener noreferrer\">prosecutors<\/a> refusing to take up certain criminal cases \u201cin the name of social justice.\u201d<\/p>\n<p>\u201cSenator Kennedy, I think I can speak to that issue very broadly in the federal context based on my experience as a prosecutor,\u201d Huie began. \u201cTo phrase my opinion \u2018constitutional terms\u2019 on the federal side, Article II [of U.S. Constitution] directs the President shall take care that the laws of faithfully executed.\u201d<\/p>\n<p>Kennedy repeated his question twice more, to which Huie replied that he would need to \u201cget more detail\u201d to form a straight opinion.<\/p>\n<p>\u201cAre you afraid to give me an answer?\u201d the senator asked. He then asked the same question to <a href=\"https:\/\/www.congress.gov\/nomination\/117th-congress\/1482?s=1&#038;r=36\" target=\"_blank\" rel=\"noopener noreferrer\">Evelyn Padin<\/a>, who the president nominated to be a United States District Judge for the District of New Jersey.<\/p>\n[embedded content]\n<p>\u201cOne would have to look at the position that the prosecutor\u2019s taking<em>\u2014\u201d\u00a0<\/em>Padin began.<\/p>\n<p>\u201cI just explained it,\u201d Kennedy interrupted. \u201cSome prosecutors have taken the position, despite the fact that their legislature has passed a criminal statute, that they\u2019re not going to prosecute cases in violation of that statute. Do you agree with that or disagree with that?\u201d<\/p>\n<p>Padin answered that it is a matter that largely falls before the executive branch, then called it a \u201ccomplicated answer.\u201d<\/p>\n<p>\u201cNo it\u2019s not,\u201d Kennedy replied. <strong><a href=\"https:\/\/dailycaller.com\/2022\/01\/12\/jessica-clarke-john-kennedy\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Biden Nominee Jessica Clarke Muffs John Kennedy\u2019s \u2018Basic\u2019 Question During Hearing: \u2018You Want To Take Another Crack At That?\u2019)<\/a><\/strong><\/p>\n<p>The senator then turned to the third nominee, <a href=\"https:\/\/www.documentcloud.org\/documents\/21079480-jennifer-rearden-senate-questionnaire-for-federal-judicial-nomination\" target=\"_blank\" rel=\"noopener noreferrer\">Jennifer Rearden<\/a>, who former President Donald Trump first nominated to serve a district judge for the United States District Court for the Southern District of New York. Biden re-nominated her to the federal bench in January.<\/p>\n<p>\u201cSenator, I am aware that prosecutors must act consistent with the 14th Amendment that comes up in connection with selective prosecution,\u201d Rearden answered.<\/p>\n<p>\u201cBut do you agree with the prosecutors or disagree?\u201d Kennedy asked again. Rearden said she cannot give an opinion as she had not studied the issue.<\/p>\n<p>\u201cAre you afraid to give me your answer?\u201d Kennedy asked.<\/p>\n<p>\u201cNo, senator, I\u2019d give you an answer if I had it. I\u2019m doing my best to answer your question.\u201d<\/p>\n<p>The senator said he is \u201cat a loss\u201d that the three nominees could not answer his question. He then asked if they would give him an answer.<\/p>\n<p>\u201cI think I got my answer,\u201d Kennedy said, after waiting in dead silence.<\/p>\n<p>At a Feb. 16 hearing, the senator repeatedly asked the same question to <a href=\"https:\/\/dailycaller.com\/2022\/02\/16\/john-kennedy-nina-morrison-biden-nominee-district-judge\/\" target=\"_blank\" rel=\"noopener noreferrer\">Nina Morrison<\/a>, Biden\u2019s nominee for the United States District Judge for the Eastern District of New York. He concluded the hearing by doubting he can vote for her due to her inability to give him a straightforward answer.<\/p>\n<p>District attorneys, notably <a href=\"https:\/\/dailycaller.com\/2022\/01\/04\/manhattan-district-attorney-crime-memo-alvin-bragg\/\" target=\"_blank\" rel=\"noopener noreferrer\">Alvin Bragg<\/a> of Manhattan and <a href=\"https:\/\/dailycaller.com\/2021\/12\/14\/los-angeles-sheriff-left-wing-district-attorney-called-pig\/\" target=\"_blank\" rel=\"noopener noreferrer\">George Gasc\u00f3n<\/a>\u00a0of Los Angeles, enforced lenient policies connected to crime. Gasc\u00f3n reportedly refused to prosecute 12,000 cases brought forth in his first year as homicide and grand auto theft skyrocketed in his city.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Republican Louisiana Sen.
