They scared off our customers and ruined our business. They were anti-competitive. Credit: mpi34\/MediaPunch \/IPX via AP<\/p>\n<\/div>\n<p>Breitbart News <a href=\"https:\/\/www.breitbart.com\/tech\/2021\/04\/24\/wired-hackers-improve-mcdonalds-notoriously-broken-ice-cream-machines\/\">previously reported<\/a> on Kytch and their small ice cream machine maintenance device which is installed inside a McDonald\u2019s ice cream machine and provides access to features usually only accessible by technicians.<\/p>\n<p>The news of Kytch\u2019s machines and McDonald\u2019s faulty ice cream machines caused enough of a stir to result in an <a href=\"https:\/\/www.breitbart.com\/pre-viral\/2021\/09\/03\/bidens-ftc-looking-mcdonalds-broken-ice-cream-machines\/\">FTC investigation<\/a> into the McDonald\u2019s ice cream machines and the degree of repair rights that McDonald\u2019s franchise owners have.<\/p>\n<p>McDonald\u2019s worked quickly to close Kytch out of its potential customer market, warning franchise owners not to use the device and that it could cause \u201cinjury\u201d and possibly void warranties. Now Kytch is fighting back and demanding almost a billion dollars in damages.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p><em>Wired<\/em> reports:<\/p>\n<blockquote>\n<p class=\"paywall\">Late Tuesday night, Kytch filed a long-expected\u00a0<a class=\"external-link\" href=\"https:\/\/www.scribd.com\/document\/562063724\/Kytch-v-McDonald-s-Complaint\" target=\"_blank\" rel=\"nofollow noopener\">legal complaint<\/a>\u00a0against McDonald\u2019s, accusing the company of false advertising and tortious interference in its contracts with customers. Kytch\u2019s cofounders, Melissa Nelson and Jeremy O\u2019Sullivan, are asking for no less than $900 million in damages.<\/p>\n<p class=\"paywall\">Since 2019, Kytch has sold a phone-sized gadget designed to be installed inside McDonald\u2019s ice cream machines. Those Kytch devices would intercept the ice cream machines\u2019 internal communications and send them out to a web or smartphone interface to help owners remotely monitor and troubleshoot the machines\u2019 many foibles, which are so widely acknowledged that they\u2019ve become a full-blown meme among McDonald\u2019s customers. The two-person startup\u2019s new claims against McDonald\u2019s focus on emails the fast food giant sent to every franchisee in November 2020, instructing them to pull Kytch devices out of their ice cream machines immediately.<\/p>\n<p>\u2026<\/p>\n<p>Kytch cofounder Melissa Nelson says the emails didn\u2019t just result in McDonald\u2019s ice cream machines remaining broken around the world. (About one in seven of the machines in the US remained out of commission on Monday according to McBroken.com, which tracks the problem in real time.) They also kneecapped Kytch\u2019s fast-growing sales just as the startup was taking off. \u201cThey\u2019ve tarnished our name. They scared off our customers and ruined our business. They were anti-competitive. They lied about a product that they said would be released,\u201d Nelson says. \u201cMcDonald\u2019s had every reason to know that Kytch was safe and didn\u2019t have any issues. It was not dangerous, like they claimed. And so we\u2019re suing them.\u201d<\/p>\n<\/blockquote>\n<p><em>Wired<\/em> asked McDonald\u2019s for a comment on the situation last spring, to which the company replied:\u00a0\u201cKytch\u2019s software includes a remote operation function, and with this feature, we believe anyone cleaning, operating or repairing our shake machines (like restaurant crew members or maintenance technicians) could potentially be injured if the equipment is turned on remotely.\u201d<\/p>\n<p>In another statement, McDonald\u2019s said:\u00a0\u201cNothing is more important to us than food quality and safety, which is why all equipment in McDonald\u2019s restaurants is thoroughly vetted before it\u2019s approved for use,\u201d the statement read. \u201cAfter we learned that Kytch\u2019s unapproved device was being tested by some of our franchisees, we held a call to better understand what it was and subsequently communicated a potential safety concern to franchisees.
