Gun manufacturers are not shielded from liability. Rather, they are protected from frivolous lawsuits over the criminal use of guns that are legally made and legally sold.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>During the SOTU, Biden said, \u201cRepeal the liability shield that makes gun manufacturers the only industry in America that can\u2019t be sued.\u201d<\/p>\n<p>When Biden refers to a \u201cliability shield,\u201d he is referencing the Protection of Lawful Commerce in Arms Act (PLCAA), which he campaigned on repealing. PLCAA is the law that protects gun makers from frivolous suits over legally manufactured and legally sold firearms.<\/p>\n<p>In fact, Biden\u2019s SOTU claims about gun makers being free of \u201cliability\u201d are simply reformulated similar claims he has made during the past two years.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>For example, in April 2021, Biden\u2019s <a href=\"https:\/\/www.breitbart.com\/2nd-amendment\/2021\/04\/09\/fact-check-joe-biden-falsely-claims-gun-makers-have-legal-immunity\/\">suggested<\/a> that PLCAA gives gun makers \u201clegal immunity.\u201d<\/p>\n<p>Biden said, \u201cWe should \u2026 eliminate gun manufacturers from the immunity they receive from Congress.\u201d<\/p>\n<div id=\"attachment_19745154\" class=\"wp-caption alignnone\"><a href=\"https:\/\/cndimages.nyc3.cdn.digitaloceanspaces.com\/breaking-news\/wp-content\/uploads\/2022\/02\/Joe-Biden-at-NYPD-HQ-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-19745154\" src=\"https:\/\/cndimages.nyc3.cdn.digitaloceanspaces.com\/breaking-news\/wp-content\/uploads\/2022\/02\/Joe-Biden-at-NYPD-HQ-2.jpg\" alt=\"\" width=\"640\" height=\"480\" \/><\/a><\/p>\n<p class=\"wp-caption-text\">President Joe Biden listens during a Gun Violence Strategies Partnership meeting at the New York Police Department Headquarters in New York on February 3, 2022. (Photo by Brendan Smialowski\/AFP via Getty Images)<\/p>\n<\/div>\n<p>\u201cMost people don\u2019t realize, the only industry in America, a billion dollar industry, that can\u2019t be sued\u2026 are gun manufacturers,\u201d he added.<\/p>\n<p>Breitbart News <a href=\"https:\/\/www.breitbart.com\/2nd-amendment\/2021\/04\/09\/fact-check-joe-biden-falsely-claims-gun-makers-have-legal-immunity\/\">pointed<\/a> out:<\/p>\n<blockquote>\n<p>PLCAA is very narrow in scope. It shields gun makers from lawsuits in situations where a gun, criminally used, was legally made and legally sold.<\/p>\n<p>In other words, Glock cannot be sued over a handgun that was used in crime if that handgun was legally made then distributed from the factory to a Federal Firearms License holder (FFL), then sold via a National Instant Criminal Background System (NICS) check to an individual at retail.<\/p>\n<p>The\u00a0text of PLCAA <a class=\"x5l\" href=\"https:\/\/www.govtrack.us\/congress\/bills\/109\/s397\/text\" target=\"_blank\" rel=\"noopener external\">states<\/a>: \u201cBusinesses in the United States that are engaged in interstate and foreign commerce through the lawful design, manufacture, marketing, distribution, importation, or sale to the public of firearms or ammunition products that have been shipped or transported in interstate or foreign commerce are not, and should not, be liable for the harm caused by those who criminally or unlawfully misuse firearm products or ammunition products that function as designed and intended.\u201d<\/p>\n<p>However, the protections set forth PLCAA do not shield gun manufacturers from lawsuits over defective goods, criminal misconduct on the part of the gun maker, etc. In other words, the protections in PLCAA do not provide gun makers with \u201clegal immunity.\u201d<\/p>\n<\/blockquote>\n<p>During a February 24, 2020, South Carolina campaign speech, Biden <a href=\"https:\/\/www.breitbart.com\/politics\/2020\/02\/24\/joe-biden-to-gun-manufacturers-im-going-to-take-you-down\/\">criticized<\/a>\u00a0the protections in PLCAA then referenced gun makers and said, \u201cI\u2019m going to take you down.\u201d<\/p>\n<p><em>AWR Hawkins is an award-winning Second Amendment columnist for Breitbart News<\/em><em>\u00a0and the writer\/curator of\u00a0<a href=\"https:\/\/www.breitbart.com\/downrange\/\" target=\"_blank\" rel=\"noopener\">Down Range with AWR Hawkins<\/a>,\u00a0<\/em><em>a weekly newsletter focused o<\/em><em>n al<\/em><em>l things Second Amendment, also for Breitbart News.
