McAleenan<\/em>, Jackson wrote a footnote in her ruling stating:<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote>\n<p><strong>The Court uses the term \u201cundocumented non-citizens\u201d throughout this Memorandum Opinion to refer to persons born abroad\u2014the federal immigration statutes call them \u201caliens\u201d<\/strong>\u2014who are deemed \u201cinadmissible\u201d under 8 U.S.C. \u00a7\u00a7 1182(a)(6)(C) or 1182(a)(7) because they have not received authorization to come into, or remain, in the United States. [Emphasis added]\n<\/blockquote>\n<p>Likewise, in\u00a0<em>Kiakombua v. (Kevin Lamarque\/Pool via AP)<\/p>\n<\/div>\n<p>Dan Stein, head of the Federation for American Immigration Reform (FAIR), said in a statement that Jackson\u2019s \u201crefusal at times to use the term \u2018alien\u2019 in the context of interpreting immigration law \u2014 a term of longstanding and legally correct usage \u2014 indicates a willingness to allow politics and political pressure to influence her judgment.\u201d<\/p>\n<p>\u201cThis is of concern to us, as we believe it is up to courts to use the language of the statutory law in decisions interpreting that law,\u201d Stein said.<\/p>\n<p>As Breitbart News <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/25\/bidens-scotus-nominee-helped-strike-down-trumps-border-controls\/\">reported<\/a>, Jackson has a mixed record on immigration \u2014 twice striking down former President Donald Trump\u2019s border controls but also upholding that federal agencies have broad authority to build a wall along the United States-Mexico border and ruling in favor of regulations to tighten up asylum rules.<\/p>\n<p><em>John Binder is a reporter for Breitbart News.
