And if the accused ever does stand trial, it\u2019s likely an insanity defense will be raised, meaning prosecutors will have the burden of proving\u00a0Brown knew what he was doing was wrong.<\/p>\n<p>Once a spot opens up, it\u2019s expected Brown will be\u00a0transferred to Vernon Psychiatric Hospital.<\/p>\n<p>\u201cHe can finally get the help that he needs so he can assist us in his representation,\u201d\u00a0defense attorney Heath Harris said.<\/p>\n<p>Brown was arrested and charged with kidnapping and burglary last year after he allegedly snatched the sleeping four-year-old from his crib and brutally beat him to death, leaving his lifeless, bloodied body in a street where it was found by a local jogger, court documents and video surveillance reportedly show.<\/p>\n<p>Harris, an attorney for Brown, \u201csaid he was frustrated by how slowly authorities were moving but hoped the new charge would mean he\u2019d be able to request an examining trial and get access to evidence,\u201d The Dallas Morning News <a href=\"https:\/\/www.dallasnews.com\/news\/crime\/2021\/06\/09\/man-accused-of-kidnapping-cash-gernon-from-dallas-home-now-faces-a-murder-charge-in-the-boys-death\/\">reported<\/a>. \u201cAt an examining trial, a judge would determine whether there is enough evidence for a case to go before a grand jury.\u201d<\/p>\n<p>\u201cIt\u2019s almost a month after this tragedy, and I\u2019m still waiting to prepare this kid\u2019s defense. We can\u2019t do that till we have all the evidence,\u201d Harris said, noting that he\u2019s waiting for his client\u2019s mental health to be evaluated.<\/p>\n<p>Disturbing night vision footage exclusively <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-9593001\/Video-reveals-moment-Cash-Gernon-snatched-bed-Darriynn-Brown.html\">obtained<\/a> by the Daily Mail seemed to show the terrifying moments before Cash was taken from his crib. The <a href=\"https:\/\/www.dailywire.com\/news\/video-shows-disturbing-moments-before-alleged-killer-snatches-4-year-old-cash-gernon-from-crib-comes-back-for-twin-brother\">footage<\/a> also\u00a0showed the man, allegedly Brown, apparently coming back for Cash\u2019s twin brother, Carter, hours later:<\/p>\n<blockquote>\n<p><em>\u201cThe night-vision footage shows Brown \u2013 dressed in a hoodie and wearing a backpack \u2014 creeping around and hoovering near the child\u2019s bed while he slept. As Brown lifted Gernon\u2019s blanket \u2013 the child appears to awaken \u2013 as Brown whisks him out of the room,\u201d Fox News <a href=\"https:\/\/www.foxnews.com\/us\/moment-murdered-four-year-old-cash-gernon-was-snatched-from-his-bed-as-he-slept-next-to-twin-brother-by-suspec\">reported<\/a>.<\/em><\/p>\n<p><em>According to The Daily Mail, the footage also shows the alleged killer \u201chovering menacingly over Carter Gernon as he slept in the crib he shared with his twin brother Cash around 7 a.m.,\u201d adding, \u201cBut Brown appears to get spooked by a sound in the house and flees, leaving Carter asleep.\u201d<\/em><\/p>\n<\/blockquote>\n<p>The Daily Mail <a href=\"https:\/\/www.dailymail.co.uk\/video\/dailymailtv\/video-2422457\/Teen-ankle-monitor-snatches-4-year-old-murders-him.html?mwv_rm=rta\">reported<\/a>\u00a0at the time that Brown was wearing an ankle monitor when he was detained. The Associated Press\u00a0<a href=\"https:\/\/ktla.com\/news\/nationworld\/4-year-old-boys-body-found-in-dallas-street-teen-arrested\/\">outlined<\/a>\u00a0Brown\u2019s past trouble with the law:<\/p>\n<blockquote>\n<p><em>Brown was arrested on April 27 on a misdemeanor charge of evading arrest in a case that\u2019s still pending. According to court documents for that charge, he lives with his parents a half-mile from where the boy\u2019s body was found. Neighbors have said Brown was known to walk in the area.<\/em><\/p>\n<\/blockquote>\n<p>\u201cBrown is also accused of walking into a Dallas home on Feb. 8 and grabbing a young child.\u00a0Police said he broke in and rummaged around, then punched the homeowner after being confronted,\u201d\u00a0The Dallas Morning News noted. \u201cHe picked up the man\u2019s 2-year-old granddaughter, but the man was able to get the girl back from him, according to an affidavit.
