John Kennedy and \u201cTexas Ted\u201d \u2014 the new nickname assigned to Sen. Ted Cruz after he was sophomorically called \u201cLyin\u2019 Ted\u201d by one of Cruz\u2019s fellow Republican candidates throughout the 2016 Republican presidential primaries, but I digress.<\/p>\n<p>The reason Kennedy and Cruz came to mind, of course, is because I await with bated breath their respective <em>shellacking<\/em> of Biden nominee <a href=\"https:\/\/redstate.com\/nick-arama\/2022\/02\/25\/breaking-biden-announces-his-supreme-court-pick-and-lindsey-graham-is-mad-n527764\" target=\"_blank\" rel=\"noopener\">Ketanji Brown Jackson<\/a> before the Senate Judiciary Committee during Supreme Court nomination hearings. #ProTip: Popcorn. <em>Lots<\/em> of <em>popcorn.<\/em><\/p>\n<p>As <a href=\"https:\/\/www.foxnews.com\/politics\/ketanji-brown-jackson-biden-supreme-court-nominee-overturned-decisions\" target=\"_blank\" rel=\"noopener\">reported<\/a> by Fox News, Jackson will likely be grilled by Kennedy and Cruz, along with the other Republicans on the Senate Judiciary Committee, over a judicial track record that includes multiple decisions overturned by higher courts. Even better, as distinguished law professor Jonathan Turley told Fox, the majority of Jackson\u2019s overturned decisions were deemed by higher courts to constitute judicial overreach.<\/p>\n<blockquote>\n<p>She has some opinions as a district court judge. They\u2019re quite lengthy opinions. She has been reversed, and the D.C. Circuit [Court of Appeals] reversed her for basically judicial overreach in a couple of cases.<\/p>\n<\/blockquote>\n<p>As noted by Fox, a 2019 case involved an order that expanded the Department of Homeland Security (DHS) definition on which noncitizens could be deported. Another overturned case involved <em>three orders<\/em> from Jackson on federal employees\u2019 collective bargaining power.<\/p>\n<p>Jackson\u2019s DHS ruling was overturned by the D.C. Circuit Court, which said after reviewing the DHS policy that it did not fall under the <a href=\"https:\/\/redstate.com\/stu-in-sd\/2021\/04\/28\/where-are-the-republican-lawsuits-under-the-administrative-procedures-act-n370005\" target=\"_blank\" rel=\"noopener\">Administrative Procedure Act<\/a>. Then Jackson\u2019s ruling on the three collective bargaining orders was overturned unanimously by the D.C. Circuit Court, which ruled that she <em>did not have jurisdiction <\/em>to adjudicate the case.<\/p>\n<p>And <em>this,<\/em> from Turley, which is equally troubling if not more so:<\/p>\n<blockquote>\n<p>She\u2019s only actually published a single decision as an appellate judge, and that came out in the last 24 hours.\u00a0[This is] a win for unions against a change by federal agencies.<\/p>\n<\/blockquote>\n<p>Four words to consider (so far), if you\u2019re keeping score at home: <em>legislating from the bench.<\/em><\/p>\n<p><a href=\"https:\/\/judicialnetwork.com\/\" target=\"_blank\" rel=\"noopener\">Judicial Crisis Network<\/a> president Carrie Severino previously told Fox News Digital \u201cJudge Jackson\u2019s record of reversals by the left-leaning D.C. Circuit is troubling for anyone concerned about the rule of law,\u201d as transcribed by Fox.<\/p>\n<blockquote>\n<p>Cases like these suggest that Jackson might be willing in politically charged cases to ignore the law to deliver a particular policy outcome, and that\u2019s not what we want to see from a Supreme Court justice.<\/p>\n<\/blockquote>\n<p>In a mini tweetstorm in which she correctly accused Biden of promising \u201cunity and moderation\u201d but delivering \u201cradical extremism,\u201d Servino tweeted after Biden announced Jackson\u2019s nomination:<\/p>\n<blockquote>\n<p>Expect to hear from Biden and his supporters that Judge Jackson is \u201cin the mainstream.\u201d That\u2019s liberal speak for a judge who will deviate from the text of the constitution and statutes without hesitation to ensure the Left\u2019s preferred policy outcomes.<\/p>\n<\/blockquote>\n<p>Bingo.<\/p>\n<blockquote class=\"twitter-tweet\" data-conversation=\"none\">\n<p dir=\"ltr\" lang=\"en\">Before he was elected, Biden campaigned on the promise of unity and moderation. But since taking office, he has continued to deliver radical extremism. Demonstrably so, by a very simple question:<\/p>\n<p>How many <em>conservative<\/em> black female judges were on Biden\u2019s list?<\/p>\n<p>Rhetorical question.
