In 2019, former President Donald Trump expanded the rule to include migrants who use non-cash benefits like food stamps and Medicaid. Before then, public charge was\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.cnbc.com\/2022\/02\/23\/supreme-court-hears-dispute-over-bidens-rejection-of-trump-era-immigration-rule.html\" target=\"_blank\" rel=\"noopener\">defined<\/a>\u00a0as someone \u201cprimarily dependent on the government for subsistence.\u201d<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>As Breitbart News <a href=\"https:\/\/www.breitbart.com\/economy\/2022\/02\/17\/dhs-mayorkas-oks-citizenship-for-migrants-who-rely-on-welfare\/\">reported<\/a>:<\/p>\n<blockquote>\n<p>The public charge rule was mandated by Congress to help deny residency and citizenship to legal and illegal migrants who cannot work enough to stay out of poverty. The resulting regulation was adapted to exclude migrants who rely on government-delivered welfare and other forms of taxpayer charity, which was then described as being a \u201cpublic charge.\u201d<\/p>\n<p>But the public charge regulation was rarely enforced on migrants and their U.S. sponsors. So President Donald Trump\u2019s deputies issued a regulation that instructed immigration officers on how to decide when particular migrants were dependent on the government\u2019s increasing variety of aid and welfare programs.<\/p>\n<\/blockquote>\n<p>However, an Illinois district judge ruled Trump\u2019s expanded \u201cpublic charge\u201d rule could not be implemented nationwide during Trump\u2019s last months in office. As a result, in March 2021, President Joe Biden\u2019s Administration stopped defending the legal challenges to the rule that carried over from Trump\u2019s administration. After the Illinois district judge\u2019s decision, the Biden administration dismissed the remaining legal challenges involving the public charge rule.<\/p>\n<p>After Biden\u2019s Administration chose not to defend the rule in court, the administration removed the rule from the Federal Register. Then, Biden ordered a new public charge rule.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Biden\u2019s actions likely violate the Administrative Procedure Act (APA) that governs federal rulemaking. Under the APA, the federal government must allow for a notice-and-comment period when implementing new rules and when rescinding old rules.<\/p>\n<p>Chief Justice John Roberts\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/02\/23\/supreme-court-trump-public-charge-rule\/\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0Biden\u2019s attempt to circumvent the APA raised the question of \u201ccollusive action.\u201d<\/p>\n<p>\u201cI\u2019m not questioning anybody\u2019s motives. I\u2019m questioning the ease with which a decision in your favor will make it for an incoming administration to avoid notice-and-comment review,\u201d Chief Justice Roberts\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/02\/23\/supreme-court-trump-public-charge-rule\/\" target=\"_blank\" rel=\"noopener\">told<\/a>\u00a0Biden\u2019s Deputy Solicitor General Brian H. Fletcher.<\/p>\n<p>Justice Elena Kagan also expressed concerns about Biden\u2019s strategy,\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/02\/23\/supreme-court-trump-public-charge-rule\/\" target=\"_blank\" rel=\"noopener\">telling<\/a>\u00a0Fletcher he should \u201cassume that that is a problem and that we shouldn\u2019t be greenlighting that behavior for your administration or any other administration.\u201d<\/p>\n<p>Fletcher defended the Biden Administration\u2019s tactics,\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/rollcall.com\/2022\/02\/23\/supreme-court-hears-arguments-over-public-charge-rule\/\" target=\"_blank\" rel=\"noopener\">saying<\/a>\u00a0on Wednesday:<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<blockquote>\n<p>Here, DHS had decided to issue a new public charge rule, the ongoing litigation would have complicated that rulemaking and required intrusive discovery, the 2019 rule was not producing its intended effects, and the rules\u2019 unintended and unwanted effects were aggravating a public health crisis.<\/p>\n<\/blockquote>\n<p>The oral arguments in this case on Wednesday came less than one week after the Court\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/18\/supreme-court-takes-up-review-of-remain-in-mexico-policy\/\" target=\"_blank\" rel=\"noopener\">agreed<\/a>\u00a0to hear another consequential immigration case involving the Migrant Protection Protocols, commonly known as the \u201cRemain in Mexico\u201d policy.<\/p>\n<p>Arizona leads a coalition of 12 states that argue they should be able to defend the rule in court due to the Biden administration\u2019s acquiescence to the adverse \u201cpublic charge\u201d ruling.<\/p>\n<p>Arizona Attorney General Mark Brnovich\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/02\/23\/supreme-court-trump-public-charge-rule\/\" target=\"_blank\" rel=\"noopener\">argued<\/a>\u00a0that Biden\u2019s strategy is \u201can unprecedented legal maneuver.\u201d Because Biden dismissed the remaining legal challenges to the public charge rule, Arizona argues that states that supported the rule were left with no recourse.<\/p>\n<p>Stephen Miller, former Trump adviser and current President of America First legal, released a statement in support of Arizona\u2019s efforts:<\/p>\n<blockquote>\n<p>America First legal is proud to be working with our state Attorneys General to combat the Biden Administration\u2019s lawless attempts to abandon the defense of federal law. The Biden Administration\u2019s opposition to the plain language of the public charge statute is astounding, and they have rabidly sought\u2013by abandoning the defense of the public charge regulations, and by proposing new regulations now\u2013to advance an incoherent interpretation that permits limitless numbers of welfare-dependent migrants to obtain lawful status in the United States. They must be defeated.<\/p>\n<\/blockquote>\n<p>The Supreme Court will determine whether Arizona and the 12 other states can join the legal battle and pick up where the Trump administration left off. The Court is expected to issue its decision between late spring and early summer.<\/p>\n<p>The Case is\u00a0<em>Arizona v.
