Andrew Cuomo.<\/p>\n<p>Cuomo\u2019s secretary Melissa DeRosa and the governor\u2019s counsel Beth Garvey told Democratic lawmakers in a meeting last week that the administration has yet to revoke the licenses of any nursing homes facing allegations of mishandling residents during the pandemic. The aides blamed the lax enforcement on inadequate laws and \u201csignificant due process,\u201d according to <a href=\"https:\/\/nypost.com\/2021\/02\/14\/ny-laws-go-too-easy-on-nursing-homes-cuomo-aides-admit\/\">The New York Post<\/a>.<\/p>\n<p>\u201cI think a lot of these nursing homes, frankly, retrospectively, even prior to COVID have been getting away with a lot for a lot of years,\u201d DeRosa told lawmakers, according to audio of the meeting received and reviewed by the Post.<\/p>\n<p>\u201cI think that if there is any evidence that anyone was willful, or anyone was negligent in a way that goes beyond the normal course that costs people\u2019s lives, I think that we all share the same goal, which is to hold them accountable,\u201d DeRosa added.<\/p>\n<p>Garvey told the lawmakers that attempts to hold nursing homes accountable and to revoke the licenses of those found guilty of misconduct have not moved forward much because of a lengthy due process system.<\/p>\n<p>\u201cIt has not happened,\u201d Garvey said when asked if Cuomo\u2019s administration has revoked the license of any nursing home accused of misconduct. \u201cWe have significant due process, obviously, for those operators that we have to go through and hearings. So those are still ongoing.\u201d<\/p>\n<p>DeRosa <a href=\"https:\/\/www.dailywire.com\/news\/report-cuomos-top-aide-says-new-york-hid-nursing-home-death-toll\">ignited<\/a> a firestorm around Cuomo\u2019s handling of New York\u2019s nursing homes throughout the pandemic. At another point in the meeting, the governor\u2019s secretary said that Cuomo\u2019s administration kept the true impact of the disease in nursing homes hidden from the public for months out of fear of federal prosecution.<\/p>\n<p>\u201cAnd basically, we froze,\u201d DeRosa said. \u201cBecause then we were in a position where we weren\u2019t sure if what we were going to give to the Department of Justice, or what we give to you guys, what we start saying, was going to be used against us while we weren\u2019t sure if there was going to be an investigation\u201d by then-President Trump\u2019s Department of Justice.<\/p>\n<p>Bipartisan backlash has rocked Cuomo since DeRosa\u2019s revelation was made public last week. Republicans across the state have called for the governor\u2019s resignation while over aa dozen state Democratic lawmakers have <a href=\"https:\/\/www.dailywire.com\/news\/new-york-democrat-state-senators-issue-statement-calling-for-cuomos-emergency-powers-to-be-stripped\">pushed<\/a> to strip the governor of his emergency powers.<\/p>\n<p>\u201cWithout exception, the New York State Constitution calls for the Legislature to govern as a co-equal branch of government,\u201d a group of Democratic senators wrote in a statement. \u201cWhile COVID-19 has tested the limits of our people and state \u2013 and, early during the pandemic, required the government to restructure decision making to render rapid, necessary public health judgments \u2013 it is clear that the expanded emergency powers granted to the Governor are no longer appropriate.
