Therefore, we ask that your decisions comport with the Constitution and our nation\u2019s laws by consulting with Congress to receive authorization before any such deployment.\u201d<\/p>\n<p>The letter specifically mentioned the Constitutional conflict between Congress\u2019 power to declare war under <a href=\"https:\/\/www.law.cornell.edu\/constitution\/articlei\">Article I<\/a> of the Constitution with the president\u2019s authority as commander-in-chief of the armed forces under <a href=\"https:\/\/constitution.congress.gov\/constitution\/article-2\/\">Article II<\/a>. \u201cThis crossover was intentionally written by the framers of the U.S. Constitution so Congress and the President would be required to cooperate on our nation\u2019s military affairs.\u201d In addition, the members argued, the War Powers Resolution of 1973, passed in the aftermath of the Vietnam War and after years of \u201cunauthorized involvement by U.S. Armed Forces\u201d in conflicts, reinforced the need for cooperation between the president and Congress by ensuring that \u201c\u2018the collective judgment of both the Congress and the President\u2019 would be utilized before the \u2018introduction of United States Armed Forces into hostilities, or into situations where imminent involvement in hostilities is clearly indicated by the circumstances.\u2019\u201d<\/p>\n<p>\u201cOur nation\u2019s laws are highly relevant to the ongoing situation in Ukraine,\u201d the members continued. \u201cWere an attack by Russia to be imminent or underway, the War Powers Resolution would clearly require congressional authorization before the President may command U.S. Armed Forces to engage in hostilities.\u201d The members stressed that the guidelines would not require Congressional approval for American forces to play an advisory role, citing the administration\u2019s recent withdrawal of <a href=\"https:\/\/www.wtsp.com\/article\/news\/nation-world\/florida-national-guard-removed-f-ukraine\/67-a268dcaa-7404-48a7-9bf8-7841ddd13a69\">160 Florida National Guardsmen<\/a> who had been training Ukranian soldiers. However, they stressed that \u201c<span>an imminent or active attack by Russia would compel you, under Section 8(c) <\/span><span>of the War Powers Resolution, to seek specific Congressional authorization if you aim to leave any remaining U.S. advisers, trainers, special forces, or other U.S. military personnel in areas of these imminent or active hostilities.\u201d They also reminded Biden that he must get the same approval in order to launch a preemptive strike against Russia.<\/span><\/p>\n<p>\u201cWe strongly urge your administration to respect the separation of powers, U.S. law, and Congress\u2019s constitutional war powers authority,\u201d the members said, adding that Congress \u201cstands ready\u201d to debate the implications of a war posture. But until that time, \u201c[t]he American people, through their representatives in Congress, deserve to have a say before U.S. troops are placed in harm\u2019s way or the U.S. becomes involved in yet another foreign conflict,\u201d the members concluded.<\/p>\n<p>The letter was signed by 43 members of the House of Representatives from both parties and across the ideological spectrum. Notable co-signers included Texas Republican Rep. Louie Gohmert, Arizona Republican Reps. Andy Biggs and Paul Gosar, Kentucky Republican Thomas Massie, Florida Republican Matt Gaetz, and Progressive Democratic \u201cSquad\u201d members Reps.
