I kind of feel like this could be an issue, but what do you think? Is there something wrong here?\u201d<\/p>\n<p>Hostin agreed, <a href=\"https:\/\/dailywire.com\/news\/oh-clarence-the-view-trots-out-racist-trope-claiming-justice-clarence-thomas-doesnt-really-represent-the-black-community\/\">complaining as she has in the past<\/a>\u00a0that the Supreme Court does not have to abide by the same strict code of ethics and behavior that restrains other appointees to the federal bench.<\/p>\n<p>\u201cThe thing about the Supreme Court is that it\u2019s just not bound by the same rules that other federal judges are bound by. Like, we\u2019re thinking that this doesn\u2019t look right, that there\u2019s an appearance of impropriety \u2026 They just don\u2019t have that same code of conduct,\u201d she said. \u201cAnd so, he hasn\u2019t recused himself with these cases that his wife is sort of very involved in.\u201d<\/p>\n<p>Hostin went on to note that Thomas had recused himself when a case concerning a military academy came before the court while his son was in attendance, arguing that he should also step back from cases regarding January 6th.<\/p>\n<p>\u201cWhy not this time, when his wife was intimately involved in politics?\u201d she asked.<\/p>\n<p>\u201cIt\u2019s unbelievable to me,\u201d Behar agreed. \u201cThis is unprecedented, we\u2019ve never seen this before.\u201d<\/p>\n<p>Hostin went on to say that judges had to recuse themselves if their spouses were party to specific litigation or were officers or trustees of an involved party.<\/p>\n<p>\u201cSo it\u2019s kind of slicing it pretty thin when Justice Thomas is saying, \u2018Well my wife\u2019s not really \u2014 not really a party, she\u2019s not really a director of these organizations,\u2019 but she holds a leadership position,\u201d Hostin continued to complain, and Behar asked how the right might respond if Justice Sonia Sotomayor had a friend who was \u201cegging on an insurrection.\u201d<\/p>\n<p>According to a Politifact <a href=\"https:\/\/www.politifact.com\/factchecks\/2022\/jan\/11\/facebook-posts\/theres-no-evidence-ginni-thomas-organized-jan-6-ev\/\">fact-check<\/a> published on January 11, 2022, Thomas did write social media posts on January 6, 2021, cheering on the protests and rally-goers \u2014 but after the situation turned violent, she amended those posts to clarify that they were written before the situation had devolved.
