The lower court ruling also required Dakota Access pipeline (DAPL) operator Energy Transfer to shut down operations of the pipeline within 30 days, but an appeals court <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-560\/193078\/20210920175151276_DAPL%20-%20Cert%20Petition%20Appendices%20-%20Volume%20II.pdf#page=395\">nixed<\/a> that part of the ruling in August 2020.<\/p>\n<p>While the pipeline, which <a href=\"https:\/\/ir.energytransfer.com\/static-files\/ef92fa63-5d75-427d-a1d3-795b93a67fc5\">transports<\/a> an estimated 570,000 barrels of crude oil per day from North Dakota to Illinois, remains operational, Energy Transfer has argued that the threat of a sweeping EIS and potential shutdown has created uncertainty for its future. The company asked the Supreme Court to review its case and cancel the environmental review in a September <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/21-560.html\">court filing<\/a>.<\/p>\n<p>\u201cDAPL\u2019s ongoing operation thus remains uncertain, with a substantial risk of a shutdown,\u201d the company wrote. \u201cThis Court should intervene to eliminate this uncertainty and, by reversing the panel decision, restore Dakota Access\u2019s easement in order to ensure its continued operation and avoid the economic and environmental fallout of a shutdown.\u201d<\/p>\n<p>In January 2017, former President Donald Trump <a href=\"https:\/\/dailycaller.com\/2017\/01\/25\/heres-the-actual-text-of-trumps-executive-orders-on-keystone-xl-dakota-pipelines\/\">signed an executive order<\/a> expediting the U.S. Army Corps of Engineers\u2019 review of the DAPL. Environmental groups and Native American tribes, which filed the legal challenge against the Trump administration over the pipeline approval, <a href=\"https:\/\/earthjustice.org\/brief\/2021\/biden-delivers-disappointment-on-the-dakota-access-pipeline\">strongly criticized<\/a> the decision to allow the DAPL to continue operations.<\/p>\n<p>\u201cWe are gravely concerned about the continued operation of this pipeline, which poses an unacceptable risk to our sovereign nation,\u201d Mike Faith, chairman of the Standing Rock Sioux Tribe, said in a statement. \u201cIn a meeting with members of Biden\u2019s staff earlier this year, we were told that this new administration wanted to \u2018get this right.\u2019\u201d<\/p>\n<p>\u201cUnfortunately, today\u2019s update from the U.S. Army Corps of Engineers shows it has chosen to ignore our pleas and stick to the wrong path,\u201d Faith added. <strong><a href=\"https:\/\/dailycaller.com\/2022\/02\/18\/united-states-energy-crude-oil-imports-joe-biden\/\">(RELATED: US Set To Again Become Net Importer Of Oil)<\/a><\/strong><\/p>\n<p>The DAPL has been the subject of many protests from activists and <a href=\"https:\/\/dailycaller.com\/2021\/02\/09\/scarlett-johansson-chris-evans-stars-joe-biden-dakota-access-pipeline\/\">Hollywood celebrities<\/a> alike. Environmentalists have <a href=\"https:\/\/www.theguardian.com\/environment\/2018\/oct\/16\/dakota-access-pipeline-bayou-bridge-protest-activism\">argued<\/a> the pipeline could leak, causing significant damage to tribal lands and water sources it crosses beneath.<\/p>\n<p>But Energy Transfer has <a href=\"https:\/\/daplpipelinefacts.com\/The-Facts.html\">countered<\/a>, saying the pipeline is \u201cone of the most technologically advanced and safest pipelines\u201d ever built and doesn\u2019t cross Native lands.
