He also admitted that Tubbs went on after the 2014 attack to commit other offenses \u2013 including one in which DNA evidence linked her to the Denny\u2019s assault.<\/p>\n<p>&#8220;If we knew about her disregard for the harm she caused we would have handled this case differently,&#8221; Tuesday afternoon.<\/p>\n<p>Alex Bastian, Gascon\u2019s special adviser, said on &#8220;America\u2019s Newsroom&#8221; earlier in the day that &#8220;the content of these jail calls was something that we did not know about&#8221; until Fox News\u2019 Bill Melugin asked for comment on the alarming statements Tubbs made in calls with her father between November and January.<\/p>\n<p>&#8220;That statement that Alex Bastian made is completely untrue,&#8221; OR \u2018LYING\u2019?<\/strong><\/a><\/p>\n<p>He pointed to a Los Angeles Times report in which Bastian went on the record to state that senior aides in Gascon\u2019s office knew about the calls.<\/p>\n<p>Hatami said that he has seen emails that show discussion of the calls circulated at the highest levels of Gascon\u2019s office \u2013 and that they should be available under California\u2019s open records laws.<\/p>\n<p>&#8220;I\u2019ve seen emails, emails that show that George Gascon and his chain of command knew about those jail calls well before Bill Melugin published them,&#8221; He doubled down on his claim that he didn&#8217;t know about the jailhouse calls until last Thursday.<\/p>\n<p>&#8220;I became aware last Thursday of the contents of that call, and the contents of that call were extremely disturbing to me because it showed a level of callousness and a level of disrespect for humanity from an individual that I had previously felt, given her conditions when the crime had originally occurred, she needed to be prosecuted as a juvenile,&#8221; he said. &#8220;I, as a result of reviewing the contents of that particular jail call, I came to the conclusion that this person was gaming the system.&#8221;<\/p>\n<p>The victim, now 18, was 10 when Tubbs allegedly assaulted her in a Denny\u2019s restroom on New Year\u2019s in 2014.<\/p>\n<p>In a statement, she told Fox News Monday that Tubbs\u2019 lenient treatment was a miscarriage of justice, &#8220;insulting and &#8220;unfair&#8221; to her as a victim.<\/p>\n<p>&#8220;The things he did to me and made me do that day was beyond horrible for a ten-year-old girl to have to go through,&#8221; she said. &#8220;I want him tried as an adult for the crimes he committed against me.&#8221;<\/p>\n<p>Gascon is under intense pressure from his own deputies as well as the public amid a second recall petition in just over a year in office. The Los Angeles Association of Deputy District Attorneys Wednesday voted by a 97.9% majority to support the recall effort against their boss.<\/p>\n<p><a href=\"https:\/\/westcoasttriallawyers.com\/attorneys\/neama-rahmani\/\" target=\"_blank\" rel=\"noopener\">Neama Rahmani<\/a>, a Los Angeles-based former federal prosecutor, told Fox News Digital Tuesday that the heightened scrutiny now is too little, too late since Tubbs has already been sentenced to two years in a juvenile facility \u2013 of which she could serve as little as two months.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/us\/liberal-la-county-da-gascon-progressive-crime-wave-blowback\" target=\"_blank\" rel=\"noopener\"><strong><u>LOS ANGELES COUNTY DA GEORGE GASCON BACKPEDALS ON PROGRESSIVE DIRECTIVES AMID CRIME WAVE, PUBLIC BLOWBACK<\/u><\/strong><\/a><\/p>\n<p>&#8220;Gascon is either lying or poorly managing his office,&#8221; he said. &#8220;Either way, it\u2019s a very bad look for someone who is facing a recall. And it\u2019s even worse for the victim of sexual assault. Who didn\u2019t receive the criminal justice she deserved because of Gascon\u2019s blanket policies.&#8221;<\/p>\n<p>However intense criticism of those policies came to a head last week, when Gascon began backpedaling.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/us\/la-county-prosecutor-blasts-policy-change-on-juvenile-cases-amid-controversy-over-trans-child-molester-case\" target=\"_blank\" rel=\"noopener\"><strong><u>LA PROSECUTOR BLASTS POLICY CHANGE AMID CONTROVERSY OVER TRANS CHILD MOLESTER CASE<\/u><\/strong><\/a><\/p>\n<p>Last Wednesday, Gascon\u2019s chief deputy Sharon Woo sent a memo to prosecutors easing up on a blanket ban on seeking to try juveniles in adult court.<\/p>\n<p>At the time, Gascon\u2019s office denied the move had any connection to the Tubbs case and instead said the change came as prosecutors await a series of state Supreme Court decisions that are expected to send multiple cases back to Los Angeles.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/apps-products?pid=AppArticleLink\" target=\"_blank\" rel=\"noopener\"><strong><u>CLICK HERE TO GET THE FOX NEWS APP<\/u><\/strong><\/a>\u00a0\u00a0<\/p>\n<p>Then on Friday, in a series of five memos sent to staff, Gascon softened his other directives, saying exceptions could be made to once again bring charges that would carry sentences of life without parole and allow juveniles to be tried in adult court.
