Why?\u00a0Equity.<\/p>\n<p>In 2018, California enacted the blatantly unconstitutional\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180SB826\" target=\"_blank\" rel=\"noreferrer noopener\">SB 826<\/a>, which requires publicly held corporations to have a state-mandated number of women on their boards \u2014 one fewer than the majority for odd-numbered boards, and half for even-numbered boards.\u00a0<\/p>\n<p>Now the final nail has been placed in the coffin of the\u00a0<a href=\"https:\/\/www.eeoc.gov\/statutes\/title-vii-civil-rights-act-1964\" target=\"_blank\" rel=\"noreferrer noopener\">Civil Rights Act<\/a>. California enacted\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201920200AB979\" target=\"_blank\" rel=\"noreferrer noopener\">AB 979<\/a>\u00a0in 2020 to require that a minimum number of \u201cunderrepresented communities\u201d also get positions on these same corporate boards.\u00a0That means boards must contain a certain number of members representing ethnic minorities and non-traditional sexual orientations.<\/p>\n<p>Those who thought the leftist mob would stop at demanding that women receive guaranteed seats simply because of their sex were wrong. Several groups are suing to stop such progressive activists from pushing these unconstitutional policies \u2014 with cases such as <a href=\"https:\/\/nationalcenter.org\/ncppr\/2021\/11\/29\/shareholder-activists-sue-california-over-radical-board-of-director-rules\/\">Center for Public Policy Research v. Weber<\/a>, <a href=\"https:\/\/nationalcenter.org\/ncppr\/2021\/10\/07\/sec-sued-for-approving-nasdaqs-racist-sexist-board-quota-rules\/\">National Center for Public Policy Research v. SEC<\/a>, and Judicial Watch\u2019s suit against California.<\/p>\n<h2 id=\"civil-rights-movement-sullied\">Civil Rights Movement Sullied<\/h2>\n<p>One can\u2019t help but weep for the civil rights movement. The tremendous sacrifices, losses, and displays of courage driving the promise of a more perfect union \u2014 dignity, respect, and equality for\u00a0<em>all<\/em>\u00a0people \u2014 are sullied. Bigotry, racism, and flagrant sexism are now par for the course.\u00a0<\/p>\n<p>The sitting president of the United States announced he will only consider a black woman for the new vacancy on the U.S. Supreme Court. This should have shocked the conscience, yet it doesn\u2019t seem beyond the pale anymore. These recent laws, the president\u2019s statement, and the widespread acceptance of these off-putting measures suggest equality has been laid to rest in the name of\u00a0<em>equity<\/em>.\u00a0<\/p>\n<h2 id=\"equity-can-t-change-the-math\">\u2018Equity\u2019 Can\u2019t Change the Math<\/h2>\n<p>In reality, policies aimed at achieving equity \u2014 the catch-all term for blatant discrimination against men, whites, Christians, heterosexuals, and oftentimes <a href=\"https:\/\/www.wgbh.org\/news\/education\/2021\/07\/22\/as-supreme-court-weighs-harvard-admissions-case-two-asian-americans-speak-out-and-allege-bias\" target=\"_blank\" rel=\"noreferrer noopener\">Asians<\/a> \u2014 are really meant to wildly overrepresent certain groups. For instance, many companies have initiatives aimed at increasing the number of black senior leaders from some lower percentage to a radically high number \u2014 as high as 20 percent. One problem: black Americans only make up <a href=\"https:\/\/www.census.gov\/quickfacts\/fact\/table\/US\/RHI225219\">13.4 percent<\/a> of the population.<\/p>\n<p>Racial quotas within the workforce create\u00a0a zero-sum game. Companies can hire and promote more black Americans, but they cannot increase the overall black population. More black Americans in leadership roles at Company A means less black Americans available for Company B.<\/p>\n<p>The same can be said of women in the workforce. <a href=\"https:\/\/www.census.gov\/prod\/cen2010\/briefs\/c2010br-03.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Census data<\/a>\u00a0for 2010 showed a U.S. population of 308.7 million \u2014 151.7 million males and 156.9 million females. Despite these extremely similar numbers,\u00a0<a href=\"https:\/\/www.bls.gov\/charts\/employment-situation\/civilian-labor-force-participation-rate.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Bureau of Labor Statistics<\/a>\u00a0data shows only 60 percent of women older than 20 years old participated in the labor force in 2010, compared to 74 percent of men. Knowing that a higher percentage of men participate in the workforce, only someone inherently bad at math would try to mandate a work environment that was half men and half women.\u00a0<\/p>\n<h2 id=\"zero-sum-game\">Zero-Sum Game<\/h2>\n<p>Again, recognizing these numbers as hard data points, this is a zero-sum game wherein every organization that successfully creates this misguided equity dream of half men and half women ensures that other companies won\u2019t be able to achieve those \u201cequitable\u201d outcomes \u2014 outcomes which in reality are actually disproportionate to true workforce demographics.<\/p>\n<p>It stands to reason that a truly fair board \u2014 one accurately representing the workforce \u2014 would have more men than women. While some might say this conclusion is hateful, others should recognize it as an empirical fact based on bona fide data.\u00a0<\/p>\n<h2 id=\"equity-policies-are-unjust\">Equity Policies Are Unjust<\/h2>\n<p>Setting all the math aside, policies like those implemented in California and throughout private companies are unjust and very likely illegal. At least that\u2019s what <a href=\"https:\/\/abc7.com\/diversity-lawsuit-california-board-of-directors\/6818511\/\" target=\"_blank\" rel=\"noreferrer noopener\">Judicial Watch<\/a>\u00a0and\u00a0the <a href=\"https:\/\/nationalcenter.org\/ncppr\/2021\/11\/29\/shareholder-activists-sue-california-over-radical-board-of-director-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\">Free Enterprise Project<\/a>\u00a0of the National Center for Public Policy Research have concluded. Both groups have filed lawsuits exposing the laws for what they are \u2014 racist, sexist, and discriminatory on many fronts.\u00a0<\/p>\n<p>These \u201cprogressive\u201d policies usurp Dr. Martin Luther King Jr\u2019s place in history \u2014 choosing race, gender, and sexual orientation over the content of one\u2019s character.
