Opponents of the law say the bill goes much further than simply banning discrimination, however, and the penalties for violating it are as high as $50,000.<\/p>\n<p>\u201cThe adjudicating tribunal is the mayor-appointed human rights commission who can assess damages and attorney\u2019s fees against the offending person. In addition, they can impose fines ranging from: $10,000 for first offenses; $25,000 for each repeated offense within 5 years; and $50,000 for each repeated offense within a 7 year period,\u201d Nebraska Family Alliance (NFA) Policy Director Nate Grasz told The Daily Wire in an email. \u201cThose are the definition of \u2018draconian\u2019 and would quickly bankrupt any person or business.\u201d<\/p>\n<p>NFA <a href=\"https:\/\/journalstar.com\/news\/local\/govt-and-politics\/fairness-ordinance-brings-citys-human-rights-commission-into-spotlight\/article_4adb9318-a245-5e53-b180-ab18965cf88e.html\">filed<\/a> a petition on Tuesday to stop the ordinance, which has yet to be signed by the mayor, from taking effect. The NFA has until 15 days after submitting the petition to collect 4,137 signatures to stop the bill.<\/p>\n<p>Nebraska Governor Pete Ricketts (R) issued a statement condemning the bill on Monday: \u201cThis ordinance is anything but fair \u2014 it should be called the \u2018unfairness ordinance.\u2019 It puts girls at risk by allowing men into girls\u2019 bathrooms. It applies to private schools and not to public schools. It prevents parents from helping their kids who are experiencing gender dysphoria. And it threatens to bankrupt families who instill traditional values on their children \u2014 anyone who disagrees could get fined up to $50,000. I urge the people of Lincoln to sign the petition to let the people vote on these unfair policies!\u201d<\/p>\n<p>Grasz says the Fairness Ordinance is in part a \u201cbathroom bill\u201d that allows men to enter women\u2019s restrooms if the man identifies as female. The ordinance also has far-reaching implications on speech and religious grounds.<\/p>\n<p>\u201cPurporting to punish discrimination in housing, employment and public accommodation, the ordinance redefines sex to mean \u2018female, male, neither or both\u2019 and includes \u2018sexual orientation\u2019 \u2026 and \u2018gender identity or expression\u2019 \u2026 as protected categories in public accommodation, housing and employment,\u201d Grasz told The Daily Wire in an email.<\/p>\n<p>\u201c\u2018Public accommodation\u2019 is incredibly broad and encompasses \u2018all places or businesses offering or holding out to the general public goods, services, privileges, facilities, advantages, and accommodations for the peace, comfort, health, welfare, and safety of the general public,\u2019\u201d he continued. \u201cThat\u2019s pretty much everywhere and anything.\u201d<\/p>\n<p>City code includes exemptions for \u201cany place of public accommodation owned by a religious corporation which gives preference in the use of such place to members of the same faith,\u201d but the exemption is limited. Grasz said that ordinance can still apply to the staff of such religious organizations as individuals.<\/p>\n<p>The ordinance overhauls city code banning \u201csexual harassment.\u201d The new legislation would expand bans on sexual harassment to include places of \u201cpublic accommodation.\u201d It also expands the definition of sexual harassment to include \u201cverbal conduct\u201d that \u201cunreasonably interfer[es] with an individual\u2019s work performance or creat[es] an intimidating, hostile or offensive environment in employment, housing or public accommodation.\u201d<\/p>\n<p>\u201cIf I don\u2019t use a person\u2019s preferred pronouns or if I dare to talk publicly about human sexuality in a way that might have the \u2018effect\u2019 of intimidating or offending them \u2013 or interfering with their work performance \u2013 I might be liable for a discriminatory act,\u201d Grasz said.<\/p>\n<p>\u201cIt also broadens the \u2018conversion therapy\u2019 ban passed last year to include punishment for anyone trained in counseling (including pastors) who would counsel a minor away from transgenderism or homosexuality,\u201d he added. \u201cSo if a pastor had counseling as a part of their professional training, they are liable if they talk in biblical terms to a minor who is struggling with gender identity.\u201d<\/p>\n<p><em>The Daily Wire\u2019s first original film, Shut In, has made its cinematic debut, being met with rave reviews.
