However, the SEC has not distributed the $40 million in collected fines to shareholders and continues to subpoena Tesla regarding Musk\u2019s social media use, according to a filing earlier this week.<\/span><\/p>\n<p><a href=\"https:\/\/www.wsj.com\/articles\/elon-musks-accusation-of-harassment-countered-by-sec-11645232813?mod=business_lead_pos6\"><span>The Wall Street Journal<\/span><\/a><span> reported that the agency believes \u201cits engagement with Tesla and Mr. Musk about how they comply with the policy is consistent with the expectations of the court overseeing the settlement.\u201d<\/span><\/p>\n<p><span>\u201cThe commission\u2019s enforcement staff have \u2026 sought to meet and confer with counsel for Tesla and Mr. Musk to address any concerns regarding Tesla and Mr. Musk\u2019s compliance,\u201d wrote senior SEC official Steven Buchholz in a letter to a Manhattan federal judge.<\/span><\/p>\n<p><span>As <\/span><a href=\"https:\/\/www.dailywire.com\/news\/elon-musk-accuses-federal-agency-of-harassment-trying-to-chill-his-free-speech\"><span>The Daily Wire<\/span><\/a><span> reported on Thursday, Musk\u2019s counsel <\/span><a href=\"https:\/\/www.cnbc.com\/2022\/02\/17\/tesla-ceo-musk-accuses-sec-of-calculated-effort-to-chill-his-right-to-free-speech.html\"><span>wrote<\/span><\/a><span> that Tesla thought settling the charges would conclude the SEC\u2019s \u201charassment\u201d of Musk, observing that \u201cthe SEC has broken its promises\u201d and is now \u201cweaponizing the consent decree by using it to try to muzzle and harass Mr. Musk and Tesla.\u201d<\/span><\/p>\n<p><span>\u201cThe SEC seems to be targeting Mr. Musk and Tesla for unrelenting investigation largely because Mr. Musk remains an outspoken critic of the government,\u201d the filing explained. \u201cThe SEC\u2019s outsized efforts seem calculated to chill his exercise of First Amendment rights rather than to enforce generally applicable laws in evenhanded fashion.\u201d<\/span><\/p>\n<p><span>Indeed, Musk is frequently outspoken on national political issues \u2014 and appears to be no fan of President Joe Biden.<\/span><\/p>\n<p><span>When the White House has featured electric vehicle makers such as GM and Ford at various events, Tesla \u2014 the world\u2019s largest electric vehicle manufacturer \u2014 has been sometimes omitted. The <\/span><a href=\"https:\/\/www.dailywire.com\/news\/joe-bidens-electric-vehicle-summit-excludes-tesla\"><span>snubbing<\/span><\/a><span> may lie in the fact that Tesla is not unionized \u2014 as White House Press Secretary Jen Psaki hinted last year when she was asked why Tesla was not invited to an electric vehicle summit in which Ford and GM participated.<\/span><\/p>\n<p><span>\u201cWell, we, of course, welcome the efforts of all automakers who recognize the potential of an electric vehicle future and support efforts that will help reach the president\u2019s goal. And certainly, Tesla is one of those companies,\u201d Psaki said. \u201cToday, it\u2019s the three largest employers of the United Auto Workers, and the UAW president who will stand with President Biden as he announces his ambitious new target, but I would not expect this is the last time we talk about clean cars, the move toward electric vehicles, and we look forward to having a range of partners in that effort.\u201d<\/span><\/p>\n<p><span>When asked if Tesla was omitted because it was not unionized, Psaki repeated that attendees included \u201cthe three largest employers of the United Auto Workers.\u201d<\/span><\/p>\n<p><span>\u201cI\u2019ll let you draw your own conclusions,\u201d she added.<\/span><\/p>\n<p><i><span>The Daily Wire\u2019s first original film, Shut In, has made its cinematic debut, being met with rave reviews.
