A legal battle ensued when Biden\u2019s DHS Secretary Alejandro Mayorkas issued a memo terminating the program in June.<\/p>\n<p>Then, Texas-based federal Judge Matthew Kacsmaryk ordered Biden to \u201cenforce and implement MPP in good faith\u201d following a lawsuit from Texas and Missouri. After the DHS issued a second revocation memo in October, the&nbsp;U.S.&nbsp;Court of Appeals&nbsp;for the Fifth Circuit affirmed the district court\u2019s order requiring Biden to implement the program in good faith.<\/p>\n<p>Biden\u2019s administration then filed a petition for certiorari asking the Court to hear its argument in the MPP case. In January, the Court&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/01\/28\/biden-asks-supreme-court-to-end-trumps-remain-in-mexico-policy\/\" target=\"_blank\" rel=\"noopener\">rejected<\/a>&nbsp;a request from Texas to extend the time to file a response to Biden\u2019s petition by one month.<\/p>\n<p>Biden began re-enrolling migrants into the MPP in December, but he is dragging it out much more slowly than former President Donald Trump. Trump\u2019s administration sent roughly 400 migrants back to Mexico daily at the program\u2019s peak. However, Biden has sent approximately 410 migrants period back to Mexico under the revived program.<\/p>\n<p>With arguments set for April, the Supreme Court\u2019s decision is expected in summer.<\/p>\n<p>The case is <i>Biden v.
