In his <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/09\/judge-allows-united-airlines-to-mandate-vaccination-for-employees-criticizes-calloused-approach\/\">opinion<\/a>, Pittman was sympathetic to employees but said he was bound by court precedent, and he declined the request because employees could not prove \u201cirreparable harm,\u201d one of four variables which need to be satisfied in court in order for a judge to issue an injunction and preserve the \u201cstatus quo\u201d during litigation. Federal Judges Andy Oldham and Jennifer Elrod reversed Pittman\u2019s ruling, pointing to the \u201crather unique\u201d nature of the case.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p><span>\u201cPlaintiffs allege a harm that is ongoing and cannot be remedied later: they are actively being coerced to violate their religious convictions. Because that harm is irreparable, we reverse the district court,\u201d Oldham, a President Donald Trump appointee, and Elrod, a George W. Bush appointee, wrote in their opinion.&nbsp;<\/span><\/p>\n<p><span>The panel <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/01\/04\/federal-judges-hear-arguments-in-united-airlines-vaccine-mandate-case\/\">heard arguments<\/a> in the case in early January.&nbsp;<\/span><span>The Fifth Circuit, which is widely considered the most conservative appeals court, initially rejected an emergency request to halt the mandate in mid-December, but&nbsp;<a href=\"https:\/\/www.breitbart.com\/health\/2021\/12\/14\/appeals-court-refuses-to-block-united-airlines-vaccine-mandate\/\">granted<\/a>&nbsp;a motion to expedite an appeal in the case after Pittman\u2019s decision to refuse the injunction in November 2021.&nbsp;<\/span><\/p>\n<p><span>United Airlines is estimated to have placed around 2,000 employees who were granted religious or medical exemptions on unpaid leave for foregoing vaccination \u2014 a measure the company argued is a reasonable accommodation to its policy.&nbsp;<\/span><span>Those employees have also been stripped of their health benefits and many are the subject of a non-compete clause.&nbsp;<\/span><span>The lawsuit, which was originally&nbsp;<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/Users\/katherinehamilton\/Downloads\/1%20-%20Complaint%20(1).pdf\" target=\"_blank\" rel=\"noopener noreferrer\">filed<\/a>&nbsp;by six United Airlines employees in September of 2021, alleges that the company violated&nbsp;Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act (ADA) by discriminating against them based on their religious&nbsp;beliefs&nbsp;and medical&nbsp;conditions.<\/span><\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Despite being \u201cdisturbed\u201d by United Airlines\u2019 \u201cseemingly calloused approach to its employees\u2019 deeply personal concerns,\u201d Pittman, at the time, specifically said a loss of income does not constitute irreparable harm.<\/p>\n<p><span>\u201cThe Court is not insensitive to Plaintiffs\u2019 plight. A loss of income, even temporary, can quickly ripple out to touch nearly every aspect of peoples\u2019 lives, and the lives of their families and dependents. But the Court\u2019s analysis must be guided by the law, not by its sympathy,\u201d Pittman said in his opinion, acknowledging that some plaintiff\u2019s in the lawsuit will suffer hardships such as losing income to pay for cancer treatments, becoming homeless, and being unable to pay for their child\u2019s\u2019 education.<\/span><\/p>\n<p>In response, Oldham and Elrod distinguished two separate aspects of irreparable harm in the United case, which informed their decision to reverse Pittman\u2019s ruling.<\/p>\n<p><span>\u201cThe first is United\u2019s decision to place them on indefinite unpaid leave; that harm, and any harm that flows from it, can be remedied through backpay, reinstatement, or otherwise,\u201d the judges wrote. \u201cThe second form of harm flows from United\u2019s decision to coerce the plaintiffs into violating their religious convictions; that harm and that harm alone is irreparable and supports a preliminary injunction.\u201d<\/span><\/p>\n<p><span>Ronald Reagan appointee Jerry Smith penned the dissent, accusing his colleagues of \u201cplay[ing] CEO of a multinational corporation.\u201d<\/span><\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p><span>\u201c\u2026The majority shatter every dish in the china shop. It rewrites Title VII to create a new cause of action,\u201d Smith said.&nbsp;<\/span><\/p>\n<p><span>Smith argued that the panel should have affirmed Pittman\u2019s order denying the injunction.&nbsp;<\/span><\/p>\n<p><span>\u201cFor every conceivable reason that the plaintiffs could lose this appeal,&nbsp;<\/span><span>they should,\u201d he said.&nbsp;<\/span><\/p>\n<p><span>The Fifth Circuit judges ordered the case to go back to Pittman for review. With Pittman\u2019s concerns about irreparable harm assuaged, he will consider remaining preliminary injunction factors and ultimately decide whether unvaccinated employees with exemptions will return to work.<\/span><\/p>\n<p><span>In November, Pittman notably told United Airlines employees that besides their inability to prove irreparable harm, their \u201carguments appear compelling and convincing at this stage.\u201d<\/span><\/p>\n<p>\u201cUnited\u2019s mandate thus reflects an apathy, if not antipathy, for many of its employees\u2019 concerns and a dearth of toleration for those expressing diversity of thought,\u201d he wrote in part.<\/p>\n<p>The case is&nbsp;<em>Sambrano v.
