Why would HHS be funding &#8220;safe smoking kits&#8221; which, even if they don\u2019t contain &#8220;stems,&#8221; do include other paraphernalia that facilitate the use of crack cocaine, meth, heroin, and other drugs?<\/p>\n<p>Such methods are just one example of &#8220;harm reduction,&#8221; an approach to drug policy that has attracted attention in some big, blue cities; the &#8220;<a href=\"https:\/\/www.hhs.gov\/about\/news\/2021\/12\/08\/samhsa-announces-unprecedented-30-million-harm-reduction-grant-funding-opportunity-help-address-nations-substance-use-overdose-epidemic.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/7945d34da455d7c678654265567196fd0fce0b1a?url%3Dhttps%253A%252F%252Fwww.hhs.gov%252Fabout%252Fnews%252F2021%252F12%252F08%252Fsamhsa-announces-unprecedented-30-million-harm-reduction-grant-funding-opportunity-help-address-nations-substance-use-overdose-epidemic.html%26userId%3D6348687%26signature%3D635c4f69fe60b8fa&amp;source=gmail&amp;ust=1645044314496000&amp;usg=AOvVaw1k4SfxovzRL-q930YexF79\">unprecedented<\/a>&#8221; harm-reduction grant program is one of several signs that federal policymakers are similarly interested. Amid&nbsp;<a href=\"https:\/\/www.city-journal.org\/new-book-documents-grim-realities-of-americas-never-ending-drug-crisis\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/f1570fca30cc9b04ea8d8d94dbe8a37be5d6a250?url%3Dhttps%253A%252F%252Fwww.city-journal.org%252Fnew-book-documents-grim-realities-of-americas-never-ending-drug-crisis%26userId%3D6348687%26signature%3D793dd274d1505811&amp;source=gmail&amp;ust=1645044314496000&amp;usg=AOvVaw3B1np5-szJuDrMSvh4nRdI\">a historic wave<\/a> of drug overdose deaths, it\u2019s little surprise that policymakers are considering unorthodox ideas. But while some harm reduction ideas have merit, the label is often a cover for radical proposals backed by the shoddiest evidence, proposals that could do real harm.<\/p>\n<p>In principle, &#8220;harm reduction&#8221; refers to practices that mitigate the harms of drug use without reducing use itself. Such approaches need not be controversial. HHS\u2019s&nbsp;<a href=\"https:\/\/www.samhsa.gov\/sites\/default\/files\/grants\/pdf\/fy22-harm-reduction-nofo.pdf#page=8\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/748047c3f640af0b802385512e6ea090bd29fe53?url%3Dhttps%253A%252F%252Fwww.samhsa.gov%252Fsites%252Fdefault%252Ffiles%252Fgrants%252Fpdf%252Ffy22-harm-reduction-nofo.pdf%2523page%253D8%26userId%3D6348687%26signature%3D988324b2af0f4270&amp;source=gmail&amp;ust=1645044314496000&amp;usg=AOvVaw2Gm1C4Nzgh0vUTvVdXAtG_\">grant outline<\/a>, for example, mentions funding disease-testing kits to help people who use drugs be informed about their HIV or hepatitis C status, and therefore hopefully reduce transmission. In the broader context of drug policy, harm reduction can operate alongside enforcement, treatment, and education to minimize the harms of illegal drugs.<\/p>\n<p>But the term can also include policies pushed by more activist-minded &#8220;harm reductionists&#8221; who are concerned not just with particular policies, but with a wholesale critique of (their understanding of) American drug policy.<\/p>\n<p>These activists&nbsp;<a href=\"https:\/\/drugpolicy.org\/issues\/harm-reduction\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/c02cb53576609ed3317acf390643573dac5bf5d9?url%3Dhttps%253A%252F%252Fdrugpolicy.org%252Fissues%252Fharm-reduction%26userId%3D6348687%26signature%3D50770fc4d1931b63&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw0Xczqe-UEZTDQXAll5zn5t\">tend to view<\/a> the &#8220;drug war&#8221; and drug criminalization as more harmful than drug use. They argue that overdose deaths are driven by an &#8220;unsafe&#8221; supply of drugs, which is itself (they claim) a product of criminalization. Some\u2014<a href=\"https:\/\/www.city-journal.org\/review-of-drug-use-for-grown-ups\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/da4e12dc100c066096387082e310cb634a34e068?url%3Dhttps%253A%252F%252Fwww.city-journal.org%252Freview-of-drug-use-for-grown-ups%26userId%3D6348687%26signature%3D0a07f40c965790cf&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw3OfNA1-_j1z_O-Wug7yFlu\">including<\/a> Columbia University professor Carl Hart\u2014insist that most drug use is <a href=\"https:\/\/filtermag.org\/the-invisible-majority-people-whose-drug-use-is-not-problematic\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/cb0524812d3ef108fd8f6a345349119c7fbd0010?url%3Dhttps%253A%252F%252Ffiltermag.org%252Fthe-invisible-majority-people-whose-drug-use-is-not-problematic%252F%26userId%3D6348687%26signature%3D7a566c777a7a5e38&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw1pHL0GbEk6hDCI427Y9Rgl\">not problematic<\/a>, and that most problematic use is a product of social &#8220;stigma&#8221; rather than the intrinsically dangerous characteristics of drugs.<\/p>\n<p>The distribution of &#8220;safe smoking kits&#8221; including &#8220;glass stems&#8221; is typical of the harm reductionist approach. As the Drug Policy Alliance, a major harm reduction group, describes it, such policies are meant to &#8220;meet people where they are at, and keep people free of diseases and alive so they have a chance of recovery and healing.&#8221; The group claims that distributing safe smoking kits is an &#8220;evidence-based&#8221; practice, rhetoric often deployed by harm reductionists to paint political opponents as &#8220;anti-science.&#8221;<\/p>\n<p>In reality, the evidence on which safe smoking kits are based is paper-thin.<\/p>\n<p>One common argument for crack-pipe distribution is that it reduces hepatitis C and HIV infection among users, by reducing pipe sharing and therefore hypothetical contact between drug users&#8217; cut lips. This was HHS\u2019s stated justification for funding safe smoking kits, for example.<i>&nbsp;<\/i><\/p>\n<p>But the evidence that pipe sharing is actually a disease risk is weak, relying on&nbsp;<a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/10.1111\/j.1478-3231.2008.01688.x\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/7faf474f30a79862fc42eef812eb0ed00663f92c?url%3Dhttps%253A%252F%252Fonlinelibrary.wiley.com%252Fdoi%252F10.1111%252Fj.1478-3231.2008.01688.x%26userId%3D6348687%26signature%3D91933ac63de85493&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw0kuJNIBlPtW5Ikpogn25zC\">surveys of<\/a>&nbsp;<a href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1081\/JA-120028488?journalCode=isum20\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/400948e516574d3f8195f0c2e2c96d2d48f3f941?url%3Dhttps%253A%252F%252Fwww.tandfonline.com%252Fdoi%252Ffull%252F10.1081%252FJA-120028488%26userId%3D6348687%26signature%3D69a5c882605c432f&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw01HRrS6B-aKN3lozfBKghK\">drug users<\/a> that correlate sharing with infection while doing little to account for confounding variables. The measured effects are not huge, though: One year after a safe smoking program <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0955395907000436?via=ihub\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/3f338a873fa5bd24fbb00e421acd980a931652d6?url%3Dhttps%253A%252F%252Fwww.sciencedirect.com%252Fscience%252Farticle%252Fabs%252Fpii%252FS0955395907000436%253Fvia%253Dihub%26userId%3D6348687%26signature%3D6ea5d7917c1505a5&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw39TQ0MmYjAiP09rPxM29wg\">was rolled out<\/a>&nbsp;in Ottawa, 56 percent of users reported injecting at the same rate, while only 29 percent said they had started smoking more. Further, it\u2019s hard to square that evidence with the harm reduction commitment to also distributing syringes, something HHS&nbsp;<a href=\"https:\/\/www.samhsa.gov\/sites\/default\/files\/grants\/pdf\/fy22-harm-reduction-nofo.pdf\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/70cb733fe0626a288c11f5ebe86d81f1c71bb720?url%3Dhttps%253A%252F%252Fsci-hub.se%252Fhttps%253A%252Fwww.sciencedirect.com%252Fscience%252Farticle%252Fabs%252Fpii%252FS0955395907000436%253Fvia%253Dihub%26userId%3D6348687%26signature%3Dd6c706e6721a59ac&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw3l_OFdcZe_0qy9yE9FHXm1\">will also fund<\/a>.<\/p>\n<p>The standard argument against the distribution of drug paraphernalia, and indeed many harm-reduction interventions, is &#8220;moral hazard,&#8221; the idea that if policy reduces the risks of a harmful practice, people will be more likely to engage in that practice. Even if pipe distribution reduces the average user\u2019s risk of infection per use, for example, it might also lead him to smoke more, increasing the total number of infections overall.<\/p>\n<p>Harm reductionists&nbsp;<a href=\"https:\/\/filtermag.org\/drug-policy-reform-movement\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/14d217789086e706d2d35ecdc867f18043742adf?url%3Dhttps%253A%252F%252Ffiltermag.org%252Fdrug-policy-reform-movement%252F%26userId%3D6348687%26signature%3D11196baf0710478b&amp;source=gmail&amp;ust=1645044314497000&amp;usg=AOvVaw1fyb45f2JVaHWobuHW7-Ob\">often dismiss<\/a>&nbsp;&#8220;moral hazard&#8221; as a non-issue, but it can show up in even seemingly benign policies. But the evidence is not there to say that distribution works, either. With drug overdose deaths pushing 100,000 a year, the experiment might be worth it.
