The internship is open only to &#8220;Black, Hispanic, Native American, and\/or LGBTQ+ freshman undergraduate student[s],&#8221; according to Morgan Stanley\u2019s <a href=\"https:\/\/morganstanley.tal.net\/vx\/lang-en-GB\/mobile-0\/brand-2\/user-1448774\/xf-3786f0ce9359\/candidate\/so\/pm\/1\/pl\/1\/opp\/12497-2022-Freshman-Enhancement-Program-New-York\/en-GB\" target=\"_blank\" rel=\"noopener\">website<\/a>. Princeton has allegedly encouraged its students to apply for the program, according to the letter.<\/p>\n<p>&#8220;Morgan Stanley and Princeton are leading institutions in our culture,&#8221; the letter reads. &#8220;What you do matters not only because it affects the individuals involved, but also because you set an influential example for others. Pandering to activists with \u2018diversity, equity, and inclusion\u2019 initiatives like this internship program is actively harming and racializing our already divided country.&#8221;<\/p>\n<p>The program keeps with the uptick in race-based benefits in recent years. Following George Floyd\u2019s death in Minneapolis, gig economy behemoths like Uber and Postmates <a href=\"https:\/\/freebeacon.com\/latest-news\/postmates-uber-offer-promotions-for-black-restaurants-raising-tough-legal-questions\/\" target=\"_blank\" rel=\"noopener\">waived<\/a> delivery fees for black-owned restaurants. And public health agencies have <a href=\"https:\/\/freebeacon.com\/coronavirus\/food-and-drug-administration-drives-racial-rationing-of-covid-drugs\/\" target=\"_blank\" rel=\"noopener\">encouraged<\/a> providers to prioritize certain minority groups when distributing scarce COVID-19 therapeutics.<\/p>\n<p>Morgan Stanley\u2019s program appears to use race and sexual orientation in a wooden fashion. While a holistic review that considered race and sex among numerous other factors might survive a legal challenge, the bank\u2019s website and outside materials that describe the program explicitly state that candidates must be gay, black, Hispanic, or Native American to apply.<\/p>\n<p>Based on Morgan Stanley\u2019s description, it appears that white and Asian applicants who are heterosexual are categorically ineligible for the program. Tuesday\u2019s letter notes that federal law prohibits all forms of race discrimination discrimination in employment and contracting. Morgan Stanley declined to comment.<\/p>\n<p>Lawyers for the Project on Fair Representation said in Tuesday\u2019s letter that the program\u2019s existence indicates a &#8220;broader dysfunction&#8221; at both Morgan Stanley and Princeton. A sound legal review would never authorize discrimination based on race or sexual orientation, they argued.<\/p>\n<p>&#8220;It is difficult to understand how these programs passed internal legal review in light of the clear statutory prohibitions discussed above,&#8221; the letter reads.<\/p>\n<p>The letter is addressed to Eric Grossman, Morgan Stanley\u2019s chief legal officer, and Ramona Romero, general counsel at Princeton.<\/p>\n<p>The Freshman Enhancement Program is billed as a four-week program to help rising sophomores better understand Morgan Stanley\u2019s operations. Interns are placed with one of four divisions\u2014global capital markets, investment banking, wealth management, or sales, trading, and research\u2014for both virtual and in-person training and networking.<\/p>\n<p>A <em>Washington Free Beacon<\/em> review found that elite universities besides Princeton encouraged their students to pursue the program.<\/p>\n<p>Harvard\u2019s office of career services encouraged students to apply to the program. <a href=\"https:\/\/employers.ocs.fas.harvard.edu\/event\/application-deadline-morgan-stanley-freshman-enhancement-program\" target=\"_blank\" rel=\"noopener\">Guidance<\/a> on Harvard\u2019s website notes that the program is only open to gay and minority freshmen. Bates College\u2019s Center for Purposeful Work flagged the program in a seven-page diversity internship <a href=\"https:\/\/www.scribd.com\/document\/559170254\/Bates-Center-for-Purposeful-Work-2018-Diversity-Internship-Handout\" target=\"_blank\" rel=\"noopener\">handout<\/a> that appears to be from the 2018 academic year, and highlighted the identity-based application restrictions.<\/p>\n<p>The University of Michigan\u2019s career center <a href=\"https:\/\/events.umich.edu\/event\/91482\" target=\"_blank\" rel=\"noopener\">promoted<\/a> an information session about the program set for Jan. 31, according to the university\u2019s website. The materials did not mention the selection criteria. Denison University in Ohio also <a href=\"https:\/\/knowltonconnect.denison.edu\/events\/2022\/02\/02\/morgan-stanley-2022-freshman-enhancement-program-new-york\/\" target=\"_blank\" rel=\"noopener\">alerted<\/a> students to the internship.<\/p>\n<p>Tuesday\u2019s letter also notes that institutions that receive federal dollars are subject to federal nondiscrimination laws like Title VI of the Civil Rights Act, which prohibits discrimination based on &#8220;race, color, or national origin in any program or activity that receives federal funds.&#8221;<\/p>\n<p>The Project on Fair Representation\u2019s director is Ed Blum, a Texas-based activist behind a landmark <a href=\"https:\/\/freebeacon.com\/courts\/supreme-court-to-reconsider-affirmative-action-for-college-admissions\/\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> accusing Harvard of discrimination against Asian students. The group\u2019s lawyer is Boyden Gray, the White House counsel to former president George H.W.
