Valieva challenged this action, resulting in RUSADA lifting the provisional suspension on February 9. The International Olympic Committee (IOC), WADA, and International Skating Union (ISU) launched appeals against RUSADA\u2019s decision to lift Valieva\u2019s provisional suspension last week. CAS dismissed all three of these appeals on February 14.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>A CAS panel deliberated from the evening of February 13 to the early morning hours of February 14 to reach a decision on the matter. The panel gave four primary reasons for allowing Valieva to continue competing in the 2022 Winter Olympics, placing emphasis on her status as a \u201cprotected person\u201d under WADA\u2019s code due to her minor age of 15 years.<\/p>\n<p>The World Anti-Doping Code (WADC) <a href=\"https:\/\/www.wada-ama.org\/sites\/default\/files\/resources\/files\/2021_wada_code.pdf\">defines<\/a> a \u201cprotected person\u201d as an athlete \u201cwho at the time of the anti-doping rule violation: (i) has not reached the age of sixteen (16) years; (ii) has not reached the age of eighteen (18) years and is not included in any Registered Testing Pool and has never competed in any International Event in an open category; or (iii) for reasons other than age has been determined to lack legal capacity under applicable national legislation.\u201d<\/p>\n<p>WADA says it \u201ctreats Protected Persons differently than other Athletes or Persons in certain circumstances based on the understanding that, below a certain age or intellectual capacity, an Athlete or other Person may not possess the mental capacity to understand and appreciate the prohibitions against conduct contained in the Code.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>CAS \u201cemphasized\u201d in a press release detailing its February 14 ruling \u201cthere were serious issues of untimely notification of the results of the Athlete\u2019s anti-doping test that was performed in December 2021 which impinged upon the Athlete\u2019s ability to establish certain legal requirements for her benefit.\u201d<\/p>\n<p>\u201c[S]uch late notification was not her [Valieva\u2019s] fault, in the middle of the Olympic Winter Games Beijing 2022,\u201d the panel noted in its ruling.<\/p>\n<p>WADA&nbsp;<a href=\"https:\/\/www.reuters.com\/lifestyle\/sports\/olympics\/valievas-entourage-targeted-by-ioc-valieva-hearing-looms-2022-02-13\/\">told<\/a>&nbsp;Reuters on February 13 it would launch an investigation into Valieva\u2019s \u201centourage\u201d in an effort to determine how the child came to ingest a banned substance. WADA said it would ask its \u201cindependent Intelligence and Investigations Department to probe the coaches, doctors and other adults surrounding the athlete.\u201d<\/p>\n<p>Beijing, China, is currently hosting the 2022 Winter Olympics. The Games began on February 4 and will continue through February 20. Valieva <a href=\"https:\/\/olympics.com\/beijing-2022\/olympic-games\/en\/results\/figure-skating\/athlete-profile-n1057109-kamila-valieva.htm\">competed<\/a> in the Games during the women\u2019s figure skating short program and free skating \u2014 both part of&nbsp;the Russian Olympic Committee (ROC)\u2019s team event \u2014 on February 6 and 7, respectively. The Russian teenager became the first woman to successfully <a href=\"https:\/\/twitter.com\/NBCOlympics\/status\/1490541221735018496?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1490541221735018496%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.si.com%2Folympics%2F2022%2F02%2F07%2Fkamila-valieva-15-years-old-first-woman-quad-figure-skating-olympics-beijing\">execute<\/a> a \u201cquad Salchow,\u201d which involves four complete rotations in the air, on February 7. Valieva\u2019s historic performance <a href=\"https:\/\/www.si.com\/olympics\/2022\/02\/07\/kamila-valieva-15-years-old-first-woman-quad-figure-skating-olympics-beijing\">helped<\/a> the ROC win a gold medal for its figure skating team event.<\/p>\n<p>Monday\u2019s CAS ruling cleared Valieva to compete in additional women\u2019s figure skating events at the 2022 Winter Olympics on February 14 and February 17. She will skate for the individual women\u2019s short program on Monday and end her week with an individual free skate on Thursday.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>\u201cGiven what we saw in her team performances, she is likely to shine with a series of gravity-defying quadruple jumps that are rare in women\u2019s figure skating,\u201d the BBC <a href=\"https:\/\/www.bbc.co.uk\/sport\/winter-olympics\/60371282\">predicted<\/a> of Valieva\u2019s upcoming performances on February 14.<\/p>\n<p>\u201cBut if she wins a medal there are no guarantees that she would not be stripped of it at a later date once the anti-doping process is complete,\u201d the British public broadcaster noted.<\/p>\n<p>The IOC said on February 14 it would \u201cnot be appropriate\u201d to hold a medal ceremony for the ROC figure skating team event. The committee added that if Valieva wins a medal in an individual skating event this week, \u201cno flower or medal ceremonies will take place.\u201d<\/p>\n<p>Many issues surrounding Valieva\u2019s doping case remain unresolved. The CAS on Monday alluded to her team facing further legal \u201cproceedings\u201d in the near future.<\/p>\n<p>\u201cThe proceedings on the merits of the apparent anti-doping rule violation, including the athlete\u2019s right to request the analysis of the [urine] B-sample, will be pursued by RUSADA in due course,\u201d the International Testing Agency (ITA) <a href=\"https:\/\/ita.sport\/news\/beijing-2022-ita-acknowledges-decision-of-cas-to-uphold-rusadas-decision-to-lift-provisional-suspension-of-figure-skaterkamila-valieva\/\">observed<\/a> on February 14, adding that \u201cthe legal process for this case is not finally concluded.\u201d<\/p>\n<p>Russia is currently participating in the 2022 Winter Olympics with limitations according to the terms of a WADA-imposed ban that has prohibited Moscow from international sporting events through December 2022. WADA <a href=\"https:\/\/www.france24.com\/en\/europe\/20201217-russia-to-miss-tokyo-olympics-after-doping-ban-halved\">enforced<\/a> the ban \u2014 which sees Russia compete at the Olympics as the \u201cROC\u201d\u2014 due to a major doping scandal involving thousands of Russian athletes. The ban only prohibits Russians from flying their national flag and playing their national anthem.
