Rakoff asserted that Palin\u2019s legal team had not proven The Times acted with actual malice in its June 14, 2017 editorial, which was corrected the morning after it was published. On the day of the editorial, a gunman had opened fire at a baseball field where GOP congressmen were practicing; Congressman Steve Scalise was seriously wounded and others were injured.<\/p>\n<p>The Times <a href=\"https:\/\/www.nytimes.com\/2022\/02\/14\/business\/sarah-palin-new-york-times.html\">recalled<\/a> on Monday, \u201cThe headline was \u2018America\u2019s Lethal Politics,\u2019 and the editorial asked whether the Virginia shooting was evidence of how vicious American politics had become.\u201d<\/p>\n<p>\u201cThe paper\u2019s editorial cited a \u2018targets\u2019 website created by Ms. Palin for the 2010 midterm elections that featured crosshairs over Democratic House districts, including Ms. Gifford\u2019s. \u2018The link to political incitement was clear,\u2019 states a later-deleted line from the piece,\u201d <a href=\"https:\/\/www.wsj.com\/articles\/sarah-palin-sues-new-york-times-alleging-defamation-in-editorial-1498613308?mod=article_inline\">The Wall Street Journal<\/a> noted when the lawsuit was filed in 2017.<\/p>\n<p>Rakoff stated on Monday, \u201cThis is an example of very unfortunate editorializing on the part of The Times,\u201d but added, \u201cmy job is to apply the law. \u2026 The law sets a very high standard for actual malice, and in this case the court finds that that standard has not been met,\u201d <a href=\"https:\/\/www.washingtonpost.com\/media\/2022\/02\/14\/palin-new-york-times-verdict\/\">The Washington Post<\/a> reported. He noted he would continue to let the jury deliberate to a conclusion, though it would be dismissed and opined that Palin would likely appeal his decision, adding that an appeals court \u201cwould greatly benefit from knowing how the jury would decide\u201d the case.<\/p>\n<p><a href=\"https:\/\/www.wsj.com\/articles\/sarah-palin-v-new-york-times-goes-to-jury-11644616478\">The Wall Street Journal<\/a> noted on Friday:<\/p>\n<blockquote>\n<p><em>Palin lawyer Kenneth Turkel urged a federal jury in Manhattan to hold the Times accountable in a case that he said boiled down to a simple rule: \u201cDon\u2019t say false things.\u201d Mr. Turkel argued the Times and its then-opinion editor had doggedly advanced a narrative that \u201cdemonized the right wing,\u201d part of what he alleged was a pattern at the newspaper.<\/em><\/p>\n<\/blockquote>\n<p>Turkel asserted, \u201cAll they had to do was dislike her a little less and we\u2019re not sitting here today.\u201d<\/p>\n<p>David Axelrod, representing The Times, stated that The Times had made an honest mistake that was fixed quickly, claiming there was no false narrative or political agenda at work.
