Durham\u2019s office made the claim as part of his investigation that had brought charges against Michael Sussmann, a lawyer who had worked on behalf of the Democratic National Committee and Hillary Clinton\u2019s 2016 campaign and who is currently charged with making a false statement to the FBI.<\/p>\n<p>Durham alleged Sussmann \u201chad assembled and conveyed the allegations to the FBI on behalf of at least two specific clients, including a technology executive (Tech Executive 1) at a U.S.-based internet company (Internet Company 1) and the Clinton campaign,\u201d according to a section in the court filing, titled \u201cFactual Background.\u201d<\/p>\n<p>Billing records he obtained suggest that Sussmann \u201crepeatedly billed the Clinton Campaign for his work on the Russian Bank-1 allegations\u201d and that the unnamed technology executive met and [communicated] with Mark Elias, a left-wing lawyer and operative who has filed numerous election-related lawsuits on behalf of the Democrats. Sussman previously pleaded not guilty and accused Durham of acting in a politically motivated manner.<\/p>\n<p>\u201cTech Executive-1 also enlisted the assistance of researchers at a U.S.-based university who were receiving and analyzing large amounts of Internet data in connection with a pending federal government cybersecurity research contract,\u201d Durham\u2019s filing states.<\/p>\n<p>The executive also \u201ctasked these researchers to mine Internet data to establish \u2018an inference\u2019 and \u2018narrative\u2019 tying then-candidate Trump to Russia,\u201d the filing states, adding that the technology firm that the executive worked for\u00a0\u201chad come to access and maintain dedicated servers\u201d for Trump\u2019s executive office.<\/p>\n<p>\u201cTech Executive-1 and his associates exploited this arrangement by mining the EOP\u2019s DNS traffic and other data for the purpose of gathering derogatory information about Donald Trump,\u201d Durham\u2019s filing reads. EOP refers to Trump\u2019s office, while\u00a0DNS traffic refers to traffic coming in and out of a server.<\/p>\n<figure id=\"attachment_4003026\" class=\"wp-caption alignnone\"><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4003026\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2021\/09\/17\/Michael-Sussmann-600x338.jpg\" alt=\"Michael Sussman\" width=\"600\" height=\"338\" \/><\/noscript><\/figcaption>&nbsp;<\/p>\n<p>Michael Sussmann in an undated interview. (CNN\/Screenshot via NTD)<\/figure>\n<p>Durham further wrote that\u00a0Sussmann \u201cprovided an updated set of allegations\u2014including the Russian Bank-1 data and additional allegations relating to Trump\u201d to another federal agency that isn\u2019t the FBI. Claims that Sussmann provided in a meeting in February 2017 relied on\u00a0\u201cthe purported DNS traffic that Tech Executive-1 and others had assembled pertaining to Trump Tower, Donald Trump\u2019s New York City apartment building, the EOP, and the aforementioned health care provider,\u201d according to Durham.<\/p>\n<p>Sussmann, his court filing added, \u201cprovided data which he claimed reflected purportedly suspicious DNS lookups by these entities of internet protocol addresses affiliated with a Russian mobile phone provider\u201d in the February 2017 meetings. Sussmann also said such DNS\u00a0lookups \u201cdemonstrated that Trump and\/or his associates were using supposedly rare, Russian-made wireless phones in the vicinity of the White House and other locations,\u201d which Durham described as false.<\/p>\n<p>\u201cThe Special Counsel\u2019s Office has identified no support for these allegations,\u201d Durham wrote. \u201cIndeed, more complete DNS data that the Special Counsel\u2019s Office obtained from a company that assisted Tech Executive-1 in assembling these allegations reflects that such DNS lookups were far from rare in the United States.\u201d<\/p>\n<p>After Durham\u2019s court filing was unsealed, Trump on Feb. 12\u00a0<a href=\"https:\/\/twitter.com\/realLizUSA\/status\/1492646490346598404\">issued a statement<\/a> claiming it provided \u201cindisputable evidence\u201d his campaign and office were being spied on by Democrats in a bid to connect him to the Russian government.
