Lindsey Graham and Democratic Connecticut Sen. Richard Blumenthal, would make liability protections under Section 230 of the Communications Decency Act contingent on companies adequately following \u201cbest practices\u201d for online platforms regarding the prevention of online child exploitation conduct. These practices would be determined by a National Commission on Online Child Sexual Exploitation Prevention, which would also be established by the bill.<\/p>\n<p>The bill was approved with a voice vote, and it will now head to the Senate floor.<strong> <a href=\"https:\/\/dailycaller.com\/2021\/10\/07\/amazon-web-services-onlyfans-lance-gooden-anne-wagner\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: EXCLUSIVE: House Republicans Call On Amazon To End Relationship With OnlyFans Over Child Pornography)<\/a><\/strong><\/p>\n<div id=\"attachment_7273848\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7273848\" class=\"wp-caption-text\">Sen. (Photo by Drew Angerer\/Getty Images)<\/p>\n<\/div>\n<p>Critics have argued the bill would encourage companies to aggressively moderate content and weaken encryption by exposing companies to civil lawsuits and state-level criminal charges for child exploitation content. A coalition of privacy advocates, tech groups, and civil rights organizations sent a <a href=\"https:\/\/cdt.org\/wp-content\/uploads\/2022\/02\/Human-rights-coalition-opposition-letter-to-EARN-IT-Act-S3538.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">letter<\/a> to Senate lawmakers opposing the bill and warning the legislation would \u201cthreaten free expression\u201d and \u201cjeopardize security.\u201d<\/p>\n<p>\u201cBut by opening the door to sweeping liability under state laws, the EARN IT Act would strongly disincentivize providers from providing strong encryption,\u201d the letter read. \u201cSection 5(7)(A) of EARN IT states that provision of encrypted services shall not \u2018serve as an independent basis for liability of a provider; under the expanded set of state criminal and civil laws for which providers would face liability under EARN IT.\u201d<\/p>\n<p>While lawmakers have acknowledged potential privacy concerns posed by the bill, they questioned tech companies\u2019 motivations in opposing legislation regulating online platforms.<\/p>\n<p>\u201cEvery time you turn around, the tech companies have a reason not to do everything. That\u2019s wearing thin,\u201d Graham <a href=\"https:\/\/www.politico.com\/newsletters\/morning-tech\/2022\/02\/10\/earn-it-earns-a-markup-00007632\" target=\"_blank\" rel=\"noopener noreferrer\">told<\/a> Politico.<\/p>\n<p>\u201cWe are a nation that needs to do so much more,\u201d Democratic New Jersey Sen.
