The Governor and I are pleased with today\u2019s ruling. At the beginning of this pandemic, Governor Northam used his broad emergency powers to close places of worship, private businesses, and schools and impose a statewide mask mandate,\u201d Miyares <a href=\"https:\/\/www.oag.state.va.us\/media-center\/news-releases\/2303-supreme-court-of-virginia-dismisses-castillo-v-youngkin-2\" target=\"_blank\" rel=\"noopener\">wrote<\/a>.<\/p>\n<p>\u201cNearly two years later, we have better risk mitigation strategies and vaccines, and we know much more about the efficacy of requiring children to wear masks all day. We agree with the Court\u2019s decision and will continue to defend the Executive Order. Youngkin\u2019s Executive Order Two and Order of Public Health Emergency One (collectively, \u2018EO 2\u2019) that permit parents to exempt their children from school masking requirements,\u201d according to the <a href=\"https:\/\/www.oag.state.va.us\/files\/MIYARES2022\/ORD02-07-2022Castillo,M.pdf\" target=\"_blank\" rel=\"noopener\">order<\/a>.<\/p>\n<p>The state\u2019s Supreme Court justices wrote \u201cwe deny petitioners\u2019 motion to amend, and we dismiss the petition because the relief requested does not lie against any of the respondents.\u201d<\/p>\n<p>The ruling follows Youngkin\u2019s decision last week to join a parent lawsuit against Loudoun County schools over masks. As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/virginia-governor-joins-parents-lawsuit-against-loudoun-schools-over-masks\" target=\"_blank\" rel=\"noopener\">reported<\/a>:<\/p>\n<blockquote>\n<p><em>Virginia\u2019s governor, attorney general, and superintendent of public instruction have asked a court to let them become plaintiffs in a <a href=\"https:\/\/www.oag.state.va.us\/files\/2022\/As-Filed-Papers-in-Barnett-v-LCSB.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> brought by parents against the Loudoun County Public Schools (LCPS), lending new legal firepower to a group of parents\u2019 quest to unmask their children.<\/em><\/p>\n<p><em>After taking office last month, Gov. Glenn Youngkin issued an executive order saying that parents had the right to choose whether their children must wear masks at school or not. Nearly two years later, Governor Youngkin is using those same emergency powers to adapt to our current phase in the same pandemic, by giving parents the ability to opt out of a school mask mandate,\u201d he <a href=\"https:\/\/www.oag.state.va.us\/media-center\/news-releases\/2298-february-2-2022-attorney-general-miyares-sides-with-loudoun-parents-in-recent-lawsuit\" target=\"_blank\" rel=\"noopener\">wrote<\/a>.<\/p>\n<p>In addition to K-12th grade schools, <a href=\"https:\/\/www.dailywire.com\/news\/three-virginia-universities-end-vaccine-mandate-after-ags-legal-opinion\" target=\"_blank\" rel=\"noopener\">three large Virginia universities<\/a> have recently ended their COVID-19 vaccine mandate following a new legal opinion by Miyares.<\/p>\n<p>Miyares released the&nbsp;<a href=\"https:\/\/www.oag.state.va.us\/files\/Opinions\/2022\/22-004-Youngkin-issued.pdf\" target=\"_blank\" rel=\"noopener\">opinion<\/a>&nbsp;on January 26 that stated Virginia university campuses cannot require the mandate unless it is listed among required immunizations for higher education institutions.<\/p>\n<p><span>The attorney general wrote that \u201cas recognized in the prior opinion, \u2018[t]here is no question that the General Assembly could enact a statute requiring the COVID-19 vaccine for in-person school attendance,\u2019\u201d according to a <\/span><a href=\"https:\/\/www.oag.state.va.us\/media-center\/news-releases\/2295-january-28-2022-attorney-general-miyares-issues-legal-opinion-that-public-universities-cannot-mandate-covid-19-vaccine-for-students\"><span>statement<\/span><\/a><span> from Miyares\u2019 office.<\/span><\/p>\n<p>\u201cAs of this writing, it has not done so.
