A lower state court&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.politico.com\/news\/2022\/01\/28\/pennsylvania-court-strikes-mail-voting-law-00003179\" target=\"_blank\" rel=\"noopener\">determined<\/a>&nbsp;its mail-in voting law was unconstitutional in Pennsylvania. In Wisconsin, a state trial court held that it was illegal to use drop boxes for returning absentee ballots.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Republicans challenged voting laws in each state judiciary because their Democrat governors are unlikely to sign off on any changes to current voting laws. \u201cThis is the only way it could play out, because [Gov. Tom Wolf] would never\u201d repeal mail voting,&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/05\/report-china-keeping-winter-olympians-in-unreasonable-quarantine-conditions\/\" target=\"_blank\" rel=\"noopener\">said<\/a>&nbsp;Adam Bonin, a Pennsylvania election attorney.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Pennsylvania\u2019s Act 77, passed in 2019, allowed statewide no-excuse mail balloting. Conservative attorneys in Pennsylvania&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/05\/report-china-keeping-winter-olympians-in-unreasonable-quarantine-conditions\/\" target=\"_blank\" rel=\"noopener\">argued<\/a>&nbsp;that \u201cprovisions in the state constitution require people to vote in person except under a very specific set of enumerated circumstances.\u201d<\/p>\n<p>Pennsylvania Governor Tom Wolf (D) and Attorney General Josh Shapiro (D) appealed the lower court ruling that determined the law was unconstitutional. Former President Donald Trump cheered the lower court\u2019s ruling,&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/05\/report-china-keeping-winter-olympians-in-unreasonable-quarantine-conditions\/\" target=\"_blank\" rel=\"noopener\">asking<\/a>, \u201cIf widespread mail-in balloting is unconstitutional in Pennsylvania now, how could mail-in balloting have been constitutional in the RIGGED 2020 Presidential Election then?\u201d<\/p>\n<p>However, Pennsylvania\u2019s Supreme Court has a 5-2 liberal majority, so the court\u2019s chances to uphold the lower court\u2019s ruling are slim. \u201cWe\u2019re simply saying that the Pennsylvania Constitution requires in-person voting except under limited, specified circumstances,\u201d&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/05\/report-china-keeping-winter-olympians-in-unreasonable-quarantine-conditions\/\" target=\"_blank\" rel=\"noopener\">said<\/a>&nbsp;Greg Teufel, an attorney for the Republican lawmakers challenging Act 77.<\/p>\n<p>If Pennsylvania\u2019s majority liberal supreme court rules against the conservatives, they are willing to take the case to the United States Supreme Court. \u201cWe are anticipating \u2014 if we do lose \u2014 that we would request the [U.S.] Supreme Court to hear the case. That\u2019ll be their discretion whether to accept this case or not, but we\u2019re hopeful,\u201d Republican state Rep. Timothy Bonner told&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.politico.com\/news\/2022\/02\/05\/mail-voting-on-trial-battleground-states-0000579\" target=\"_blank\" rel=\"noopener\"><em>Politico<\/em><\/a>.<\/p>\n<p>In Wisconsin, conservatives successfully challenged the state\u2019s absentee dropbox law. A state trial court ordered drop boxes banned ahead of February\u2019s local primary, but a state appeals court stayed the order. Wisconsin\u2019s supreme court&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.usnews.com\/news\/best-states\/wisconsin\/articles\/2022-01-28\/wisconsin-election-officials-deadlock-on-drop-box-rules\" target=\"_blank\" rel=\"noopener\">agreed<\/a>&nbsp;to hear the case and keep the appeal court\u2019s stay in place while the case is pending.<\/p>\n<p>Conservatives might have more chance in Wisconsin\u2019s highest court, as its makeup is different from Pennsylvania\u2019s. Wisconsin\u2019s supreme court is evenly split with three conservatives and three liberals, one moderate swing justice. The Wisconsin elections commission&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.jsonline.com\/story\/news\/politics\/elections\/2022\/01\/28\/wisconsin-election-officials-keep-ballot-drop-box-policies-place\/9255681002\/\" target=\"_blank\" rel=\"noopener\">failed<\/a>&nbsp;to repeal their dropbox guidelines, so voters may use them until the state supreme court decides its fate.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Courts in Wisconsin and Pennsylvania will hear cases involving voting laws the states implemented ahead of the 2020 presidential election.
