The biggest of these whoppers, however, was Biden\u2019s claim that Americans couldn\u2019t buy a gun at the time the Second Amendment was drafted.<\/p>\n<p>During his speech, Biden said:<\/p>\n<blockquote>\n<p><em>This doesn\u2019t doesn\u2019t violate anybody\u2019s Second Amendment right\u2026You couldn\u2019t buy a cannon when this amendment was passed. There\u2019s no reason why you shouldn\u2019t be able to buy certain assault weapons.<\/em><\/p>\n<\/blockquote>\n<p>This isn\u2019t the first time Biden has made this false claim. In June 2021, he made a similar statement, saying \u201cThe Second Amendment, from the day it was passed, limited the type of people who could own a gun and what type of weapon you could own. You couldn\u2019t buy a cannon.\u201d<\/p>\n<p>Back then, The Washington Post\u2019s fact checker <a href=\"https:\/\/www.washingtonpost.com\/politics\/2021\/06\/28\/bidens-false-claim-that-2nd-amendment-bans-cannon-ownership\/\">gave<\/a> Biden\u2019s statement four pinocchios, the most a statement can receive. Biden has apparently changed his claim over the years, but has never gotten it right. In 2020, he people \u201cweren\u2019t allowed to own a cannon during the Revolutionary War as an individual,\u201d which also isn\u2019t true. At the time he made the claim, historians <a href=\"https:\/\/www.politifact.com\/factchecks\/2020\/jun\/29\/joe-biden\/joe-bidens-dubious-claim-about-revolutionary-war-c\/\">told<\/a> PolitiFact that no evidence existed to support Biden\u2019s claim, and Biden\u2019s campaign couldn\u2019t provide any.<\/p>\n<p>One year later, Biden changed his claim to 20 years after the Revolutionary War, but that also is incorrect. As the Post explained:<\/p>\n<blockquote>\n<p><em>In fact, you do not have to look far in the Constitution to see that private individuals could own cannons.&nbsp;<a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artI-S8-C11-1\/ALDE_00001072\/\">Article 1, Section 8, Clause 11<\/a>&nbsp;gives Congress the power to declare war. But there is another element of that clause that might seem strange to modern ears \u2014 Congress also had the power to \u201cgrant Letters of Marque and Reprisal.\u201d<\/em><\/p>\n<p><em>What\u2019s that? These were&nbsp;<a href=\"https:\/\/law.jrank.org\/pages\/8441\/Marque-Reprisal.html\">special waivers<\/a>&nbsp;that allowed private individuals to act as pirates on behalf of the United States against countries engaged in war with it. The \u201cletter of marque\u201d allowed a warship to cross into another country\u2019s territory to take a ship, while a \u201cletter of reprisal\u201d gave authorization to bring the ship back to the home port of the capturer.<\/em><\/p>\n<p><em>Individuals who were given these waivers and owned warships obviously also obtained cannons for use in battle.<\/em><\/p>\n<\/blockquote>\n<p>Flash forward another year \u2013 to last week \u2013 and Biden is still making this claim that has been debunked multiple times.<\/p>\n<p>National Review\u2019s David Harsanyi explained that Americans \u201cabsolutely could buy a cannon.\u201d<\/p>\n<p>\u201cThere is&nbsp;<a href=\"https:\/\/www.amazon.com\/First-Freedom-Through-Americas-Enduring\/dp\/1501174002\">zero historical evidence<\/a>&nbsp;that Americans were barred from purchasing or constructing any type of weapon they pleased. Not only are there numerous accounts of the American military using, or purchasing, private cannons;&nbsp;<a href=\"https:\/\/www.battlefields.org\/learn\/articles\/militia-sea\">privateers<\/a>&nbsp;\u2014 as the name strongly suggests \u2014 relied on their own cannons, as well. (For their expedition, Lewis and Clark bought a privately owned small-bore cannon and Girardoni air rifle, which could shoot 30 or more times without reloading,)\u201d Harsanyi continued.<\/p>\n<p>Charles C. W. Cooke, also with National Review, added some information about purchasing a cannon today.<\/p>\n<p>\u201cIf the cannon you want to buy was manufactured&nbsp;<a href=\"https:\/\/www.atf.gov\/firearms\/qa\/are-muzzleloading-cannons-considered-destructive-devices\">before 1898<\/a>&nbsp;(i.e., it\u2019s a muzzle loading model), you can do so without regulation. If it\u2019s a \u201csaluting cannon,\u201d it\u2019s also&nbsp;<a href=\"https:\/\/www.thecannonstore.com\/customer-service\">exempt<\/a>. And if it\u2019s neither a \u201csaluting cannon\u201d nor a pre-1898 model, you need to pay a $200 tax stamp, fill in some forms, wait a bit, and . . . well, that\u2019s it. Cannon are&nbsp;<a href=\"https:\/\/www.atf.gov\/firearms\/firearms-guides-importation-verification-firearms-national-firearms-act-definitions-1\">categorized as<\/a>&nbsp;\u201cdestructive devices\u201d under the 1934 National Firearms Act, and they\u2019re legal&nbsp;<a href=\"https:\/\/www.oregonlive.com\/pacific-northwest-news\/2015\/10\/want_to_buy_a_cannon_fill_out.html\">under federal law<\/a>&nbsp;and in most states.
