Democratic officials immediately challenged the map in the Wake County Circuit Court, where Republicans initially <a href=\"https:\/\/dailycaller.com\/2022\/01\/11\/republican-north-carolina-congressional-map-court-ruling\/\">won<\/a>. The plaintiffs were <a href=\"https:\/\/twitter.com\/marceelias\/status\/1489742036953616384?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Etweet\">represented<\/a> by the Elias Law Group, an elections litigation firm founded by prominent Democratic attorney Marc Elias.<\/p>\n<p>\u201cThe General Assembly diminished and diluted the voting power of voters affiliated with one party on the basis of party affiliation,\u201d the court <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2021\/11\/413PA21.pdf\">ruled<\/a> Friday. \u201cAchieving partisan advantage incommensurate with a political party\u2019s level of statewide voter support is neither a compelling nor a legitimate government interest.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">And there it is: the NC Supreme Court, in a 4-3 ruling along party lines, strikes down the GOP congressional map that might have led to an 11R-3D split, orders NC\u2019s General Assembly to submit new maps by Feb. 18th. <a href=\"https:\/\/t.co\/aYO2e88Jny\">https:\/\/t.co\/aYO2e88Jny<\/a> <a href=\"https:\/\/t.co\/8fG3aAqgmx\">pic.twitter.com\/8fG3aAqgmx<\/a><\/p>\n<p>\u2014 Dave Wasserman (@Redistrict) <a href=\"https:\/\/twitter.com\/Redistrict\/status\/1489743677278900228?ref_src=twsrc%5Etfw\">February 4, 2022<\/a><\/p>\n<\/blockquote>\n<p>Democratic Rep. GK Butterfield previously cited the gerrymandered map as the reason for his <a href=\"https:\/\/dailycaller.com\/2021\/11\/18\/gk-butterfield-blames-gerrymandering-retirement-north-carolina\/\">retirement<\/a>, describing it as \u201cracially gerrymandered.\u201d<\/p>\n<p>The state legislature will have until Feb. 18 to submit new maps to a lower court, where they must be approved. The new maps must take into account \u201cpartisan fairness,\u201d while using metrics such as a mean-median difference analysis and an efficiency gap analysis to determine whether or not the maps are fair.<\/p>\n<p>Due to this part of the ruling, Democrats could gain seats, despite Republican control of the legislature. Former President Donald Trump won North Carolina 50%-48% in 2020, but the state\u2019s current congressional <a href=\"https:\/\/ballotpedia.org\/United_States_congressional_delegations_from_North_Carolina\">delegation<\/a> favors the GOP 8-5. North Carolina received one additional seat following the 2020 census. <a href=\"https:\/\/dailycaller.com\/2021\/04\/26\/census-congressional-seats-california-new-york-rust-belt-lose-texas-florida-gain\/\"><strong>(RELATED: Census Bureau Announces States In The South, Northwest Pick Up Congressional Seats)<\/strong><\/a><\/p>\n<p>The state Supreme Court\u2019s decision marks the second time in less than three years that a map drawn by the North Carolina legislature was ruled unconstitutional.
