Glenn Youngkin filed a motion Wednesday to join a lawsuit against a school district for defying his executive order that overturned mask mandates.<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2022\/01\/16\/glenn-younkin-signs-11-executive-orders-on-day-one\/\" target=\"_blank\" rel=\"noopener noreferrer\">Youngkin<\/a>, along with Attorney General Jason Miyares and Superintendent of Public Instruction Jillian Balow, filed the <a href=\"https:\/\/www.oag.state.va.us\/files\/2022\/As-Filed-Papers-in-Barnett-v-LCSB.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">complaint<\/a>, motion for a temporary injunction and motion for a temporary restraining order on behalf of three parents <a href=\"https:\/\/amp.dailycaller.com\/2022\/02\/02\/parents-sue-virginia-loudoun-county-school-mask-mandate\" target=\"_blank\" rel=\"noopener noreferrer\">filing suit<\/a> against the Loudoun County School Board (LSCB). The plaintiffs alleged that the LCSB defied the governor\u2019s <a href=\"https:\/\/www.governor.virginia.gov\/media\/governorvirginiagov\/governor-of-virginia\/pdf\/74---eo\/74---eo\/EO-2---School-Mask-Mandate-Executive-Order-Exception.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">executive order<\/a>&nbsp;allowing parents to opt their children out of wearing a mask in the classroom.<\/p>\n<p>Despite the governor\u2019s order issued in January, several of the board\u2019s schools sent letters to parents Jan. 28 threatening suspension if students refuse to comply with their mask mandate, the motion alleged.<\/p>\n<p>The motion claimed the LCSB \u201cdirectly interfered\u201d with the rights of <a href=\"https:\/\/dailycaller.com\/2021\/12\/13\/loudoun-county-virginia-parents-operation-shoe-drop-school-board-citizens-for-freedom\/\" target=\"_blank\" rel=\"noopener noreferrer\">parents<\/a> to decide on whether their child enters school with a face covering and denied the plaintiffs\u2019 children the right to pursue in-person learning. It also alleged the district violated <a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?ses=212&amp;typ=bil&amp;val=sb1303\" target=\"_blank\" rel=\"noopener noreferrer\">S.B. 1303<\/a>, which requires all Virginia school boards to require in-person instruction.<\/p>\n<p>\u201cThe School Board has \u2018directly interfered with the rights of each parent here \u2026 to make educational decisions for their children,\u2019 who would \u2018attend their respective Loudoun County Public School mask-free if it were not for the [School Board\u2019s] Mandate,&#8217;\u201d the motion alleged. \u201cEach of the Plaintiff Parents children has been refused an in-person education after arriving at school without a mask, in accordance with their parents\u2019 wishes and in reliance on EO.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">.<a href=\"https:\/\/twitter.com\/GovernorVA?ref_src=twsrc%5Etfw\">@GovernorVA<\/a> and I are joining Loudoun County parents in their lawsuit against the School Board for ignoring Executive Order Two &amp; denying an \u201copt out\u201d option for parents. <a href=\"https:\/\/t.co\/D7tG3qmYgD\">https:\/\/t.co\/D7tG3qmYgD<\/a><\/p>\n<p>\u2014 Jason Miyares (@JasonMiyaresVA) <a href=\"https:\/\/twitter.com\/JasonMiyaresVA\/status\/1489010711116320769?ref_src=twsrc%5Etfw\">February 2, 2022<\/a><\/p>\n<\/blockquote>\n<p>The document said the plaintiff\u2019s have also witnessed \u201cadverse physical and mental health effects\u201d in their children due to long-term mask wearing. <strong><a href=\"https:\/\/dailycaller.com\/2022\/01\/17\/virginia-school-districts-youngkin-mask-mandates\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Northern Virginia School Districts Go To War With Youngkin Over Repeal Of Mask Mandates)<\/a><\/strong><\/p>\n<p>It argued that the governor has both a \u201cstatutory right and duty\u201d to protect Virginia parents\u2019 rights to make choices about their children within the educational system. Youngkin\u2019s executive order was a \u201cnecessary measure\u201d in ensuring the \u201chealth and safety\u201d of students, it also argued.<\/p>\n<p>\u201cThe Governor has concluded that EO 2 is a necessary measure to protect public health, safety, and welfare during the COVID-19 emergency, in particular the the health and safety of children,\u201d the motion said. \u201cHe brings this suit to protect the health and safety of all Virginians. He also brings this suit to protect the fundamental right of every Virginia child to an education and the fundamental right \u2018of parents and guardians to direct the upbringing and education of [their] children.\u201d\u2018<\/p>\n<p>After the executive order went into effect Jan. 24, the motion said the LCSB voted to continue enforcing a mask mandate. Stone Bridge High School, a school in Loudoun County,&nbsp;<a href=\"https:\/\/dailycaller.com\/2022\/02\/02\/maskless-students-suspended-for-minimum-of-10-days-could-face-trespassing-charges\/\" target=\"_blank\" rel=\"noopener noreferrer\">suspended<\/a> an 11th grader for 10 days for failing to comply with the mask mandate, according to documentation obtained by the Daily Caller.<\/p>\n<p>Seven Virginia <a href=\"https:\/\/dailycaller.com\/2022\/01\/24\/glenn-youngkin-virginia-school-board-lawsuit-mask-mandate\/\" target=\"_blank\" rel=\"noopener noreferrer\">school districts<\/a> sued over Youngkin\u2019s executive order, arguing in a Jan. 24 joint statement that it is unconstitutional and opens a safety hazard for students.
