Mark Pody (R) and state Rep. Jerry Sexton (R). It \u201cpermits a person to petition a court for an injunction to prohibit a woman who is pregnant with the person\u2019s unborn child from obtaining an abortion.\u201d<\/p>\n<p>An \u201cinjunction\u201d is <a href=\"https:\/\/www.law.cornell.edu\/wex\/injunction\">defined<\/a> as \u201ca court order requiring a person to do or cease doing a specific action.\u201d<\/p>\n<p>The details of the bill include a specific timeline that must be followed. Within fourteen days of a petition being filed, there will be a court hearing in which the two sides can \u201cpresent evidence.\u201d<\/p>\n<p>In order to request the injunction, there must be \u201creasonable probability\u201d that the woman will seek an abortion. The man must be the biological father of the unborn child. He must also execute \u201ca voluntary acknowledgement of paternity\u2026 that is not subject to being rescinded\u201d if the two are not married. He does not have to provide DNA evidence. The \u201cproof of parenthood,\u201d as reported by <a href=\"https:\/\/www.huffpost.com\/entry\/tennessee-lawmakers-introduce-bill-allow-fathers-veto-abortions_n_6025ae58c5b6f88289fa797a\">HuffPost<\/a>, \u201crequires only that the petitioner acknowledges paternity.\u201d<\/p>\n<p>If the woman has an abortion in violation of the injunction served to her, the legislation states that the court may hold her \u201cin civil or criminal contempt and punish [her] in accordance with the law.\u201d<\/p>\n<p>The bill does not include language in which there are exceptions for incest or rape.<\/p>\n<p><a href=\"https:\/\/www.huffpost.com\/entry\/tennessee-lawmakers-introduce-bill-allow-fathers-veto-abortions_n_6025ae58c5b6f88289fa797a\">HuffPost<\/a> notes that the measure will most likely be found unconstitutional if it becomes law. The media outlet cites the 1992 Planned Parenthood v. Casey decision, wherein the Supreme Court ruled that it was not constitutional to require a woman to tell her husband before seeking an abortion.<\/p>\n<p>In 2014, the Missouri legislature attempted to pass a bill involving fathers, as well. It was introduced by state Rep. Rick Brattin and \u201cwould further require women to receive the written and notarized consent of a fetus\u2019 father before obtaining an abortion,\u201d according to an article published by <a href=\"https:\/\/www.theguardian.com\/us-news\/2014\/dec\/22\/planned-parenthood-missouri-abortion-permission-father\">The Guardian<\/a> at the time. Unlike the Tennessee bill, the Missouri one included exceptions for \u201clegitimate rape\u201d and incest.<\/p>\n<p><a href=\"https:\/\/fox17.com\/news\/local\/new-bill-tn-mothers-seeking-abortion-could-face-injunction-if-fathers-file-petition\">Fox 17 News Nashville<\/a> spoke with Pody on Friday about Tennessee\u2019s recent measure:<\/p>\n<blockquote>\n<p><em>\u2018If he can prove to the courts that he is the father, the biological father, then he has rights to what\u2019s going on with his son or daughter,\u2019 Senator Pody said.<\/em><\/p>\n<p><em>Pody says the mother would be able to provide her own argument as to why she should go through with the abortion, and medical issues would be taken into consideration.<\/em><\/p>\n<\/blockquote>\n<p>Francie Hunt, Executive Director of Tennessee Advocates for Planned Parenthood, responded to the legislation in a statement:<\/p>\n<blockquote>\n<p><em>A pregnant person must have the ultimate control over their body and their pregnancy. This is an unconstitutional, insulting, and dangerous bill. Nobody should have the power to make health care decisions for someone else \u2014 not a judge, a partner, and certainly not a rapist regardless of paternity. Tennessee politicians\u2019 priorities couldn\u2019t be more out of step with the dire needs of their constituents as they suffer from the consequences of Gov. Lee\u2019s botched response to the pandemic. The legislature needs to stop trying to distract the public from their leadership failures with increasingly stigmatizing abortion restrictions.<\/em><\/p>\n<\/blockquote>\n<p>This is not the first time that Tennessee has been the focus of the abortion debate. Just last year, Republican Gov. Bill Lee signed the controversial heartbeat bill into law, which banned abortions after a fetal heartbeat can be detected <span><em>\u2014<\/em><\/span> usually at about six weeks of pregnancy.
