County District Attorney George Gasc\u00f3n this week, temporarily blocking several of his reforms to preserve the status quo pending final resolution upon a trial.<\/p>\n<p>The Los Angeles Times <a href=\"https:\/\/www.latimes.com\/california\/story\/2021-02-08\/several-of-d-a-george-gascons-reforms-blocked-by-l-a-county-judge\">reported<\/a>, \u201cGasc\u00f3n was barred from implementing a significant part of his sprawling criminal justice reform platform Monday, after a judge ruled his plan to end the use of sentencing enhancements in thousands of criminal cases violates California law.\u201d<\/p>\n<p>According to the outlet, \u201cthe order stemmed from a lawsuit filed late last year by the union that represents hundreds of L.A. County prosecutors, alleging some of Gasc\u00f3n\u2019s plans exceeded his legal authority and put line prosecutors in an ethical bind.\u201d<\/p>\n<p>Gasc\u00f3n said his legal team would appeal the court\u2019s <a href=\"https:\/\/witnessla.com\/wp-content\/uploads\/2021\/02\/20STCP04250-Gascon-prelim-inj.pdf\">decision<\/a>, adding his office \u201cwill adjust its policies to be consistent with this ruling.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: A judge in Los Angeles has dealt a significant blow to DA <a href=\"https:\/\/twitter.com\/GeorgeGascon?ref_src=twsrc%5Etfw\">@GeorgeGascon<\/a>&#8216;s reform agenda, partially barring him keeping his prosectors from seeking longer prison terms for defendants. The judge granted a preliminary injunction sought by the <a href=\"https:\/\/twitter.com\/LACountyADDA?ref_src=twsrc%5Etfw\">@LACountyADDA<\/a> <a href=\"https:\/\/twitter.com\/LAist?ref_src=twsrc%5Etfw\">@LAist<\/a> <a href=\"https:\/\/twitter.com\/KPCC?ref_src=twsrc%5Etfw\">@KPCC<\/a><\/p>\n<p>\u2014 Frank Stoltze (@StoltzeFrankly) <a href=\"https:\/\/twitter.com\/StoltzeFrankly\/status\/1358853822739746816?ref_src=twsrc%5Etfw\">February 8, 2021<\/a><\/p>\n<\/blockquote>\n<p>\u201cI never had any illusions as to the difficulty and challenges associated with reforming a dated institution steeped in systemic racism,\u201d Gasc\u00f3n said in a statement. \u201cMy directives are a product of the will of the people, including survivors of crime, and a substantial body of research that shows this modern approach will advance community safety.\u201d<\/p>\n<p>The Association of Deputy District Attorneys for Los Angeles County (ADDA) had asked for a writ of mandate from the court to compel D.A. Gasc\u00f3n to rescind several of his new policies, declaring them \u201cinvalid and illegal.\u201d<\/p>\n<p>David Carroll, an attorney representing the ADDA, <a href=\"https:\/\/www.dailybreeze.com\/2021\/02\/08\/judge-issues-injunction-that-blocks-some-of-l-a-district-attorney-george-gascons-policies\/?utm_campaign=socialflow&amp;utm_medium=social&amp;utm_source=twitter.com&amp;utm_content=tw-DailyBreezeNews\">told<\/a> the Long Beach Press-Telegram that the lawsuit \u201chas never been about whether sentencing enhancements are good or bad policy\u2026but about whether a district attorney can force prosecutors to violate clear California law in order to carry out his desired policy changes.\u201d<\/p>\n<p>Gasc\u00f3n had issued a set of special directives shortly after taking the oath of office in December, including one that banned prosecutors from using prior offenses, known as \u201cstrikes,\u201d in sentencing enhancements that act as extra punishments, added on to the charge of an underlying crime. The union argued that policy violated the state\u2019s Three Strikes Law, approved by voters in 1994, which the ADDA says mandates lengthening sentences of previously convicted felons.<\/p>\n<p>\u201cThe Special Directives violate the Three Strikes law by prohibiting prosecutors from pleading and proving prior convictions in new cases,\u201d <a href=\"https:\/\/www.lamag.com\/citythinkblog\/judge-gascon-sentencing-enhancement\/?utm_content=bufferdfbb5&amp;utm_medium=social&amp;utm_source=twitter.com&amp;utm_campaign=buffer\">wrote<\/a> L.A. County Superior Court Judge James Chalfant. \u201cProsecutors have a ministerial duty to allege all prior convictions under the Three Strikes law.\u201d<\/p>\n<p><a href=\"https:\/\/www.latimes.com\/california\/story\/2021-02-08\/several-of-d-a-george-gascons-reforms-blocked-by-l-a-county-judge\">More details<\/a> from the L.A. Times:<\/p>\n<blockquote>\n<p><em>In his ruling, Judge James Chalfant noted that the \u201cthree strikes\u201d law requires prosecutors to \u201cplead and prove\u201d all prior serious or violent felony offenses. He found Gasc\u00f3n\u2019s directive ordering prosecutors not to file such enhancements unlawful, and cited several appellate cases that upheld the argument that strike offenses must be charged under state law.<\/em><\/p>\n<p><em>\u201cA district attorney\u2019s discretion is not unlimited. He or she must work within the framework of the criminal system,\u201d Chalfant wrote. \u201cThe legislature also is entitled to enact laws intruding on the executive or judicial branches of government so long as they do not defeat or materially impair that branch\u2019s core function.\u201d<\/em><\/p>\n<p><em>In a 46-page ruling, Chalfant also barred Gasc\u00f3n from ordering prosecutors to dismiss any sentencing enhancements in active cases, unless they can argue that there is insufficient evidence to prove the enhancement or that the dismissal would be in the interest of justice.<\/em><\/p>\n<\/blockquote>\n<p>As The Times notes, however, \u201cGasc\u00f3n can still bar prosecutors from filing most sentencing enhancements in new cases, though enhancements for prior strike offenses must still be charged, according to the order.\u201d<\/p>\n<p>Several prominent progressive leaders and organizations in L.A. County are standing with Gasc\u00f3n.<\/p>\n<p>Black Lives Matter\u2019s L.A. chapter issued a <a href=\"https:\/\/twitter.com\/cd4losangeles\/status\/1359606730431205376\/photo\/1\">statement<\/a> on Wednesday voicing support of Gasc\u00f3n, contending that \u201cending Three Strikes and sentence enhancements\u201d were part of his platform during the campaign, and a key reason voters supported him by a margin of 53.72% to 46.28% over the two-term incumbent.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">We stand with <a href=\"https:\/\/twitter.com\/BLMLA?ref_src=twsrc%5Etfw\">@BLMLA<\/a> and <a href=\"https:\/\/twitter.com\/GeorgeGascon?ref_src=twsrc%5Etfw\">@GeorgeGascon<\/a>. <a href=\"https:\/\/t.co\/b6u31nXhQu\">pic.twitter.com\/b6u31nXhQu<\/a><\/p>\n<p>\u2014 Councilmember Nithya Raman (@cd4losangeles) <a href=\"https:\/\/twitter.com\/cd4losangeles\/status\/1359606730431205376?ref_src=twsrc%5Etfw\">February 10, 2021<\/a><\/p>\n<\/blockquote>\n<p>\u201cThe people of Los Angeles voted for George Gascon because they want progressive, transformative change, and an end to punitive sentencing \u2013 like three-strikes \u2013 which has been used to harm Black defendants and communities disproportionately,\u201d BLM\u2019s statement read.<\/p>\n<p>While Gasc\u00f3n did <a href=\"https:\/\/www.dailywire.com\/news\/4-key-changes-coming-to-l-a-if-soros-backed-challenger-wins-biggest-d-a-race-in-america\">pledge<\/a> not to enforce California\u2019s Three Strikes law if elected, he only committed to eliminating gang enhancements while on the campaign trail.<\/p>\n<p>Still, Gasc\u00f3n maintains that \u201con November 3, more than 2 million people in Los Angeles County voted for a system of justice based on science and data, not fear and emotion.\u201d<\/p>\n<p>\u201cWe can no longer afford \u2013 morally, socially or economically \u2013 to justify tough-on-crime policies in the name of victims when a majority of the survivor community supports rehabilitation over excessive sentences,\u201d Gasc\u00f3n said after Monday\u2019s ruling. \u201cThe long-term health and safety of our community depend on it.\u201d<\/p>\n<p><strong><a href=\"https:\/\/www.dailywire.com\/news\/la-prosecutors-union-sues-new-da-gascon-over-special-orders\">Related: Los Angeles Prosecutors Union Sues New Progressive D.A.
