Ted Cruz (R-TX) on Tuesday slammed President Biden\u2019s Supreme Court criteria of only nominating a \u201cblack woman\u201d&nbsp;to the bench.<\/p>\n<p>\u201cRacial discrimination is wrong. Period, full stop. One of the most depressing things about Democrats today, they\u2019re very comfortable discriminating based on race,\u201d <a href=\"https:\/\/twitter.com\/SteveGuest\/status\/1488578674811183106\">said<\/a> Cruz,&nbsp;who has argued nine cases in front of the Court.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cWhen Joe Biden throws out a [race] quota\u2026 he is, number one, rejecting regardless of&nbsp;merits, everybody else, whether they are white, black, Hispanic, or native American,\u201d Cruz made the case against affirmative action.<\/p>\n<p>\u201cIt ends up being insulting to African American women,\u201d Cruz added.<\/p>\n<p>Since Lyndon Johnson\u2019s 1960s&nbsp;<a title=\"This external link will open in a new window\" href=\"https:\/\/www.dol.gov\/agencies\/ofccp\/about\/executive-order-11246-history\" target=\"_blank\" rel=\"noopener noreferrer\">so-called civil rights legislation<\/a>,&nbsp;racial preferences \u2013 euphemistically called \u201caffirmative action\u201d by some \u2013&nbsp;is a phrase conveying the&nbsp;<a title=\"This external link will open in a new window\" href=\"https:\/\/plato.stanford.edu\/entries\/affirmative-action\/\" target=\"_blank\" rel=\"noopener noreferrer\">practice<\/a>&nbsp;of government policies to achieve unequal outcomes to narrow the gap of \u201cinequities\u201d that have derived from past errors.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Sen. One of the most depressing things about Democrats today, they&#8217;re very comfortable discriminating based on race. \u2026 When Joe Biden throws out a quota \u2026 [he is] rejecting regardless of merits everybody else.&#8221; <a href=\"https:\/\/t.co\/8O70wbrJVy\">pic.twitter.com\/8O70wbrJVy<\/a><\/p>\n<p>\u2014 Steve Guest (@SteveGuest) <a href=\"https:\/\/twitter.com\/SteveGuest\/status\/1488578674811183106?ref_src=twsrc%5Etfw\">February 1, 2022<\/a><\/p>\n<\/blockquote>\n<p>Biden made it clear during the 2020 campaign and confirmed last week he would only nominate a \u201cblack woman\u201d to the Court to&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/01\/26\/chuck-schumer-joe-bidens-supreme-court-nominee-to-receive-prompt-hearing\/\" target=\"_blank\" rel=\"noopener\">ensure<\/a>&nbsp;his administration achieved equal \u201crepresentation.\u201d<\/p>\n<p>\u201cI\u2019m looking forward to making sure there\u2019s a black woman on the Supreme Court, to make sure we, in fact, get every representation,\u201d he said.<\/p>\n<p>Cruz is not the only senator to decry Biden\u2019s Supreme Court criteria.&nbsp;Sen. Susan Collins (R-ME) has also <a href=\"https:\/\/twitter.com\/therecount\/status\/1488566409085042690?s=20&amp;t=Gseeutya7vjmkz3P3OcNJg\">disagreed<\/a> with Biden\u2019s campaign \u201cpledge\u201d to only consider a \u201cblack woman.\u201d<\/p>\n<p>When CNN pushed back on Collins, suggesting&nbsp;Ronald Reagan also made a campaign pledge to fill a Supreme Court vacancy with a woman,&nbsp;Collins said that Reagan only stated \u201cone of his Supreme Court justices would be a woman.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>\u201cYou\u2019re skipping over what he exactly said\u201d&nbsp;Collins added.<\/p>\n<p>Constitutional law expert&nbsp;Jonathan Turley, who testified at Donald Trump\u2019s impeachment trial at the request of Republicans, has also <a href=\"https:\/\/www.foxnews.com\/opinion\/biden-supreme-court-reagan-trump-jonathan-turley\">distinguished<\/a> between Biden and Reagan\u2019s criteria.&nbsp;Turley explained his opinion in a Fox News op-ed last week:<\/p>\n<blockquote>\n<p>Reagan did not exclude anyone other than women in being considered while making clear that he wanted to give one of his vacancies to a female candidate.<\/p>\n<p>On Oct. 15, 1980, Reagan declared that \u201cI am announcing today that one of the first Supreme Court vacancies in my administration will be filled by the most qualified woman I can possibly find. \u2026 It is time for a woman to sit among the highest jurists.\u201d<\/p>\n<p>Notably, it was Jimmy Carter who pounced on that pledge as creating a threshold gender criteria. Others noted at the time that Reagan was simply pledging that he would select a woman in \u201cone of the first Supreme Court vacancies\u201d rather than the first vacancy. Indeed, when a vacancy did arise, aides told the media that there was \u201cno guarantee\u201d that he would select a woman.<\/p>\n<\/blockquote>\n<p>Republicans also came to regret Reagan\u2019s appointment of that woman, Sandra Day O\u2019Connor, as she proved the key fifth vote against several critical priorities to conservatives. Reagan focused on merit for his subsequent nominees, including Antonin Scalia and William Rehnquist.<\/p>\n<p>Biden told reporters last week his Supreme Court nomination would come before the end of February. Sen. Schumer (D-NY) and chair of the&nbsp;Judiciary Committee, Sen. Dick Durbin (D-IL), have promised to hold prompt congressional hearings on Biden\u2019s nominee.<\/p>\n<p>On Tuesday afternoon, Biden met with&nbsp;Durbin and committee ranking member Sen. Chuck Grassley (R-IA) to speak about his Supreme Court nomination. After the meeting, Biden <a href=\"https:\/\/mms.tveyes.com\/transcript.asp?PlayClip=FALSE&amp;DTSearch=TRUE&amp;DateTime=02%2F01%2F2022+14%3A12%3A31&amp;market=m1&amp;StationID=205\">told<\/a> reporters he and the two Senators are experienced at selecting a Court nominee:<\/p>\n<blockquote>\n<p>We\u2019ve done a lot of supreme court justices, Senator Grassley and I, and Senator Durbin. We\u2019ve worked together on supreme court nominees.
