Part of his punishment by the university included taking a racial sensitivity course, which included the same redacted slur in its training materials, the Foundation for Individual Rights in Education (FIRE) <a href=\"https:\/\/www.thefire.org\/lawsuit-professor-suspended-for-redacted-slurs-in-law-school-exam-sues-university-of-illinois-chicago\/\">reported<\/a>.<\/p>\n<p>As The Daily Wire previously <a href=\"https:\/\/www.dailywire.com\/news\/law-professor-suspended-after-responding-to-student-complaining-about-exam-question\">reported<\/a>, Kilborn included on his Civil Procedure II exam in the fall of 2020 a question that included edited references to racial and gender slurs. The question was about a hypothetical case regarding gender and racial employment discrimination.<\/p>\n<p>At one point, the question discussed allegations from a hypothetical employee regarding her treatment at a hypothetical company, saying this employee quit \u201cafter she attended a meeting in which other managers expressed their anger at Plaintiff, calling her a \u2018n___\u2019 and \u2018b___\u2019 [sic].\u201d<\/p>\n<p>The question caused a backlash from the Black Law Students Association, which claimed Kilborn\u2019s exam question \u201cshocked students and created a huge distraction from taking the exam.\u201d The BLSA circulated a petition demanding Kilborn be removed as chair of the academic affairs committee \u201cand from all other committee appointments he holds.\u201d The petition was sent to dean Darby Dickerson and Chancellor Michael Amiridis.<\/p>\n<p>Kilborn met with a member of the BLSA for a conversation on Zoom after the petition was created. During that conversation, the BLSA member asked the professor when Dickerson hadn\u2019t given the \u201cattack letter\u201d to him. Kilborn allegedly speculated, in jest: \u201cI suspect she\u2019s afraid if I saw the horrible things said about me in that letter I would become homicidal.\u201d<\/p>\n<p>The BLSA member reported this comment to the school\u2019s Behavioral Threat Assessment team, and Kilborn was placed on indefinite leave.<\/p>\n<p>Kilborn, however, believed his suspension was due to the exam question, and even said he was \u201cactively misled into believing my suspension was related to that language,\u201d according to Northwestern University Law Professor Andrew Koppelman, who&nbsp;<a href=\"https:\/\/archive.is\/jTqT1\">reported<\/a>&nbsp;on the story for The Chronicle of Higher Education.<\/p>\n<p>Kilborn is now suing UIC for violating his First Amendment rights, with the help of FIRE\u2019s Faculty Legal Defense Fund.<\/p>\n<p>\u201cThe only thing that will hold UIC accountable for its unconstitutional actions is a lawsuit,\u201d<\/p>\n<p>Kilborn said. \u201cFIRE\u2019s Faculty Legal Defense Fund&nbsp;gave me the strong medicine of real legal action, and UIC has given me no choice but to use it.\u201d<\/p>\n<p>Kilborn reached a resolution with UIC last July and \u201cagreed to alert the dean before responding to student complaints about racial issues and to audio-record his classes,\u201d FIRE reported. Kilborn was fine with the agreement and had already decided to take those actions on his own. Part of the agreement also said that Kilborn would <em>not<\/em> have to attend sensitivity training, but after the BLSA complained along with Jesse Jackson, UIC reneged on its agreement and required him to participate in a lengthy \u201ctraining on classroom conversations that address racism\u201d as well as write reflection papers before allowing him to teach again.<\/p>\n<p>\u201cIn a stunning display of unintended irony, the&nbsp;<a href=\"https:\/\/thefire.org\/university-of-illinois-chicago-training-materials\">individualized training materials<\/a>&nbsp;include&nbsp;<em>the same<\/em>&nbsp;redacted slur that Kilborn used in his test question,\u201d FIRE reported.<\/p>\n<p>\u201cUIC crucifies Kilborn for using a redacted slur, then turns around and forces him into anti-racism training that uses that same slur,\u201d said Ronnie London, head of FIRE\u2019s Faculty Legal Defense Fund. \u201cKilborn is effectively showing up to re-education and being handed his own text.\u201d<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
